information came out this summer to reopen the case district attorney-elect kevin steele says they can bring justice to the victim, a woman who moved out of the country. she complained to the police after the attack and prosecutors elected not to file charges but today they are announcing three felony charge, felonies of the second degree against bill cosby for aggravated indecent assault. >> on the evening in question mr. cosby urged her to take pills that he provided by to her and to drink wine. the effect of which rendered her unable to move or respond to his advances and he committed aggravated indecent assault upon her. >> now, again, prosecutors say that cosby gave the victim wine and pills but left her frozen and paralyzed.

in this criminal complaint the woman recounts her story, the story she told to investigators saying she was unable to do anything to stop cosby's alleged advances. cosby is set to appear in a cheltenham courtroom later this afternoon where he face l face these three felony charges. that's the latest. deannano carrierer cf1 cf2 x

urged her to take the pills saying "these will make you feel good. the blue things will take the edge off." the victim asked if the pills were herbal and cosby replied "yes, down them, put them your mouth" and he motioned for her to put the three pills in her mouth. i want to talk about the second part of the affidavit that andrea constand went back home to canada and confided in her mother and told her mother what allegedly happened. according to this affidavit, mrs. constand, the victim's mother in this case, called cosby to find out what happened to her daughter. in the avid it says that although cosby did not identify the drug he gave to the victim, during the same conversation he admitted to the assault, to the fondling. through these admissions, the affidavit goes on to say that cosby corroborated the victim's report. in the same phone call the victim's mother, cosby apologized and offered to cover

expenses associated with therapy. also in this affidavit it talks about what cosby said to police and investigators. cosby's response is that he had given andrea constand nothing more than benadryl and that the two of them had both a social and romantic relationship and that this alleged encounter was nothing more than consensual. again, cosby is expected to be brought here to district court in elkins park a little bit late otheren this afternoon to be arraigned on these charges. reporting live in elkins park, rosemary connors, nbc 10 news. >> we are working to gather more details on this breaking news, stay with nbc 10 news for updates and get the latest any time on the nbc 10 app. chill kelly sacked. the reaction continues to pour in after the eagles fired their head coach in a sudden move last night. chip kelly went out like his inconsistent offense and the eagles owner will explain why he

did what he did and what is next for the birds at a 12:30 news conference this afternoon. kelly came aboard in 2014. he had two winning seasons and one playoff appearance. this year, kelly got full control of the eagles roster but the birds failed to make the post-season after changes that drained the team of its best players. comcast sports net's john clark is here with more on the news that left some surprised but a lot of people have opinions about this. john? >> reporter: when i got the e-mail from the eagles after 7:00, i had to look at it several times to believe. it said the eagles released chip kelly and i was stunned. i was looking to see if it was a fake e-mail. it shocked everybody. i think what shocked everybody was the timing because you have one game left in the season and this is not like the eagles owner, he went through the last year of ray rhodes at 3-13, the last year of andy reid at 4-12. chip kelly came from oregon as

have you found it? >> no, not yet, lauren, and i don't think we'll see much of it today. we had the fog this morning, the clouds, not really moving. they're going to stay locked in for today. so this is a satellite picture. the rain, though, that's far down to the south. slowly moving in this direction. we'll see some rain late tonight. most of the day will be dry. now we still have some areas of some sense fog, allentown still seeing a quarter mile visibility. 1-3/4 mile visibility in coatesville but the rest of the area looking good. those clouds are not budging too much. temperatures are close to 50 degrees for philadelphia. 50 in millville, 54 wildwood. 40 in allentown and that fog really is not letting those temperatures rise in those parts of the lehigh valley. as we go through the rest of today, by noon around 50 degrees and cloudy. staying cloudy by 6:00 p.m., 53 degrees. and i think the evening commute will stay dry, wouldn't rule out a couple sprinkles or light showers but the brunt of the

