chance to look of the alleged killer face to face. the makeshift memorial keeps growing across from the theater a day after a brief hearing to read 24-year-old james holmes his rights. the accused mass murderer seemed dazed as family members of some of the victims sat nearby. >> he does look fairly demonic or something like that. his eyes are kind of crazy- looking. you know? there's something wrong with that man. >> holmes recently dropped out of grad school. police say he spent thousands of dollars on weapons and ammunitions and dressed up like a batman character and opened fire on this theater. 10 were dead in the theater and two died later. among them were jessica. her friends called jessica's family from the theater. >> we were awakened by the most horrific scream i have ever heard in my life. i thought somebody was in tmy

house, stabbing my wife in the heart. >> the victims range in age from 6 to 51. there are many stories of heroism. her friend saved her life. they made it out alive. >> we were waiting there literally in the mouth of hell. and when i say literally, i mean literally from every aspect. >> i just remember opening my eyes. i'm on the ground, blood everywhere, and i just hear her, "get up, get up." >> there is no word about motive. an entire community is left to wonder what led to the killings and how this devastated community will recover. formal charges will come monday. a decision by prosecutors on whether to seek the death penalty will come later. >> we have a continuing coverage in the colorado theater

>> police officers are investigating a late shooting in west baltimore. police say the shooting happened at mckean avenue. homicide detectives are now investigating. sensing for a man convicted in a murder-for-hire. he faces a life sentence without the possibility for parole. a woman testified she paid jeter $25,000 to kill a dentist. >> the aclue want to end battles having more training for police. nadia ramdass is live with the details.

>> this all spurs from a situation the lead to a lawsuit that the u.s. department of justice got involved. an arrest at the preakness is at the center of the dispute between a man and the baltimore city police department. a woman was arrested for allegedly assaulting somebody at a ticket counter and punching an officer. a witness said he recorded the arrest on his cell phone. police seized the phone, erasing his version of the incident. >> citizens have a right to -- as long as they are not interfering with the work of the police department, they have a right to record officers when they are doing their jobs out there in public to help keep the police accountable. >> baltimore city police say this is no longer an issue. last year they released new rules saying recorders must be

situation develops. >> thank you. the aclu wants police to go through more training. >> nadia ramdass is live at city police headquarters with the details. what prompted this request? >> this spurs from a 2010 situation that led to a lawsuit which the u.s. department of justice got involved. it was the recording of an arrest at the preakness that is at the center of a dispute between an owings mills man and the baltimore city police department. on the 2010 incident, officers attempt to arrest a woman who is on the ground and has a bloody nose. police claim she is intoxicated and assaulted somebody at the ticket counter and punched an officer. christopher sharp claims police took his cell phone and erased

his version of the incident, leading the aclu to sue baltimore city police. >> citizens have a right to -- as long as they are not interfering with the work of the police department, they have a right to record officers when they are doing their jobs out there in public to help keep the police accountable. >> baltimore city police released general order j-16, defining the policy on handling situations where citizens are recording. according to the department, it is a proactive stance following lessons learned from the past. >> i do not think there is any department in the country that has demonstrated a better commitment to showing its members that it is ok for individuals to record police activity in public places than the bpd. >> the aclu wants all police departments to cite clear guidelines that citizens have a right to record the actions of officers. the group also wants officers to receive training so they know the policy.

baltimore city police say this is no longer is a problem. they released guidelines last year saying police officers must allow these recordings and if they do not, they face department sanctions. nadia ramdass, wbal-tv 11 news. >> the body at the woman was found questionable. she was found inside an apartment. the man who also lives in the building was arrested and is being questioned about the woman's death. the body was so badly decomposed. >> $40 million for the city of baltimore. ray lahood was in town for monday's announcement. part of the funding will go to replace the kirk avenue depot
