patriots' season opener. tonight, rob gronkowski admits that he's not completely healthy. dan? >> reporter: david, there's good news and bad news recording gronkowski. the big tight end took part in his third straight practice tonight in foxboro. the bad news, his hamstring is bothering hill. he's getting stressed out. he -- getting stretched out. he originally hurt it last month. this month has his listed as the hammy isn't 100% but he's feeling good and hopes to take the field come sunday night. yeah, i mean, it comes down to the coach's decision and medical team and myself. we'll all get together and collaborate to see where i'm at. i want to be out there so bad, especially to help out the team, help out the team overall in any position. >> reporter: you can bet jimmy garofalo will feel a lot better about his first regular season

approaching worcester county. the best chances will be across western and central parts of indiana. a few scattered showers a downpour here or there. not likely to see a lot of lightning survive the trip. then we'll be moving off shore to the east. we'll try to wring out rain to the front as it moves through. the record is 93 that was set just last year, as a matter of fact. there is a chance, i think we could tie that record. the weekends have an interesting forecast. 'l a few. lisa? breaking news now. at least seven members of boston police's command staff will voluntarily wear body cameras. they will be wearing this equipment. this does not end the battle between the city and police officers union. a judge is expected to decide by noon tomorrow whether officers who don't volunteer can be forced to wear the body cameras as part of a pilot

saying that a danville, new hampshire woman who was found dead in her home was murdered. police found 51-year-old joanne's body on monday. an autopsy is complete but investigators are not yet releasing the cause of death and have not said if they have any suspects in the case. with charges now filed tonight, one of the people hit when a car crashed into a newton pizza shop is speaking out. he says he's glad that investigators took their time. six months it took to get it right. christina hager is live in wt christina? >> reporter: david that's exactly how the district attorney put it when we asked her today why these charges took so long. she explained, it is a complicated case, and it takes time to get it right. it took a half year for the man behind the wheel in this deadly crash to face charges. district attorney marian ryan explains why. >> we're fortunate to have lots

and that type of thing and it takes time to bring that all together. >> reporter: 55-year-old bradford indicted on two counts of motor vehicle homicide and one count of driving to endanger. the d.a. says he crossed into traffic on washington street, collided with other vehicles, and slammed into the sweet tomatoes restaurant. two people were killed. 32-year-old attorney gregory lauren and 57-year-old eleanor neely. her mother, eager for more answers. >> i just think at should be brought to justice. whatever he gets, he gets. it was tough. it still is tough, i'll tell ya. every day when the phone rings, i think it's her calling. >> reporter: seven people were seriously hurt. we caught up with one of them, tony wilson, as he headed to physical rehab, still recovering from back and rib injuries. >> i'm much better today than yesterday and the day before.

forward helps, he says, whether new safety barriers at the scene or new charges in the legal case occur. >> it's good to at least see there is a resolution moving forward. justice takes a long time. talking with the d.a. and seeing what she said, you know, they want to get this right. >> reporter: a friend of the driver, bradford did say early on that he struggles with medical issues. today the d.a. did not address that he faces a judge in court within the next couple of weeks. in newton, christina hager, wbz news. >> tonight, boston police are investigating a deadly shooting in dorchester. the victim was a man in his 20s. officers rushed to ripley road around 7:45 last might. they found the man shot several times. there was no reviving him. he died at that scene. a construction worker is recovering tonight after getting trapped at a work site in cambridge.

this morning. firefighters used ropes and pulleys to get this man out of a trench that was 30 feet deep. paramedics then took the man to the hospital. people who took the blue line are hoping for an easier commute after a power problem at the maverick station caused huge delays. you can see the platform there was packed as people were just trying to get to work. it took more than two hours to finally fix that issue. >> campaign 2016 tonight. depending where you live, you might not know it, but yep, massachusetts. no statewide races are on the ballot, but there are legislative races. today governor baker was in swampscott casting his vote. turnout is expected to only be 10% and the polls close tonight at 8:00. >> what would you do if you were elected about aleppo? >> about? >> aleppo. >> and what is aleppo?

candidate gary johnson with a major gaffe this morning. johnson later said he simply blanked when asked about the city at the center of the syrian crisis. while he tries to make his case to join the presidential debate, hillary clinton and donald trump were focusing today on foreign policy. liam? >> lisa, they both took part last night in the presidential forum. >> reporter: trump claimed in a series of tweets that he won clinton, meantime, repeated her attack on trump's praise of vladimir putin. hillary clinton going hard after donald trump, slamming his claim that america's generals had been "reduced to rubble" and his praise for russian president putin. >> what would ronald reagan say about a republican nominee that attacks america's generals and heaps praise on russia's president? >> reporter: and clinton

old student are suing phyllis exeter academy after their son was suspended with having sexual activity with a girl. the boy was suspended for a semester. the parents now say the school is trying to expel their son because of a recent "boston globe" story that criticized how they handled a separate sexual harassment case. david? lisa, today was the first day of class for a controversial new charter school approved for isn't ready yet so students had to travel 20 miles to go to class at a temporary location. now we learned some families are already looking to get out. >> reporter: the school was supposed to open its doors today near the city's downtown. as we told you last week, inspectors recently discovered the building was being renovated without the required permits and had to stop the

