and for the justice system to deliver. >> he's a strong kid, a tough kid, a hell of a cop. this could happen to anyone. he's the guy, because he's going to get through this. >> reporter: one police officer, i can tell you, who was not here in the courtroom today was bidel's partner who his family has credited with being a hero by firing back and saving both of their lives. he could very well be called to testify once, if and when this case moves to trial. cydney long, nbc 10 news. turning now to our first alert weather. a nice start to the work week. it was warm and sunny on this independence mall this morning. of course, labor day has come and gone, but summer is still on. >> no question about that, when you step outside. first alert chief meteorologist glenn "hurricane" schwartz is here with the details. glenn, yet another heat wave. how many times have i said that this summer? >> at least a half a dozen i would say. maybe this will be the last heat

wave of the season. but it's going to get really hot. once we get rid of the circulation of hermine, which is still affecting part of the area. it was a nice sunny day inland. but at the shore, it was pretty cloudy. we've got rain bands moving through ocean county right now, going down into atlanta county. it's been a pretty cloudy afternoon. this is a live picture in ab seeken. nothing but clouds. very dark there. showers moving through. and more showers tonight until this thing starts to move out. and when it does, with this northwest wind, it's going to allow some of that hotter air from the midwest to move in. 20-mile-an-hour winds now in mount holly and in wilmington, a little bit less in other places. the average high temperature for this time of the year is only 81. upper 80s so far today. and then near 90 tomorrow. then look how hot it gets as we

go through the rest of the week. but overnight tonight, it's still relatively mild. not too humid. and dry from the p.a. suburbs, lehigh valley. but watch what happens in new jersey, parts of new jersey, and especially the jersey shore. seeing some showers as we go through the overnight period. and then starting to dry out tomorrow. let's see how long that heat's going to last. and if we're going to set any records in a few minutes. new details on the case against bill cosby. today a judge decided when the famous comedian will go on trial. the prosecution is trying to get more accusers to testify against him. nbc 10's deanna durante joins us from outside the montgomery county courthouse with today's developments. deanna? >> reporter: jacqueline, prior bad acts, that's how prosecutors described the evidence they want to bring in by bringing in as many as 13 accusers.

those names not made public. the motion filed just minutes before bill cosby arrived here in montgomery county with his attorney. now, he was here for a pretrial conference. in many cases they don't get news coverage. this being bill cosby, and the fact that this case has been made an issue, not only here in montgomery county, but across the country, obviously this was a day that got a lot of attention. and what was discussed in that ranged from when the date of his trial will begin, the judge right now set it for june 5th of next year, to evidence that prosecutors want to introduce, and evidence the defense wants to keep out. some of that evidence includes a deposition that cosby gave during his civil lawsuit with the alleged victim in this case. prosecutors want to introduce his words. the defense said it shouldn't be allowed in. the defense is also trying to keep out a recorded conversation that was taken between the accused mother and bill cosby. now, the defense has some very strong words for the prosecutors

in this case. >> the media has presumed him guilty, not innocent. the media has championed the causes of his accusers with little thought to investigation, to little thought of challenging or exposing the motivations behind any accusations. in the courts, we've seen a prosecutor break a promise, a time-honored promise in this case. >> reporter: now, some of that has to do with a press release released under a former district attorney, and that former district attorney testified in the past he gave a nonprosecution agreement for cosby. the trial date is set for june 5th. we've not seen the last of the back-and-forth between the defense and prosecutors. even though the trial date is set, the case may not take off then. also, prosecutors are talking right now about the idea of a change of venue.

we'll get into that request. the defense said it will be making it. live in norristown, deanna durante, nbc 10 news. our coverage from cosby in court continues in just a few minutes. our legal analyst joins us to break down today's developments, including the push to allow other alleged assaults by cosby, that's coming up at 5:15. happening today, jury selection in the trial that will determine who, if anyone, should compensate victims of 2013 market street building collapse. it includes the owner of the building being demolished, the salvation army, and the demolition contractor, and you'll remember the collapse killed six people and injured 13 others. two of them are the only convicted of criminal charges in that collapse. both are now in prison. a philadelphia man has been charged with murder after police say he ran over a woman with his car, and then beat her to death with a shovel.