rain does come late tonight and then we're looking ahead to a colder 2016. i'll show you that forecast coming up. >> thanks, sheena. philadelphia police are now looking for multiple suspects who shot and killed a man in north philadelphia. investigators say they have surveillance video that captured the deadly shooting around 11:30 last night near eighth and ontario streets. when police arrived, they found the man lying in his -- on the sidewalk. he's in his mid-20s. he'd been shot more than half a dozen times and officers found casings from at least three different weapons. investigators say surveillance video shows four men approach the victim. they say each were seen pulling out a gun and firing. >> it's clear from the recording that these four shooters intentionally targeted this 25-year-old victim and shot him execution style. >> so far, police have made no arrests. new video this morning police hope will help them find a suspect in a shooting in cobbs

creek. video taken in the area shows the suspect, who is circled here in red, firing at the victim on spruce street at about 4:30 sunday afternoon. police also want to talk to the woman seen in the video as well as a man seen on crutches. they are considered witnesses. anyone with information should call police. police have arrested one man and they are looking for a second following a series of propane tanks in northeast philadelphia. we first showed you surveillance video of the burglaries earlier this month. police say their investigation led them a lot on wheatsheaf lane in port richmond where they found two vehicles and several tanks. police say they know the identity of the second man they're looking for. counterterrorism officials are also involved in this investigation. now to an update on a story we brought you yesterday morning. we have learned a man seen using a sledgehammer at the rainbow crosswalk in center city in philadelphia worked for the city water department.

the department issued a statement apologizing for the disturbance at 13th and local streets and any misunderstanding. a spokesperson for the water department went on to say it was not obvious to the casual observer that legitimate work was being done since a marked vehicle was not in the immediate vicinity. we continue to follow breaking news. criminal charges filed against bill cosby. the montgomery county district attorney's office made that announcement. we continue to get reaction to the decision and find out what it could mean for the embattled philadelphia native. plus, treasures in the trash. what authorities say this postal worker did that landed him in big trouble. and the clouds are stuck with us today. then rain late tonight and colder start to 2016. we'll take a look at this new year's forecast, what you can expect for new year's eve and if you're heading to the mummer's parade.

florida state troopers say a driver going the wrong way caused a crash on i-95 that killed the wrong people. authorities say a pickup truck driver was going southbound in the northbound lanes near miami at 1:00 a.m. this morning. the pickup slammed head on into another vehicle. the driver of the pickup died along with four people in the second vehicle. the crash led to a chain reaction of wrecks. >> that accident caused other accidents because vehicles came out of the express lane

colliding into other vehicles. >> investigators are trying to determine if drugs or alcohol played a role in the crash. today the so call aid influenza teen who ran to mexico will be returned to the united states. police caught up with 18-year-old ethan couch and his mother tanya on monday. he dyed his blond hair dark. authorities issued a warrant for couch earlier this month after his probation officer couldn't reach him. he was on juvenile probation after killing four people in a drunk driving wreck two years ago. at sentencing, his defense attorney made the affluenza argument, saying his wealthy parents coddled him and didn't teach him right from wrong. also happening today, chicago mayor emanuel is scheduled to reveal his plan for transforming his city's police department. the mayor's office says emanuel will call for new officer training to help reduce the intensity of conflicts. he's also expected to call for arming every street officer with a taser. emanuel has faced calls for his resignation after the deadly police shooting of 17-year-old laquan mcdonald.

well, the clouds are locked into place and, in fact, we still have areas of fog right now. mostly in the lehigh valley but it is going to stay cloudy through the area, especially parts of lehigh valley. late tonight we have rain moving in so some late showers, close to midnight is when we could see most of it. then we have a colder start 2016 so once we go into new year's eve, new year's day will be cooler than that. right now visibility is down to a quarter ni eer mile in allent. most of the areas north and west compared to today has improved have w v with visibility. low clouds across center city right now so it will stay like this through most of the day today. temperatures will be rising steadily to about the mid-50s by 4:00 p.m., then right around the low 50s going closer to midnight.

