times at point blank range, was in and out of the of consciousness on the way to the hospital. before he died he told police the two men who shot him also stole his handgun. he worked at a barbershop a few blocks from home. today his chair is empty. the guys here say he had a permit for his handgun but they didn't think he had any reason to need it. they don't know who would want to kill him. >> i don't know, they were probably trying to rob him because he has a nice car and everything. >> reporter: police took surveillance video from a corner store. way down the street down there, there is an auto body shop. i went down there and saw that their cameras would have had a clear shot at the alley. if the suspects went out that way, that camera would have seen it. police are looking surveillance video and talk to witnesses as we speak. tim furlong, nbc 10 news. a woman is dead after she was hit by a car in newcastle county today.

skyforce 10 over the scene moments after the crash in smyrna. the driver remained on the scene and is cooperating with police. still no word what caused the crash. in delaware county, an suv crashed into a grocery store in glen mills today. the suv, the white car there, after it was loaded on the flatbed truck, outside the acme university on beyers drive. no word on injuries or what caused the wreck. now to our decision 2016 coverage. this afternoon, election day just three weeks from tomorrow. several developments to tell you about. nbc 10's keith jones following the candidates today, live right here in our studio. >> jim, we begin with our investigation into hillary clinton's e-mail use during her time as secretary of state. today the fbi released 100 more pages from an its investigation. they reveal a senior state department staffer trying to change the classification level of an e-mail about benghazi from

clinton's private server. the staffer said that would ensure the document would be archiv archived. quote, never to be seen again. the fbi did not change the classification level. the democratic presidential nominee has largely stayed out of the spot the last few days. that's not going to change anytime soon. that's because clinton is hunkered down, preparing for the third and final presidential debate in las vegas this wednesday. instead clinton is letting her surrogates take the stand. you'll see that bernie sanders is actually taking her place in terms of stumping for the candidate. that includes former democratic rival bernie sanders, the senator from vermont, campaigning at a colorado state university in ft. collins. senator sanders is expected to take the stage soon. republican presidential nominee donald trump has been anything but quiet lately. he had a lot to say on twitter today, attacking hillary

clinton, president obama, and joe biden. he says there's larger scale fraud happening. he will hit the campaign trail in green bay, wisconsin this evening. his running mate mike pence is campaigning in ohio today. this is a rally that got under way in columbus a few minutes ago. he attacked secretary clinton, saying that she will enact four more years of obama's failed policies. >> i promise you, when donald trump becomes the president of the united states of america, we'll lead again on the world stage with american strength. >> tonight pence will continue campaigning in the midwest, speaking at a republican event in michigan. a new poll finds hillary clinton has a 50-point lead over donald trump among latino voters. and an nbc news/"wall street journal" shows 67% of likely voters in the latino community back clinton in a four-way

matchup while just 17% back trump. this comes as the clinton campaign is expanding into the state's democrats that haven't won in decades, buying tv time in texas and arizona. >> keith, thank you. elected officials are striking back against claims made by republican presidential nominee donald trump. a voter watchdog group gathered at city hall today. members of the aclu and other officials shot down claims that votes will be stolen in philadelphia. the group stayed away from naming trump publicly but said the only damage to elections are irresponsible actions made by candidates. >> we conducted an audit of every election, all results and materials, far beyond what's required by law. >> republicans and democrats say voting machines are not hooked up to the internet and your vote and the record of your vote is protected three ways once the vote is cast. coming up at 5:00, nbc 10's

months. will this warm weather stick around? >> sheena parveen joins us with her first alert neighborhood forecast, sheena. >> yes, and good news for anyone at the shore, it will get a little bit warmer through tomorrow and even as we go into wednesday. we're looking at some record temperatures as we go through this week. right now, we are well above normal for this time of year. i don't think we'll hit any records, though. 81 degrees in philadelphia right now. 81 wilmington. 81 mt. holly. coatsville almost at 80, as well as dover. if you are in atlantic city, temperature there 78 degrees. we have a lot of warm air that's going to stick around for the next few days. take a look at warm air to our south where we have 80s and even 90s, that's farther south. we won't get into the 90s, but we'll get into the mid-80s over the next few days. tonight, comfortable, just not as cool by 9:00, temperatures around 70 degrees. take a look at the records possible as we go through the

day tomorrow. the record high in philadelphia is 81 degrees. the forecast high is 84. reading, your record high is 85, your forecast is 83. the warm air will stick around way above normal this time of the year. we'll talk about the chance for rain coming up. 20 minutes of nonstop news continues with this. two college women sexually assaulted over the weekend at different schools. the crime alert went out at rowan university and the university of delaware. the student at rowan says she was leaving a party after drinking when a guy took her home. >> nbc 10's south jersey bureau reporter cydney long got reaction on campus. >> reporter: it happened inside the new holly point dorms after a late night of partying off campus. >> this wasn't a predator case. this was a college age student at a party that evening with