joel horton has been charged in adrienne lindsey's death. a person heard a woman screaming, and they found horton standing over the victim who was pinned under a car. meanwhile, a popular technical school with campuses across our region is shutting down. "nbc 10 responds" reporter harry hairston is here to tell us how the closure will impact the students. >> itt moved to close the doors after a directive from the department of education. the government issuing tighter restrictions on how for-profit schools can operate. now, the government banned itt tech from enrolling any new students last week who uses federal financial aid. the shutdown comes after a federal investigation into itt tech for alleged fraud and deceptive marketing tactics. in the statement today, itt said it's always worked tirelessly to ensure comply answer with all

applicable laws and relying lagss. now, if you went to itt tech, you may be able to get your federal student loan debt wiped away by filling out a form on the department of education's website. head to facebook for more on that. itt tech had local campuses in philadelphia, levittown, and malton, new jersey. >> harry hairston, thank you so much. public school students in philadelphia should be getting their rest tonight. >> they should. classes begin bright and early tomorrow morning. nbc 10 found out schools have a lot of other resources ready for them this year. at nebinger elementary schools, teachers got to crack out boxes and boxes of new books. 130,000 books will go to 650 classrooms. last year the pennsylvania budget standoff meant districts couldn't get their funding or textbook money on time. philly superintendent said he feels much better going into

this school year. >> for this year, we're not announcing we're closing something, or laying someone off, we're not announcing that reductions in resources or programs. instead, we're talking about investments. >> this year each school will once again have counselors and nurses. dr. hight said the district is also still working hard to reach a contract deal with his teachers. one thing is for sure, a lot of kids, a lot of parents think the school year's long enough already. so why does new jersey governor chris christie want to make it even longer? we'll take a look at his argument coming up later on at 5:00. plus, doctors have some bad news for parents. like getting the flu vaccine could get even more unpleasant for your child.

for senate, katie mcginty or pat toomey? mcginty supports clean energy jobs. pat toomey voted to protect tax breaks for oil companies. mcginty is pro-choice.

toomey wants to overturn roe v. wade and criminalize abortion. mcginty will consistently stand up to the gun lobby. toomey's against an assault weapons ban and gets an a rating from the nra. this year, pennsylvanians have a clear choice. senate majority pac is responsible for the content of this advertising.

now to decision 2016. the fireworks in pennsylvania senate race came to philadelphia today. >> both candidates accused the other of not being good for middle class families. the race between katie mcginty and pat toomey is being watched closely around the country, because it could affect control of the senate. >> nbc 10's lauren mayk spoke to both candidates today. >> keith and jacqueline, two different approaches today. mcginty at a rally with local democrats, and union supporters. toomey campaigning at a neighborhood market. both of them trying to shore up

support nine weeks from election day. >> katy mcginty, the next united states senator from pennsylvania! >> reporter: senator bob casey representing who democrats hope will join him in the senate. >> who's ready to fight? who's ready to win? >> reporter: katie mcginty is taking on the republican incumbent. they took shots at each other from across philadelphia today on taxes and spending. pat toomey at a steer in northeast philly. >> katie mcginty is campaigning all over the state calling for over $1 trillion in new government spending. >> reporter: mcginty at him from a union hall in south philly. >> pennsylvania's working people don't need any enemies. >> reporter: the top of the ticket donald trump. >> what about the trump-toomey team? i don't know what planet they're living on. >> reporter: but toomey is a republican holdout who hasn't endorsed trump. when i pointed it out to mcginty, she said he could be candid. >> are you for trump or not.

it looks like he's totally whipped donald trump. >> he said he has not made up his mind. is it fair to lump them in together? >> two things are true. one, if a united states senator has not heard enough from donald trump to have an opinion on whether he's for him or against him, that should be disqualifying at this point. being a senator, you make tough decisions every single day. it's time for toomey to make this decision. he's just not being straight with voters. >> reporter: even though senator toomey isn't out campaigning with trump, he said he still needs to be convinced to support him. the trump factor is there in this race. at 6:00, we'll take a closer look at that and the option toomey thinks some voters might take. turning to this now. bill cosby was back in court in montgomery county, accused of sexually assaulting a former temple university employee.

today we learned new information in the case. late this afternoon, a judge set a trial date of june 5th. also, the defense said it wants the trial moved out of montgomery county. prosecutors want 13 other cosby accusers to testify. cosby is charged with sex crimes involving a woman in our area more than a decade ago. it all came out in a pretrial hearing today in norristown. nbc news legal analyst is here. let's start with some of the accusations, the other accusers cosby is not charged with assaulting them, so the question becomes why would their testimony even be allowed? >> i can tell you what. this is going to be the most important ruling in this case. defendant. the value to the prosecution, to make their case. if you have bad acts, in a

situation like this, the prosecution is going to say this is his method of operation. he uses drugs and alcohol. the past 13 accusers will get on the stand and say how they had similar situations with mr. cosby, how they were drugged and how alcohol was used to be taking advantage of them. make the jury think he was guilty then and he's guilty now. >> enrique, bill cosby gave a deposition in the civil suit. the defense is trying to keep it out. ruling, the evidence that came out during those hearings was that the prosecutor did say, i did grant him immunity so he