so we won't see a big drop in temperatures overnight, especially with the rain moving in. we're at 48 degrees philadelphia, 40 still in allentown, 30 in the poconos. 50 degrees millville, 52 in wildwood and atlantic city and here's the satellite picture. a lot of cloud cover across the area and more clouds on the way and this is all ahead of that rain. so the rain is down to the south. i think it should avoid most of the evening commute even though we can't rule out a couple light showers for the evening commute but most of it will be here later than that. so this is future weather. the rest of the day today the clouds are here, a couple stray showers possible but then late tonight, 11:00 p.m. to midnight that's when we get more rain movings in. so showers overnight. you may not notice you'll be sleeping through most of it, i think, and tomorrow by noon more sunshine in the forecast. going into 2016, here's midnight, nice and dry, so great for any fireworks on the first day of 2016 it looks to be sunny and on the chillier side. the new year's eve forecast,

in northtown to explain these charges. deanna, what are you learning? >> reporter: the statute of limitations was set to run out. they lasted 12 years and that was set to expire in january. here is the multipage criminal complaint charging bill cosby with aggravated indecent assault. he is facing three counts of that charge and is expected to turn himself into police some time today. we are working to find out when he will get his mug shot taken, when those fingerprints will be taken but we know afternoon he will go in front of a montgomery county judge. the district attorney held a news conference this morning explaining new information had come to light. this was a case investigators had begun to look into back in 2005 when the victim who was once an employee at temple university came to prosecutors and said she had been assaulted inside bill cosby's cheltenham home. she told police he gave her wine

and pills and she was frozen and paralyzed. back then, prosecutors declined to charge. they say new information is helping them press these charges now. >> not going to look at the past or actions that weren't taken at that point. it's not time to monday morning quarterback. we have examined the evidence in this case. we have made determinations in regard to it that the evidence is strong and sufficient to proceed at this point. >> reporter: prosecutors say the victim in this case is willing to testify in front of bill cosby at trial, that she has been cooperating with investigators all this time. prosecutors say it was their duty to reopen this case. they also said they can bring justice to this victim. reporting live from norris town, deanna durante, nbc 10 news. >> thanks, deanna. coverage continues with rosemary connors live in elkins

park. rosemary, you just took a look at the court documents. tell us more about them. >> i've been looking that the 20-page affidavit, lauren, for the past half hour or so. according to this affidavit, because andrea constand was in and out of consciousness that night she was at bill cosby's home in cheltenham, she was legally incapable of consenting to his actions. blostz told police according to this affidavit that it was a consensual sexual encounter and he gave the victim nothing more than ben trill, not something more potent. as we heard earlier today during that news conference from the district attorney's office, in large part the reason why the d.a.'s office decided to reopen this investigation earlier this year is because of depositions that were made available and made public from the civil case involving andrea constand and bill cosby. i want to read you a bit from this avid, portions of those depositions that came to light. during a reinterview view of mrs. constand -- the victim's

seasons. comcast sports net's john clark is live at the nova care center with the news that stunned eagles fans and some reporters, too, right, john? >> it stunned a lot of people, especially the timing of it. and the giants' head coach tom coughlin spoke in new york. the eagles are playing the giants to finish out the regular season and tom coughlin said "nothing surprises me this business, but this was close." that's how surprising it is. look at chip kelly in action. the eagles will take the practice field at the nova care complex at noon without chip kelly. pat she remember rmer will be t coach. jeff lurie has not been happy with the way this team has performed on the field, getting blown out in four of the last six games and the eagles faded down the stretch.