so school leaders had to bus kids 22 miles away to norwood. a spokesperson told me 54 students had already unenrolled from the charter and tried to get back into the public system. also 16 kids showed up at the public schools on tuesday and had to be sent home because they weren't enrolled yet. the situation had district leaders say it's putting an extra strain on their resources. one school's main member told meos the state is lahlouing them to open under these circumstances." >> the charter school debate will heat up. if approved, it could allow a dozen new charter schools per year to allow enrollment to expand. after a long night and long swim, a kayak who're capsized as sea is now safe. the coast guard spent hours

in quincy. they called off the search when the man's girlfriend called in to say he was safe. he was not wearing a life jacket. he lost all of his belongings but incredibly swam ashore. it's one of those days where you think it's warmer than you think, but now we have this strange fog. >> this is apparently affecting flights. it is a little like we've seen in the last couple of days where the buildings of boston have disappeared, too. >> logan is right there being affected by the fog. boaters are affected as well. the cold front moving from the west is starting to draw in from the low clouds sitting over the ocean before the front pushes the west wind in later on tonight. competing forces right now.

dew points are well up into the 60s. it's going to be muggy tomorrow but not quite as tropical as it has been these last couple of days. here's what we're watching. we have the center of the remnants of hermine, which are moving offshore and bringing the fog right up to the coastline. later on this evening, the cold front will push the fog out to see. here's a look at the live doppler radar. a good cluster of thunderstorms right now toward albany, new york. these will be moving across new england as we head into the course of the evening. there is much-needed rainfall and hopefully they can hold together a little bit. by 8:00, we can see the downpours working towards south western new hampshire as well. the evening plans are just after sunset when the first scattered showers arrive. the actual cold front doesn't get here until tomorrow morning.

very warm for us on friday. the front doesn't get far offshore. it's going to stall right along the south coast. so i think as we head into the late afternoon and evening, the clouds will be on the increase and there might be a few thunderstorms to form that front along the south coast. overnight lows, 60s to low 70s. very warm, very muggy and tracking some of the rainfall. tomorrow morning, we're on the dry side. a few partly sunny skies, a friday. as we head towards wednesday, we see the wind turning to the west-southwest bringing in slightly air. as we move toward the evening, it is full fledged summer. upper 80s to 90. high temps near 92. hyannis is going to be a very warm day and good beach day, especially south shore up to

little more of an issue. the highs 85 to 09 with the west-southwest wind. the same front is hanging around saturday morning. as it moves its way northward, we'll see a band of cloud cover and filtered sunshine on saturday. i think most of the shower and rain activity will stay off to our northwest. then another front, a busy forecast, arrives saturday into sunday. as we look toward early sunday, a chance for showers and storms. i don't think it will be saturday, you have 70s at the coast. 80s inland and partly sunny skies. sundays some scattered showers are in the storm late saturday into sunday morning. then we'll dry out and look at the dew point trend. finally sunday night, the air moves in. monday and tuesday are looking like gems. 70 and dry air on monday. low 80s on tuesday. well into the 80s again on

in july, a playboy playmate took a picture of an unsuspecting woman who was changing in a locker room in the gym. she then posted on snap chat with the caption, "if i can't unsee this then you can't, either." the woman has been identified and is helping police. mathers has since apologized and said she intended only to share the picture with her friends, not all of her followers. if she's charged, she could face up to six months in jail for viin privacy laws. her defense doesn't seem any betterp. >> no. just the act itself is so mean. bad, bad, bad. a romantic engagement captured on camera. >> now the local photographer wants to find them. she saw the proposal at sunset. the guy down on one knee and from a distance you could see what was happening. the woman didn't want to interrupt the moment so she took the picture but never connected. the woman's daughter posted the

. >> now at 5:30, a deadly crash shutting down a highway. some of the passengers thrown 495. not everyone inside that vehicle was wearing a seat belt, and two did not survive. >> they were headed to maine for work. beth germano is live where paramedics took some of the crash victims. beth? >> reporter: one of the vices remains in fair condition here. it was a crowded vehicle on a long day trip to do a construction job. when the van flipped in merrimac, a survivor tells us not everyone was secure inside.

debris strewn highway tells the story of what happened this morning when the driver lost control and the vehicle rolled into the median strip on route 495 north in merrimac. 23-year-old jose with -- 23- year-old hose say with an injured arm says a tire blue. he has little memory of what happened next. he speaks through the interpreter. >> he kind of blacked out during the time the van was rolling and came to his senses when they came to a stop. >> repr: others traveling from milford to a home many maine for a roofing job. one person thrown from the vehicle was killed. another later died from his injuries. one of the victims, jose's uncle. he admits not all were wearing seat belts. >> he says the driver had a seat belt on, but the other guys were in the back with no seats in the back. so they were just on top of the tarps.
