this week. in indiana, tornadoes. in minnesota, record rain and widespread flooding. across the region, thousands have been driven out of their homes. and ef-1 tornado touched down in minneapolis. >> i seen it started to form. two minutes later i see debris every. >> reporter: from minnesota to ohio, flash flood warnings. >> up to my knees down the street. >> incredible. this doesn't happen. you get flooding in the spring but unbelievable right here. >> torrential storms downed trees and power lines and disrupting the most important plans. more than 25 inches of rain so far prompting 35 counties to declare imagines. >> to have river flooding like this in june is completely out of the ordinary and something

our communities never seen before. >> reporter: a wet spring and early summer have swollen rivers in four states. dozens of river gauges are reporting flooding. in st. paul, the mississippi river is already at about 20 feet, six feet above flood stage. >> that was nbc's john yang reporting. it is a court ruling hailed as victory for same-sex couples. they are declaring in unconstitutional. the three-judge panel voted 2-1 yesterday in favor of allowing couples to marry regardless of sexual orientation. the state of utah will appeal the u.s. supreme court -- to the u.s. supreme court, that is it. same-sex marriages won't take place while that appeal is being heard. it sparked mixed reactions. >> this decision is an absolute victory for fairness and equality, for all families in

utah, in every state in the 10th circuit and every state in this great nation of the united states. >> i'm disappointed because i do believe that states do have the right, through the democratic process, to make the determination on the definition of marriage. our people have spoken on that issue and that is part of our law. that being said, the sooner we can get to supreme court the better i would like it. >> reporter: it is called a major victory for privacy rights in a unanimous vote police officers must obtain a warrant to search people's cell phones. people are arrested every year for minor ovents and a century now the court says police can search they arrest to look for weapons and a crime but now cell phone searches are off limits unless there is warrant. supreme court dealt a blood to a company called areo allowed paid

he is falling a lawsuit against the obama administration on behalf of congress. he's accusing the president of going around the law by using executive orders in a memo he called it aggressive unilateralism that could lead to, quote, king-like authority. stay out. a stern warning from secretary of state john kerry. he urges other countries not to take action against insurgents in iraq saying it could worsen the country's sectarian turmoil and that turmoil is fueled largely by isis and new concerns this morning about their next large-scale attack. "the new york times" is reporting terrorists are advancing on the country's second largest dam and, if taken, it could cause devastating floods. a house panel in the united states votes on saturday mail delivery and figures to be a popular decision. it could save the u.s. postal service about a billion bucks a

helping of scrambled politics. after being criticized for keeping reviews to herself, republican senator susan collins of maine announced her support for same-sex marriage on wednesday. collins is only the fourth gop senator to publicly support the issue. president obama says only in congress do some people believe climate change is a hoax, fad, or liberal plot. the president was speaking to the league of conservation voters in washington, d.c. when he made the comments. >> many who say that -- actually, know better than and they are just embarrassed, they duck the question. hey, i'm not a scientist which really translates i accept the man-made climate change is real but if i say so outloud, i will be run out of town by a bunch of fringe elements that think climate science is a liberal plot.

then there were two. republican national committee announced top two cities hoping to host the party's next national convention. on twitter the rnc posted is it cleveland or dallas? you choose. josh earnest took over for jay carney this weaniek and now is taking to twitter. yesterday, he wrote the following. i guess i'll ask some questions what is going on? former secretary of state hillary clinton says she doesn't need anyone to fit in her record. she made that remark on pbs after her husband former president clinton defended her situation and critics calling her out of touch. wednesday the anniversary of 30 years of "purple" release.

minnesota democrat keith ellison posted this video. he is not the only prince fan. new york democrat joe crowley posted a video of his own and in it, he is covering part of raspberry beret. that is your morning dish of "scrambled politics." i'm joined by bob franken who, thankfully, won't be singing any prince songs, right? >> i was 5 years old when they came out. i wondered what the numbers of congress were doing all the time which, by the way, is a great segway into what we are going to be talking about here. isn't it? >> let's get down to it. house speaker john boehner plans to move forward with a lawsuit we have been talking about against president obama for misusing executive powers and side-stepping congress. is there a solid case here, bob? >> it's really kind of hard to remember this is an election year, isn't it?

>> oh, yeah, right. >> this is a new theme for the republicans that barack obama assuming dictatorial powers and never mind the fact that going back to glover cleveland have used more executive order. is there a constant tension between the legislative branch of government and the executive branch but chances are if a court even accepts this remembering that the judicial branch doesn't like to interfere with this kind of squabble, if this would make it to the courts it would be far beyond the barack obama presidency. >> who is going to pay for this? josh earnest says republicans want taxpayer money. will taxpayers support such a move? >> the answer they wouldn't probably have much choice about the matter. congress could certainly be able to come up with the money to do it. that is really not the issue. the issue is whether this is just ball politics that is being
