29 were injured in the saturday attack. two days later a bloodied ahmad ramahi. wheeled away on a stretcher hours after the fbi put out an alert for the 28-year-old prime suspect. investigators say the afghan immigrant was arrested after a shootout with police. he struck one officers bullet proof vest and shot another. officers returned fire striking him multiple times. >> we have every reason to believe this was an act of commissioner, and the fbi told reporters he'd been directly linked to the saturday bombing and other bombing that narrowly missed runners. >> searches and interviews were conducted at residences in elizabeth, new jersey and in perth new jersey. >> without going into specifics, they zeroed in on him sunday. sources tell cbs news, one of

let's check in with eric fisher. did it put much of a dent in the drought? >> depends where you live. certain towns, tremendous amounts of rainfall today. so the answer is yes there. others did not when the rainfall sweepstakes. we'll show you the breakdown in a moment. was there almost 2 inches of rainfall today. the most rain today since late february. it's been a long time since we got any significant rain event in the area. it fell into distinct bands. across western and northern massachusetts into southern new hampshire. this is where we saw one as much as 5 inches of rain today. i have a band from southern connecticut on the south coast and across cape cod and the islands. in between lower rain totals, it's a good thing but not as much as you'd like to see. one of the dryer spots was the wettest day in a month in the city of boston. when you look at rainfall

this is updated with today's rain. so we still have over seven- inch rainfall deficit this year alone in concord, nearly eight inches in worcester. who do a few showers moving through this evening. expect a few scattered showers as we had through the overnight. foggy, very humid, and tomorrow we bring in that drier air. we also bring in summer heat. talk about that in a bit. a possible lightning strike force the just -- the jetblue plane to make an emergency landing. flight 1731 on its way from new york to bermuda when the pilots reported the plane had been hit by lightning. no one was hurt. the plane to land safely at logan. the plane landed without incident at 9:45 this morning. also tonight, the driver in the deadly sweet tomatoes crash enters his plea of not guilty. >> both lawyers addressed his medical condition, which we now know is multiple sclerosis. with team coverage of the story tonight, including an itmack investigation. we begin with christina hager live in newton with more on what happened in court.

charges in court today, including motor vehicle homicide. attorneys did discuss his multiple sclerosis diagnosis but ultimately prosecutors said that was not to blame for the crash here, they said. they said speed was. prosecutors say was driving at full speed when he crashed into west sweet tomatoes restaurant. now half a year later >> not guilty. >> seven people were injured. relatives of the two people killed in the crash looked on. an office manager who volunteered at her church and young attorney. >> essentially, the defendant accelerated through the intersection at washington street, through a red light, clipped two vehicles, and drove straight into the sweet tomatoes restaurant.

sclerosis, but the prosecutor said investigators found the illness had nothing to do with the crash and prosecutors said despite the claim, the brake pedal was stuck. >> the judge allowed him to leave with no bail. his attorney offering a glimpse of what his defense might look like. >> i think i suffers from multiple sclerosis. he has for about 27 years. we all know the effects of multiple sclerosis. >> there were a lot of witnesses out here when this happened. prosecutors say none of them saw a break light on the vehicle, none heard a scratch, and one witness, even describe the feeling of a dust of wind when the vehicle blew through this intersection.

more on his medical condition. the defendants multiple sclerosis and any role it might have played in this deadly crash took center stage in the courtroom. whose job is it to decide whether someone with a medical condition is safe to drive? the itmack is here with a closer look. >> reporter: thousands of people surrender their licenses every year for medical reasons. here in massachusetts, doctors are legally required to report patients, so most of the responsibility falls on drivers to give up the keys. >> commonwealth recognizes that he has multiple sclerosis. >> after months of investigating, prosecutors concluded his disease was not a factor in the moments leading up to the deadly collision at sweet tomatoes restaurant. >> multiple sclerosis was not the cause of this crash. >> how difficult of a topic is this for doctors? >> i think it's one that can be really challenging. >> ms is tricky, because some patients are almost paralyzed by the disease while others can still drive safely.

it's not black-and-white at all. >> unlike other states, the itmack learned in massachusetts there is no legal requirement for doctors to report medical conditions that could affect driving abilities. >> should there be? >> i don't think so. patients may be less likely to seek care for those conditions and may not be as open andnk their doctor about the condition. >> instead doctors were police officers and concerned family members can voluntarily submit one of these requests for medical evaluations to the state. as a result, records show an average of 3200 drivers have to surrender their licenses each year well another 5000 drivers have to take a road exam or provide a medical clearance form. >> he will likely never drive again. >> his attorney has hinted ms contributed to the tragedy, but he has yet to provide more

greece. the ancient bones of the first to be discovered since dna analysis began. once they are able to test it, it could tell us a lot about the path. the bones have been in the water for 2000 years protected by a shipwreck. this is one rare request, but the owners of longfellow's wayside are asking if you've ever taken anything from the in accidentally or otherwise, please return it, no questions asked. the items are valuable artifacts. there celebrating its 300th birthday these back on display. among the treasures missing, a copy of the declaration of independence, stamps, silverware, antique dishes and paintings, and a corpse flower. just kidding on that last one. the corpse flower was never there. >> have you ever taken anything

toward the east. some of the showers may work back into the region overnight tonight. especially toward cape cod and the islands. at the same time, this front swinging from the west is going to kick the other front out to see. it's also going to bring in drier air. maybe this was the complaint today. 2 points near 70. this is about as humid as it ever gets this time of year. a really soupy night. it'll be humid, foggy, a few showers. temps in the 60s and tomorrow morning still a very humid start. as we look through the next few hours here, a lot of cl more shower activity and beneficial rain, it's expected to be toward the cape and islands into tomorrow morning. as the day goes on tomorrow, clearing from west to east across the area. that's going to bring in the warmth. it's also going to bring in sunshine. look at the highs. worcester at 81 tomorrow. upper 70s to around 80 at the coast line. your coolest spot for the cape. it will be very humid. then we get relief headed into tomorrow night.

the week a stretch of 80s all lined up for us. summer weather still going on strong. average high in boston is 71. looking at low 80s for tomorrow and wednesday, mid-80s thursday , and friday the chance to hit upper 80s before a sharp cooldown on the way this weekend which is right on time. our equinox is thursday morning. 10:21 in the morning. that we'll be the official start of the fall season. also, thursday night football g mid-70s, and the south westerly breeze. in terms of humidity, it drops off significantly for wednesday and thursday. much more comfortable air even though the temperatures are very warm. here is your accuweather seven day. note the changes looking toward the weekend. a band of showers friday night into saturday morning. we are talking 60s on saturday and sunday. dry air, bright skies, good apple picking weather right there. over to you. thanks. yesterday jimmy goes down after an incredible game.

it was really tough to watch. sports director steve burton's life tonight. i guess the big question now is we are assuming jacoby plays on thursday. do they need a backup? >> they are looking for a backup. i am going to say jacoby will be the starter on thursday night, but you have to think there's no way jimmy garoppolo can play on thursday night especially with the injury that he took landing on that shoulder. another quarterback. they haven't done so just yet. before we look ahead to the texans, let's take a look back. let's go inside the patriot locker room after the victory over miami. >> thank you, thank you, thank you. jacoby, way to step up. >> you never know when it's your time.

every time a new charter school opens in massachusetts, it takes funding away from regular public schools in that area. this year alone, charter schools will take more than 400 million dollars away from neighborhood public schools. ot right. instead of draining even more money from neighborhood public schools and giving it to charters, let's devote public resources to all of our students... not just a select few. don't lift the cap on charter schools.
