william lynn next year. with monsignor william lynn out on bail, williams is already planning the prosecution against him. while some evidence detailing the history of priest abuse and cover-up in the archdiocese may very well not be allowed in court this time around. williams believes his team will have enough to convince a jury to convict lynn again. >> when allegations were made, of sexual abuse against priests in our archdiocese, how they would handle that, how they would not tell the police, how they would tell the parishioners that the priest is being moved for health reasons. >> reporter: d.a. williams did not waiver in his decision to retry the case, in large part he said because of the abuse survivors. an attorney in philadelphia for some of those survivors explains another conviction for lynn would be significant. but it shouldn't stop there. >> the only way to move the ball forward is with the archdiocese

to come clean, so to speak. not oppose the statute of limitations retroactive provisions, and allow survivors to come forward, and get the justice they want. >> reporter: we also spoke to monsignor lynn's attorney. he said even if a second jury convicts his client, lynn would probably only serve about two months in prison because that's how much time he has left on the sentence from his first conviction from the first trial. even though, d.a. seth williams said it's worth it in the fight for justice for the victims in this case. reporting live in center city, i'm rosemary connors, nbc 10 news. >> rosemary, thank you. nbc 10 was the only local station there when lynn walked out of prison late this afternoon. lynn was being held about two and a half hours north of philadelphia in wayne county. even if prosecutors get his conviction reinstated, he may not spend much more time in prison. deanna durante explains.

>> reporter: this is the prison where monsignor william lynn has been housed. his ride showed up here just after 2:30 this afternoon. a white suv pulled up to building number 14. the person that was driving that car brought him a change of clothes and less than 20 minutes later, lynn left the prison here heading back to the philadelphia area. this is not the first time william lynn has been released from prison. his case has gone to the higher court, his original conviction in 2012. it's been historic for the church. lynn was not accused of himself harming a child, but was accused of moving a priest around and not protecting the children in the church. his attorney blamed the judge for allowing evidence in the trial that did not pertain to lynn. >> she permitted the introduction of abuse by 21 other priests over the period of

time from the '40s, '50s, '60s that he had nothing to do with. >> reporter: they will allow the monsignor a new trial, which is scheduled to begin in 2017. >> he had a 36-month sentence. he's done 33 months. the parole board granted him parole as of october. so the worst that could happen is he could be convicted and sentenced to two months. >> reporter: bergstrom said he will have the trial, quote, he should have had in the first place, and that questionable evidence will not be allowed into the case this time. the trial lasted nearly a month and jury deliberation, several weeks after that. in wayne county, deanna durante, nbc 10 news. police in atlanta county are looking for the driver who hit and killed a one mother in a crosswalk and left her there to dry. aubrey servis leaves behind a young son and daughter.

servis' mother said her daughter was crossing the street in galloway township before 10:30 last night. that's when the driver of a silver older model suv ran a red light and hit her. the victim's mother has a message for the person who killed her daughter. >> do the right thing and turn yourself in. you know you hit something. and how would you feel if it was one of your family members. >> police say the suv is possibly a 1990s chevy tahoe or suburban. it should have front end damage on the driver's side. let's talk about your first alert weather now. perfect day for ball games. these kids hit the diamond in burlington county today. a little bit of relief from the midday sunshine. >> let's get an update from meteorologist sheena parveen. >> you know, we have our new

you'll hear for yourself coming up on nbc 10 news at 5:00. a short time ago, the delaware supreme court ruled the state's death penalty law is unconstitutional. the justices said it's because a judge can sentence a person to death, regardless of what the jury recommends, and does not require jurors to be unanimous. the u.s. supreme court made a similar ruling earlier this year. delaware isn't the only local state debating its death penalty. pennsylvania governor tom wolf put a moratorium on executions last year. opponents are now challenging it in court. new jersey abolished the death penalty back in 2007. 1,000 jobs are staying in delaware, after a company decided to keep its global headquarters in wilmington. they say they considered other locations, including new jersey and pennsylvania. but recent reforms to delaware's corporate income tax helped make their decision to stay.

the company spun off from dupont last year. today new jersey governor chris christie praised state educators for boosting test scores. students in the garden state improved from last year, and the partnership for assessment of readiness for college and careers test. a passing grade on the test could soon become a requirement for graduation. however, thousands of parents refuse to let their children take the exam, calling it too time-consuming. meanwhile, local police officers say they want to build better relationships with their communities. but they might have some work cut out for them. >> when a police officer comes up to me, i don't even want to talk to the cops now. at this point, i feel -- >> live in camden. two sides try to come together. a bucks county couple accused of giving their child to this man. today, all of them went before a judge, and listen to the daughter's horrific story.

family and friends paid their final respects today to a philadelphia firefighter who died in the line of duty last month. funeral services were held for gabriel lee in north philadelphia today. lee was then laid to rest at ivy hill cemetery. the 17-year veteran was found unresponsive during a night shift at engine 50 fire station in north philadelphia ten days ago. he died a short time later. a personal story was shared as the son of a philadelphia firefighter. >> part of me, the smells of the firehouse, the people, the families, they're all so important to me. and i can't imagine -- my father's 81 years old -- and i can't imagine having lost my dad when he was 42. >> investigator have not said how lee died. national night out. a yearly tradition all across the country. but after the tragic killings in

an author of the report calls philadelphia's program hit-or-miss. >> do a good job of limiting the view of officers and when they're ryder to turn on their cameras. on the other hand, they don't have special processes to allow recorded individuals to get access to that footage. >> philadelphia body cameras, the program has much room for improvement. well, taking your dog out today, it was cloudy. temperatures cooler than normal. especially compared to last week. this was in fishtown today. nice conditions really for everybody. you can still wear short sleeves and shorts. but some areas only made it into the 70s today with that onshore wind. so a lot cooler out there. finally the clouds are starting to break in parts of the area. as we go through this evening, the clouds will slowly continue

a dozen girls found living in a man's home. two amish parents giving away their child. those are just some of the horrific allegations surrounding a case out of bucks county. >> now a judge said the suspects involved can be held for trial. nbc 10's monique braxton joins us now from the courthouse. monique, we also heard from one of the alleged victims today.

