"eyewitness news" reporter alexandria hoff is live from roosevelt mall in northeast fail with more on how this all happen, alex. >> reporter: it was clear through social media posts that some people inside this macy's at the time thought they heard gunshots but we have been told that was just a sound of a hammer, against glass. this happened inside of the macy's in the roosevelt mall off of roosevelt boulevard and cottman avenue around 2:30 when three males smashed through a case containing watches and fled. unknown quantity was taken. police say stores checking inventory to find out and see if any other items were stolen. authorities say that the trio fled in a silver mercedes benz 350 sedan, now that description matches the getaway vehicle involved in the early tuesday smash and grab theft at boyds in center city. in that incident another reek will was used to smash through an outside glass window, mens

division on civil rights, says that 30 year-old with down syndrome was moved against her parent's wishes from a classroom with diaper changing services to one without. despite a doctor's note saying she could not be fully poddy trained until five, officials a say in march 2015, the three-year old was given a week to go poddy or to get out. then was expelled. >> under the new jersey law against discrimination day care centers are required to provide reasonable accommodations. >> reporter: mari sickconn is managing attorney for disabilities rights new jersey. she isn't involved in this case but says it is clear violation of new jersey law begins discrimination that applies to publish and private day care centers. she says diaper changing is certainly a reasonable accommodation. >> day care center that serves children from infants to five years old, they are changing diapers. it is not something that they do not do. >> reporter: noble learning communities which operates chesterbrook and 180 other private schools gave us a statement saying due to pending litigation we are

unable to address details of the specific case. however, our schools are dedicated to serving need of the diverse student population, including many with disabilities. she says that parents have children with disabilities should know, and demand their rights. >> new jersey law against discrimination has always been broad and the courts in new jersey say that this is because of the discrimination statute it should be read broadly to basically get rid of the discrimination in the the state. >> reporter: lawsuit which was filed in burlington county superior court does not give names for little girl or her parents but we do understand from that lawsuit that the little girl has been enrolled in another preschool. in moorestown i'm cleve bryan, cbs-3 "eyewitness news". >> thank you, cleve. amtrak has agreed to 265 million-dollar pay out for victims families and survivors of last year deadly train derailment in philadelphia. on the night of may 12th, 2015, amtrak train 188 jumped the tracks as it entered the curve in the the port richmond