degrees. we've got kind of a land breeze today. so temperatures in the 80s, even with the cloud cover. but hol gate, long beach island, down to 73. there are some showers in that area, along with little egg harbor. 88 degrees in wood boin. farther to the south we're seeing less cloud cover than we're seeing in long beach island and long beach county, as you can see here on this radar. this is hermine spinning around. and it's as close to the coast as it's ever gotten. and continuing to creep a little bit closer. you can see some of the showers moving through atlantic city now, heading down to ocean city and sea isle city this evening. we're seeing wind gusts of 25 to 30 miles an hour. 30-mile-an-hour gusts right now in mount holly. we're going to have another heat wave. it's after labor day, and we don't get this very often after labor day, but yeah, it's happening. it looks like 90 tomorrow.

95 thursday. close to that friday. maybe the hottest of all on saturday. that is some pretty hot weather. and not only is it going to be hot, it's going to be humid, too. we may be breaking some records. philadelphia's record for thursday is 96. we're going to be pretty close to that. we could be seeing some records in places like mount holly, and millville, newark, delaware, and record heat last year at this time. but not for as many days as we're getting here. it's 87 right now. and as we go through the day tomorrow, we're going to be seeing a lot of sunshine. temperatures getting into the upper 80s. and tacony, 89 degrees. you see it's dry. pretty much everywhere. even at the jersey shore. the remains of hermine should be moving out and keeping it dry. and with the land breeze, it

kind of warms culver city up to 86 degrees. and as we go into the rest of the week, it just gets hotter and hotter. the suburbs may not quite get to 90 tomorrow. should get to 90 thursday and friday, even lehigh valley getting there. a lot of sunshine, dry weather. at the jersey shore, a bit of a land breeze. it's pretty warm at the shore as well. now we're starting to get a problem since most places did not get any rain from hermine, that we're not going to be seeing rain for a good while most likely. so as we go through the ten-day, there's saturday at 95. the eagles, it looks like sunday is going to finally get some comfort. and then temperatures drop a little bit more on monday. and we're going to have to wait until later on next week before we see temperatures dropping back into the 70s. pennsylvania has started to let consumers buy wine in more

shore. this weekend might be one of those cases. it's 89 degrees in wilmington now. 87 in philadelphia. 85 in allentown. it feels like those numbers. the humidity is not especially high during rt day today. that is going to change as we go into the next few days. there's the circulation of hermine. and it's gotten closer to the coast. now we have some rain bands coming into the shore area. still pretty nice in cape may. and in rehoboth beach, delaware. as you can see, this long beach island. right in the showers right now. down toward atlantic city. and some of that rain is on the heavier side. just briefly heavy, as you can see those bands coming right down through lbi at the moment. so if they had sunshine earlier today, they're not getting it now. as we go through the night tonight, it's going to be dry across most of the area. but not necessarily everywhere.

temperatures not dropping a whole lot. gets a little bit more humid overnight in the philadelphia area. and in the suburbs. you can see temperatures going down into the 60s. if it was a real comfortable air mass, we would be down in the 50s overnight. and in parts of new jersey, still some more showers, even inland. and at the shore, definitely showers, especially north of, let's say, ocean city as we go through the next several hours. but that's going to move out. and the heat's going to move in. we'll see how hot it's going to get in just a few minutes. an officer shot his teenage son after an argument last night in northeast philadelphia. we can tell you our cameras were outside the officer's home after that shooting. his 19-year-old son is now in critical but stable condition. police want to know in it was an accident or intentional. we'll look for answers from two others who were in the house at the time. >> i believe the son's

girlfriend, and a younger son. we're trying to get as much information from them. >> the officer has not within charged. he was already off the street because of a job-related injury. like it or not, school is back in session. many students across their area headed back to class today. that includes audubon school district in camden county. our cameras caught parents walking their kids to school this morning. a half day today. but tomorrow they'll have a full day of school. new jersey governor chris christie was in north jersey today where he called for school changes. the governor signed six education bills, that includes legislation that limits expulsions and suspensions of students in kindergarten through second grade. the governor also called for a longer school year. he said the degree gar yan calendar isn't the reason for the september-to-june time frame. from our delaware bureau, helping to make their college dreams a reality.

nbc 10 was in dover. there the recipients of a scholarship. delaware state is one of two schools in the country offering these scholarships to immigrant youth. >> these are very capable students. they had really good grades in high school. and what an exciting moment for them. what an exciting moment for us. >> this is the scholarship program's first year. it is privately funded. it's not every day you hear about a hit-and-run involving a boat. new jersey state police say that's what put four people in the hospital. take a look at this photo. it shows the boat that was damaged on greenwood lake. that's in west milford township. a vessel, possibly a ski boat, hit the 18-foot bayliner last night, then went airborne. four people inside the boat were taken to the hospital. two remain in critical condition. the other two weren't seriously injured.