>> reporter: that's right, denise. she was frightened but confident. the key witness was the victim, gifted by her parents to the man now accused of statutory sexual assault. would you like to say anything, mr. kaplan? >> not today. >> reporter: he denied comment after the hearing in which the judge said this case will go to trial. the 18-year-old said she was 14, explained their relationship. she testified, kaplan had fathered their two little girls. she also said her mother had lived with them since the first child was more than three years ago. when asked if she still cares for kaplan, she said yes. >> every victim experiences things differently. so i don't think that it's atypical or typical. >> reporter: three dozen amish listened to the evidence. in mid-june, police were sent to 428 old state road.

a neighbor called regarding the health and safety of children. police found 12 females, ranging in age from 6 months to 18. sources tell us the girls are together now in the custody of bucks county children and youth services. during the investigation, police learned daniel and savilla stoltsfus gave their daughter to kaplan. a bucks county judge recently denied kaplan's request to sell his house, which has been seized by the court. but the judge is allowing kaplan to sell items inside the home including a valuable train set. tonight everyone remains on bond. kaplan as well as daniel stotlzfus. the bond is million. one week ago for savilla it was reduced.

new video just in to nbc 10. surveillance cameras captured a smash-and-grab at a jewelry store at montgomery mall. it happened at the hellsberg diamonds. the men were wearing all black and masks as they smashed the jewelry displays. they got out of the store with about $10,000 worth of merchandise. anyone who saw what happened or has any information is asked to contact police. here's some of the other stories making headlines right now. monsignor william lynn out of jail. he became the first catholic church official in this country to be convicted of covering up child sex abuse by priests. today a judge granted lynn bail. the ruling came after pennsylvania's highest court granted him a new trial. police in atlanta county are looking for the driver who hit and killed a young mother. aubrey servis was on her way to the store last night. she was crossing the intersection when the driver of a silver older model suv ran a

classrooms today at the early learning program at wilmington. delaware is one of 20 states that received more than $1 billion from the federal race to the top challenge. the grant money has been used to ep roll more young children in the programs. voters in north wildwood may get a chance to weigh in on their name to angle sea. that's the original name. city council could decide to place a nonbinding question about the switch on november's ballot. we've all seen those rides that send riders shooting up into the sky and free fall to the ground. instead of one tower, how about three of them. instead of one height, they're offering riders the choice of anywhere from 80 feet to 189 feet. and with the increase in height, bring it on, comes higher fees i do like those rides. coming up, a new warning for pregnant women.

gather that most important data, that closest data for you guys right where the storms are falling. which, again, right now we're in morgantown. then we go around the truck, bear with me as we go around, it's a long, long vehicle here. you've got your driver's side. a full cab, very comfortable for our driver as well as our reporter or meteorologist. and on top of the truck we've got the weather station. that gives us information on temperatures, wind speeds and also helps us to make sure we're in safe enough conditions where we are. finally, if you take a look, we do have cameras that are mounted on the windshield, one that takes a look at us, one that takes a look at the road. and on the roof of the truck we have a third camera as well that can watch the skies. and of course, all of this making storm ranger 10 an unprecedented vehicle in our industry. sheena, pretty exciting to be out here again. >> yeah, crystal. it is exciting, because we can drive that thing anywhere we want, wherever we want in any type of weather.

a lot of different tools on storm ranger 10. it is a mobile radar. it has wheels on it. take a look right now at the area, the white sweeping radars. these are all of our stationary radars across the area. these don't move. and sometimes in certain situations they tend to miss things, which is why we do have storm ranger 10. that is the red sweeping radar there. and that is exactly where krystal is right now with the truck. the red sweeping radar, that is our mobile radar. if you watched us yesterday, we drove storm ranger 10 into new jersey, gloucester county. today we've driven it into berks county, where we have the closest shower in the area. so that shower actually is moving into lancaster county. but there you see our radar right near new morgan, and right around 76 there. we're going to watch that heavy rain shower. that's going to continue to slide into the south. storm ranger 10 is going to be a fantastic tool for our station. no other station has it. especially when it comes time for winter weather. we can tell you exactly what kind of precip is actually

hitting the ground, because we can move it wherever we want. right now, though, we're looking at cooler temperatures. onshore wind giving us a cooler day today. the wind direction mostly east-northeast. 80 in philadelphia. pennsylvania suburbs coming in at 73 degrees. south jersey mostly in the upper 70s. little breaks of sunshine through parts of delaware, and that's where we'll be seeing more sun into tomorrow. that wind direction is helping temperatures in some places to stay only in about the mid to upper 70s. more sunshine as we go through tomorrow. the clouds will be breaking. especially overnight tonight, and through the day tomorrow. plenty of sunshine when you're waking up. in the end of the week we start to heat up again. hot and humid from friday into saturday with a chance of storms on saturday as well. but here's a look at future weather for tonight. clearing as we go into your wednesday. you'll need the sunglasses tomorrow. temperatures will still be very comfortable, especially as we go into thursday.
