and couldn't get anyone to come to the door. the firefighters decided to go into the house and that's when the person inside began shooting. police say the shooter is now in custody. and is cooperating with authorities. we'll bring you more information as we get it. check the nbc 10 app for updates. could mccoy face charges after all? state prosecutors review the investigation after a brawl with two off duty officers. good evening. >> nbc 10's randy gyllenhaal is live at the d.a.'s office in center city. randy, it's only been a few days since philadelphia's top prosecutor revealed mccoy was in the clear. >> reporter: that caused an uproar of cops that thought the nfl star should face charges and now the state is stepping in for a second look at the case to divide whether the d.a. made the right call. running back mccoy was in the career. the case against him effectively closed until this week.

the pennsylvania attorney general's office will now take a second look at the nightclub brawl. >> the look at the paper work, the video, all of the video. and then they'll make a decision. >> reporter: john with the fraternal order of police demanded the new investigation. he says mccoy assaulted and seriously injured two off duty cops and hoping new information breaks the case open. >> clearly assault. i mean, from what i understand, there's more extensive video where it shows even more of an assault so, you know, we'll see what happens. >> reporter: the state must decide whether prosecutors in philly handled the case correctly. if not, they'll consider whether to ask a court to reverse the decision. the d.a. said it was rock solid investigation based on dozens of interviews, video and medical records. in the end, there was not adequate evidence to prove that any individual committed a criminal offense.

what is clear is that this case is causing a rift between cops who investigate crimes and the district attorney who prosecutes them. >> i can guarantee you at no time in the near future will any cop be voting for d.a. seth williams. >> reporter: the attorney general's office did warn an unprecedented move to overturn the decision of a local district attorney. at this point, unclear how long the new investigation will take. live in center city, randy gyllenhaal, nbc 10 news. new at 11:00, an eighth grade girl is charged as a juvenile after police say she stabbed another girl at school. nbc 10 was there as she was arrested wednesday outside the junior high in philly's logan police. police say the girl was stabbed with scissors. in decision 2016, tonight