a new jersey man accused of shooting a man at l.a.x. pled guilty to murder charges today. paul c irgs ancia was in u.s. district court in los angeles. three years ago the pennsville native who was living in l.a. killed the tsa officer hernandez, and shot two more agents and another person before authorities shot him. his plea means he agrees to life in prison to avoid the death penalty. more attacks against the makers of epi pens. accusing companies of hurting school children. out of jail, but not out of trouble. the college student who only served three months for rape was back in a police station today. we'll explain why next at 5:00.

convicted sex offender brock turner registered as a sex offender today in ohio. under the terms of his probation, turner must register

with the sheriff's office every three months. he was released from a california jail last week after serving three months for sexually assaulting an unconscious woman at a party. protesters were armed with ex please it signs, others armed with guns. the protesters wanted to make it clear they knew about turner's sexual assault conviction. >> i just think that he should not be hiding in his parents' house. he should be in prison. >> for the next three years, turner will also undergo random drug tests and must stay away from alcohol. 18 million years in the making. gone in a matter of seconds. police in oregon are looking for the people responsible for knocking a popular sandstone formation to the ground. oregon state police and parks department are reviewing this video of what appears to be an apparent act of vandalism. a passerby was near the pend

whether it's truly overcast. even some of the clouds in the philadelphia area are partly related to hermine, which is getting closer to the coast right now. although it continues to weaken, which is a good thing. the neighborhoods are showing in delaware, temperatures in the mid-80s, to near 90 degrees. we have hit 90 in a couple of spots here. greenville 85, reedy point 85, middletown 87. over toward the shore, it is in the 80s. it's more of a land breeze. you can see pretty clearly that there is a tropical, or subtropical system offshore, just spinning around out there. and some of that rain has moved on land. and not just a couple little showers either. especially long beach island, getting some -- at least moderate showers coming through

the risk of eczema and allergies. the link was even stronger among kids treated with two or more courses of antibiotics. two senators are calling on whether milan violated antitrust laws to protect the product of epipens. the senators say that as the price skyrocketed, schools turned to mylan's ep i pen for a discount. some of the schools were required to sign a contract agreeing not to purchase any products from mylan's competitors, which they believe could violate antitrust laws. mylan released a statement in response claiming the program has complied with all laws and regulations. parents, it's time to break the news to kids, and anyone else afraid of needles, they'll have to get the flu shot this year instead of the nasal spray.

erica edwards explains why. >> reporter: it's been the flu vaccine preference among many children for years. the nasal spray flu mist. now the american academy of pediatrics says kids should not get it this year. the move comes after a panel of experts found the nasal spray has not been effective the past three seasons. it's unclear why. >> it's still a scientific mystery, but we can't go on giving a vaccine that's ineffective. >> reporter: the aap recommends instead that all kids over 6 months get the flu shot. which experts say was about 63% effective in protecting against the flu last year. even if you do become infected after vaccination, doctors say you're far less likely to have a severe case. >> influenza can take a normal healthy child, or even adults, and put them into the emergency room in 24 hours. this is a serious infection. >> reporter: kids we talked to

good evening, i'm jim rosenfield. >> i'm jacqueline london. deanna durante has been following this case from the start. >> she's joining us live from norris tourn with the latest. >> reporter: bill cosby's defense attorney pointed out to a judge he does not think cosby can get a fair trial here in montgomery county. he said the jury should also come from outside of the county. this as prosecutors let it be known they plan to introduce testimony from as many as 13 different women to show a jury evidence of cosby's alleged prior bad acts. >> the media has presumed him guilty, not innocent. the media has championed the causes of his accusers with little thought to investigation, with little thought to challenging or exposing the motivations behind any accusations. >> reporter: defense lawyers are blaming the intense media coverage surrounding bill cosby. but they did not talk publicly about the evidence they're trying to keep the jury from

seeing. cosby's defense attorney said a telephone call between cosby and the mother of an accuser should be tossed out. cosby didn't know he was being recorded when he offered to pay for the college tuition of andrea constand, and what, if any, drugs he gave her the night of the purported crime. the judge has yet to rule on whether or not that call will be played for a jury. or if that jury will read a deposition that cosby gave when constand sued him. the defense wants a change of venue and a jury pool outside montgomery county. the judge said it may be impossible to get an impartial jury because of the media coverage. the judge did also ask cosby's defense lawyer, what, if any, accommodations need to be made for the entertainer because he's
