i'm jim rosenfield. her pleas were not enough. police opened fire tuesday and killed him, saying he had a gun. tonight there is fresh outrageous and protesters are back on the streets one hour before curfew goes into effect once again. keelth jones is monitoring developments. what's the latest? >> reporter: jim, the curfew goes into effect in under an hour, but we learned as long as they remain peaceful, these protests can stay out as long as they want. we want to warn you, though, once again the video in this story is disturbing. while you don't hear gunshots -- rather, while you hear gunshots, you will not see anyone shot. >> speak, my brother. >> what we've got out here is a peaceful rally. >> peaceful, united, we'll never be defeated. >> reporter: on day four, hundreds continue their protest. >> we can't get no justice, then you don't get no peace. >> reporter: it doesn't look like this is going to stop.

[ gunfire ] >> reporter: scott was dead, shot by police. >> did you shoot him? >> reporter: we don't know what happened before scott's wife began recording her video. >> they're actual putting the handcuffs on him. >> reporter: tonight there is new video showing what happened after the shooting. police still haven't released their footage. >> they're marching and chanting, that's great. we support expression of their first amendment rights. >> reporter: tonight a soft kir few of midnight remains in effect. >> if they do it in a peaceful way, that's the charlotte way. i'm calling on that to happen again. we want to get basketback as so possible to the charlotte we know and love. >> no matter how long it takes

for us to be out here, we will be out here. >> reporter: and the mayor wants the state to finish their investigation and release all of the videos. but, again, she thinks they are as inconclusive as scott's widow's video. an hour ago, hillary clinton postponed her upcoming trip to charlotte. the mayor asked the presidential candidates to delay any visits to charlotte so the city can use its resources to recover from the unrest. instead of visiting this sunday, clinton will now visit the following sunday. today clinton tweeted that charlotte should release the police video of the scott shooting. there are reports that donald trump is also considering a visit to charlotte at some point. meanwhile trump picked up a long-awaited endorsement from a former republican rival. texas senator ted cruz. >> vote your conscience. vote for candidates up and down the ticket who you trust. >> that was cruz getting booed during the rnc this summer after not endorsing trump there.

not a big story as far as winds go. but as jim just mentioned, satellite radar image picking up on some returns there. we're seeing some greens moving through parts of northern, central new jersey. i do think the philly metro area will get a scattered shower through the overnight headquarters, especially between the hours of 6:00 and 9:00, certainly not going to be a washout, but just not totally dry. now, our pattern change begins. we have cooler air sliding into place, so that means cooler temperatures by tomorrow. certainly by sunday. overnight lows dropping into the 40s sunday into monday. more details coming up in my full forecast. back to you. >> she was sitting on the step minding her business when she got jumped. now to an nbc10 exclusive. a 12-year-old girl attacked outside a library. cell phone video shows several girls beating her up in fish town. the attack left her with a sprained neck, and now police are investigating. nbc10's brandon hudson has the exclusive report. >> reporter: a 12-year-old girl was coming from the library when

she said a group of girls attacked her right at this intersection. she didn't even know them, and this was all caught on a cell phone. kicked and punched over and over. this quick video clip shared exclusively with nbc10 shows why kayla watson hasn't been to school in the past couple days. >> i have a sprained neck. >> reporter: wearing a neck brace from wednesday's attack, watson appeared in good spirits thanks to support from her friends. >> they've been calling me, checking up on me every day after school and before school. >> reporter: but there are still questions about this seemingly random attack outside a library on east montgomery avenue. this is a photo of how the seventh grader spent that night, lying on her back in the hospital. tonight we learned philadelphia police are investigating. >> she got snooker punched on the back of her neck and her back. if it wasn't for a young man driving by to stop the fight and call the cops, she could have been killed. >> reporter: nbc10 learned the

attackers go to middle school but the victim does not. a spokesman for the school district of philadelphia says all school district protocols and procedures are being followed but didn't talk about any disciplinary action. kayla watson's grandfather says penn treaty's principal is working on a solution, but it may be too soon. >> she's scared to go back to have a sit down. she told them no the other day. >> reporter: the family says they appreciate the principal's initiative to reach a solution. kayla watson says she hopes she can return to school tuesday after meeting with a surgeon. in fish town, i'm brandon hudson, nbc10 news. a break in the case of an 8-year-old girl shot and killed in camden this morning. u.s. marshals arrested 18-year-old tyhan brown in tennessee where police say he was hiding. brown is charged with first-degree murder in the death of gabby hill-carter. she was caught in the crossfire of a gang-related shoot-out last month. police say brown bragged about the crime to a former cell mate. investigators are still looking for up to four other gunmen

involved. former congressman chaka pa ta was back in a philadelphia courtroom today. he's challenging his conviction on corruption charges. back in june a jury found him guilty of taking an illegal $1 million loan for a failed may oral campaign and then using taxpayer money to pay it back. his lawyers are now asking a federal court to overturn the conviction. they're relying on a supreme court ruling that vacated the sentence of former virginia governor bob mcdonnell. fattah is set to be sentenced next month. could governor chris christie be impeached? new jersey lawmakers are researching whether to push for his impeachment the odds of that happening are 50-50. a majority of the 80 member assembly would need to agree to bring articles of impeachment against him, and it comes as prosecutors in the bridgegate trial suggest that christie knew more about those bridge lane closures than he let on. christie has never been charged in the bridgegate scandal, but two of his former allies are now

on trial. former christie aide david weldstein testified that creating the bridge traffic jam back in 2013 was part of a plan to boost governor christie's re-election bid. wildstein pleaded guilty to conspiracy for his role in the traffic jam last year. a construction project to help relieve traffic in south jersey is making the congestion heavier tonight. skyforce10 flying over the backup caused by crews painting and installing barriers for a new temporary ramp. that ramp will lead from route 42 north to 295 north in belmar. it's part of a highway project that will last for years, but the temporary ramp will be all set by 10:00 a.m. tomorrow. once again, video is fueling new passions after a police shooting, and tonight mayor kenney weighs in on what would happen if philadelphia faced the situation that's happening in charlotte. also mistaken identity. the surveillance video that led to a twist in a delaware county

tonight the events in charlotte are raising a debate around the country about when police departments should release video. nbc10's drew smith asked philadelphia's mayor about that and looks back at the timeline of some big local cases. >> reporter: in a week where two police shootings got big attention, the city of tulsa quickly put out aerial and ground video. protests there remained calm. but in charlotte, the only video evidence has come from the victim's wife, who shared this from her cell phone. >> don't shoot him. >> reporter: charlotte's chief says releasing police video could make tensions worse. >> i know the expectation that video footage can be the panacea, and i can tell you that is not quite the case. >> reporter: he points to maintaining the integrity of the investigation. >> show me your hands. >> reporter: last year in south jersey, it took public records requests and three weeks' time to see this dash cam video of the police shooting of jerome
