city in the country to pass a soda tax. but at what cost? >> tax is so high that it will have to be passed on to the consumers. >> good evening. i'm jacqueline london. the controversy isn't open as opponents are promising tonight to file a lawsuit over the tax. nbc ten's drew smith joins us live from the overbrook section. so many people want to know how much out of pocket will they have to pay for their drinks and what is the next step? >> first, the mayor has to sign it. that's expected to happen monday. then the law could go into effect january 1. if stores decide to pass along the entire tax to you the shopper, they could cost more than 18 cents a bottle and an 18-ounce bottle could jump by a dollar. city council approved a 1.5% tax

on sweetened drinks, including soda, regular and giant, teas, energy sports and some juice drinks. the revenue would improve parks and rec. >> our fight is not over. >> the tax violates the pennsylvania constitution, some say. >> that's why we're going to go before the court. >> the mayor said he's on strong legal grounds. >> they spent a long time twisting the facts of this whole debate on television with millionings of dollarsaged that wasn't effective. we'll fight the fight when it comes. >> berkeley has passed a similar tax. >> they have proof that the consumers are moving away from the beverages. >> while shop owners tell us they're bracing for a drop in business. >> i don't think it's fair.

>> and this market in particular is really worried. we're just one block up from city line avenue. they think customers will walk over into montgomery, avoid the the shop and avoid this tax. still, a big win for mayor kenny today on a tax that could have ripple effects nationally. >> the gunman responsible for killing 49 people in an orlando nightclub texted his wife during the attack. that's according to a source close to the family. that source told nbc news, omar mateen's wife texted her husband around 2: po in the morning to ask where he was. he replied "do you see what's happening?" she said no. and then the shooter responded with a text saying "i love you, babe." a gun shop owner met with omar mateen weeks before the shooting.

brandon joins us. they said theman made an unusual demand. >> they said the shooter requested a certain type of high-grade body armor which tipped them off. since the owner didn't see his i.d., he couldn't pass it along to the fbi. it was inside this gun shop in benson beach, florida, where he tried to buy ammunition and armor weeks before the mass shooting at pulse nightclub. the co-owner robert bell talked about the meeting. >> it was very sad that we had him that close. >> he said he asked for ammunition and armor. since there was no sale, the shop couldn't give a name to authorities because they never saw his i.d. >> it's the sickest feeling you

the rise of isis. a stark new warning from the director of the cia over the threat from isis. john brennan told congress that efforts to defeat isis on the battlefield have not put a dent in the group's ability to carry out attacks globally. he warped that isis is calling on supporters to attack in their home countries. new jersey governor chris christie is slamming president obama and democrats for pushing gun reform. christie is locked in a battle on gun regulation. one of his measures would streamline the process. he said he plans to fight the assembly on their vote. more than 600 casino workers in atlantic city say they'll go on strike if a contract is not reached by the 1th. they voted to authorize a

strike. it previously approved of other strikes. now that atlantic city's casinos are gaining financial footing. the casinos say they're working toward a contract that works for both sides. happening now, a man injured. a fire rips through a home in west philadelphia. the fire broke out about an hour ago on west 62nd street. the victim was taken to pes bateer ab hospital. >> a girl is in the hospital after being hit by a drunk driver tonight. its happened just before 8:30. authorities say the girl's injuries are serious but these expected to be ok. the driver was arrested for driving under the unions. new at 11:00, from the nbc 10

delaware bureau police are searching for several teenagers accused of assaulting a girl on tuesday. the girl was approached by a group of teenagers who prevenltded her from leaving the scene. during the con frontation, she suffered a cut to the right eyebrow. one teenager has been arrested and charged. the investigation is ongoing. a win tonight for philadelphia transgender students and their supporters. philadelphia's commission approved new guidelines tonight. among them is a measure that will allow students to access locker rooms and bathrooms that correspond to their jenlder identity. they may also dress according to their jenlder identity. the guidelines go into effect immediately. turning to our weather now, cloudy and mild in center city tonight. nbc's 16th and south streets where kids were dribbling in the

dry weather after the rain today. are we finished with the rain now? it depends on where you live, right? locks, location, location. sheena parvene has more. >> we're looking at a lot of stormy weather off around washington extending farther toward south. that's not going to move into our area but we could still see some showers rights around delaware as we go through the overnight hours. some of those showers could be lingering for delaware and south jersey tomorrow morning. looking into parts of kent county, lights rain moving in but the thunderstorm activity, that will remain to our west and down to our south. there's future weather. overnight a lot of it starts to die down. by the morning commute tomorrow there's a chance we could still see some lightningering showers in new jersey, maybe even delaware, that's at 8:00 a.m. tomorrow morning.

for renovations to ritenhouse fair park. >> we will be seeing a nice improvement by tomorrow morning. maybe still a few lingering showers. for the rest of the overnight period, though, showers still possible mainly south of philadelphia. can't rule out a thunderstorm. i think at this point, mainly delaware could see showers through the overnight hours. don't forget, your seven day forecast is always strolling right at the bottom of the streen for you. tomorrow we'll see gradual clearing from north to south and we'll see things starting to improve. we can't rule out lingering showers for new jersey and delaware. for father's day it looks dry and sunny. it looks really nice. most of the area dealing with cloud cover. we still do have the showers just off to our west and off to our south.

that's what we're looking at currently across the area. we're seeing some shower activity here, so in parts of delaware right around dover is where we're seeing light rain trying to move in. the heaviest of it is off in parts of maryland. farther to the south, look at this line of severe weather. these are really nasty thunderstorms. they're going to remain to our south if parts of maryland and virginia. we don't have to worry about that but we could see rain moving into parts of delaware tonight. look what it does. it dies down. by 8:00 tomorrow morning clouds are still around. i think we could still see some lightningering showers for new jersey and delaware. tomorrow afternoon, looking much better than it did today and the dry air keeps moving in for the weekend. high pressure starts to build in for the weekend so that will keep us nice and dry both