neighborhood on your smart phone and tablet. more than 18 million americans are bracing for historic flooding. missouri's national guard has been called up to help residents prepare for the torrential rain. >> reporter: a city submerged. >> it's very clear that missouri is in the midst of a very historic and dangerous flooding event. >> reporter: 16 counties are under flood warnings, including the area where the missouri and mississippi rivers meet. >> this came up quick. >> volunteers turned out on tuesday in the blistering cold to fill sandbags in st. louis where a flooded waterway threatened hundreds of homes. >> just grab everything you can and walk out the door. pretty much. >> reporter: rachel chambliss and her family are trying to prepare for what's to come. torrential rains over the past several days pushed already-swollen rivers and streams to virtually unheard of heights, forcing water over levees and rivers at all-time highs. in certain areas, some 20 to 30

feet above flood stage. floods forced scattered evacuations and the closure of interstates and hundreds of roads. a waste water treatment plant shut down after it sent sewage directly into nearby rivers and streams. it's a frightening flashback for those who went through the devastating 1993 flood that destroyed over 10,000 homes and impacted hundreds of towns. experts predict the mississippi river will reach 15 feet above flood stage, becoming the worst flood on record. second only to 1993. >> we've got a lot of water that we have to get out of the state, so to speak. we have countless leads to will stay underwater for several days. again, everybody get their message out, this is not done yet. >> that was nbc's morgan radford reporting. a camera captured a bridge collapse in england. floodwaters washed away a big piece of the 18th century structure. the bridge had already been shut

down due to structural concerns. thousands of residents have evacuated areas of northern england because of flooding there. pope francis offered sympathy for flood victims in the u.s., england, and latin america. at his weekly general audience, the pope asked the congregation to pray for those affected by the extreme weather events. a postal worker in new york faces charges after he got so overwhelmed with holiday deliveries that authorities say he dumped them into the trash. federal officials say daniel darby became stressed when the number of gifts and cards increased in december. they say he stuffed the item into garbage bags then threw them in the trash. the holiday mail was discovered two days later. he's charged with delaying and destroying the mail. meanwhile, a second new york mail carrier, james hayden, was also accused of stealing 50 gift cards from envelopes over the past year. a newborn baby is reportedly doing well after she was left outside in the freezing cold in washington state.

someone left the newborn outside a fire station in yakima. the child's umbilical cord was still attached. a firefighter preparing for an early morning workout discovered the child. >> i was pretty shocked to see a little infant inside, wrapped in towels inside the cardboard box but relieved when she did make a cry. >> reporter: the fire department is considered a safe haven where someone can hand over a newborn baby. however people are supposed to hand the child to a volunteer or firefighter. turkish police say they detained two suspected isis militants who are believed to be planning suicide attacks during new year's celebrations in that country. authorities say the two men were caught in a raid in turkey's capital city. police seized a suicide vest armed with a bomb and explosive device that was fortified with ball bearings as well as bomb-making equipment. official said the would be attackers were planning to detonate the bombs at two locations near bars and a shopping mall. if you're planning on

ringing in the new year in times square in new york, you'll have a lot of company, and not all of those folks will be partying. nearly 6,000 police officers will be on patrol. new york's police commissioner said recent terror attacks in paris and san bernardino, california, have raised fears. there are concerns that isis supporters could attack the nation's largest new year's celebration. the commissioner says police have spent months preparing. >> we are aware that the threat picture has changed be because of isis. it's changed significantly from what it was a year rag in ago o years ago and ahead of that, that's why we have enlarged our capabilities. >> hundreds of thousands of revellers are expected to pack times square. millions of people will watch from home. happening today, workers will test the famous ball drop in times square. the trial run will ensure the ball will fall without a hitch at midnight. this year's ball features more than 2,000 waterford crystals.

impact -- ouch. new research shows the impact electronic cigarettes may have on human cells. lab workers exposed cells to the vapor of two popular brands of e-cigarettes. these cells were more likely to show dna damage and die than cells not exposed to the vapor. while nicotine versions caused more serious damage, the nicotine-free vapor caused damage as well. a new study suggests cutting down on salt intake could be harmful for people with heart failure. those patients who stuck to a low-sodium diet were 85% more likely to die or be hospitalized for heart disease compared to those who didn't restrict salt. but experts say this is a very preliminary study so heart patients should not reach for the salt shaker just yet. today mummers fest continues at the pennsylvania convention center with a sneak peek at the fancy brigade. you are invited to see about a dozen fancy brigade clubs rehearsing for their strut down