everybody else. >> reporter: rowan's director of communications issued an alert over the weekend to notify students one of their colleagues reported a sexual assault to police, telling them she vaguely knew the student who offered to walk her home from a party. >> i'm going to go help you out and take this young woman home, make sure she gets home all right. and then it didn't end up that way. >> reporter: instead of making it home safely -- >> she ended up in that person's residence hall and was sexually assaulted. >> reporter: campus police have seen this type of acquaintance crime before. the victim was taken to the hospital for evaluation and released. >> at that time we were able to gather a little bit more information. even then, we don't have much. she blacked out and as i said, she awoke to being sexually assaulted. >> reporter: graduate student kim vogt is thankful that campus

administration is on alert. police are collaborating on the investigation and protecting the identity of the victim. if you become separated from your phone, there are safety stations like this one and help is just a push button away. >> she did the right thing afterwards, she felt in the morning, that's not what i thought was going to happen at night. >> reporter: no one so far has been charged with a crime but police plan to speak with the accused, and they encourage anyone with information to call them. cydney long, nbc 10 news. now to the attack on another college woman, a 20-year-old university of delaware student says a man grabbed her from behind saturday night and sexually assaulted her. she told newark police she was walking alone off campus at 10:30. he pushed her against a car, attacked her, then rean away. a defendant in the

bridgegate trial in north jersey says the lanes of the washington bridge were closed for legitimate work, not payback. bill baroni testified that the closures had nothing to do with pay back. he and bridget kelly are both accused of intentionally shutting down several lanes of the gwb in 2013. christie denies knowing of plans to shut down lanes. today opening statements ghabegan in a trial involving jy sandusky. mike mcqueary is suing the university, claiming it ruined his coaching career and personal life after he reported sandusky's abuse to school officials. today a lawyer for penn state argued it's not the university's fault that ma query cannot find another job.

let's take you overseas. a major battle against isis started a few hours ago. this morning iraqi forces backed by american air power and artillery slowly advanced on the iraqi city of mosul which has been under the control of isis for two years. the operation is expected to take weeks, even months. the united nations has expressed concerns that over a million civilians could be forced out of their homes or used as human shields. retired general cartwright pleaded guilty a few minutes ago. prosecutors say he leaked classified information to "new york times" reporter about a covert nuclear weapons plan. he retired in 2011. 53 philadelphia police academy recruits graduated today, taking an oath to serve and protect. nbc 10 at the graduation ceremony this morning. 50 of the graduates will work for the philadelphia police

department, while three others will serve as septa police officers. in the past few hours, three men pleaded guilty in connection with a shootout that left olympic sprinkler tyson gay's daughter dead this weekend. 15-year-old trinity gay died in the hospital after being shot in the neck during a shootout between two people outside a restaurant in lexington, kentucky. trinity was a star track athlete at her high school. police believe she was an innocent bystander. opening statements are expected as early as wednesday in th in the etan paetz murder trial. 6-year-old etan disappeared in new york city back in 1979. he became one of the first children to ever be featured on milk carton. hernandez confessed to killing the boy but his lawyers say he

is mentally ill. our partners at wdpl says there is a new petition for state lawmakers. the governor has repeatedly said there is no chance but his term in office ends january. the city of philadelphia wants your input on its initiative to end youth smoking. a public hearing is being held at 5:30 at the municipal services building. last week the mayor announced tough penalties against retailers that sell tobacco products to minors. the city wants to increase the fee to businesses who sell tobacco from 50 to $300. that money will go toward hiring more inspectors to crack down on youth tobacco sales. the hoboken train station is back on track and running again. about three weeks ago a new jersey transit train killed a woman and injured more than a

hundred people when it crashed into the station. six more tracks opened early this morning. new jersey transit officials say trains entering the station will not reduce the speed limit from ten miles per hour to five. investigators say the train that crashed was speeding at this time of the accident. no relief yet for residents dealing with the aftermath of flooding in north carolina. volunteers are pitching in to help people who still have no place to stay. it could be another week before floodwaters recede. picture perfect in delaware valley along the river. >> nothing wrong with an october warm-up. meteorologist krystal klei is joining us live. >> krystal, i know you're taking a look at the fall foliage. >> reporter: guys, if you're like me, you've just been itching for those fall colors. currently, if you take a look outside, the likelihood is you won't see too many trees that have fully changed color, kind

of like some of the trees you see behind me. there's an actually a few reasons why that's happening. from walking your dog to hiking to simply driving to work. you may be thinking the same thing this fall. >> i think they could be a little better. you know, a little bit more color. but we're getting there. >> reporter: it's still pretty green. >> which is surprising, i'm not used to it being this green. >> reporter: while portions of the region have gun to see colors, the southeast portion of pennsylvania as well as southern new jersey and delaware haven't been so lucky. >> it seems like a very slow start. when fall does hit, it will probably be fast and quick. >> reporter: according to forester heather kerr, there are quite a few factors that determine when foliage peaks and how long it lasts. >> the nights become cooler as the seasons change. the trees become dormant and

send their reserves down to their roots. >> reporter: while we have had a drier than average year, we actually had a wet start to fall, which can delay the start of peak foliage colors. finally, it all depends on different trees' reaction to the weather. >> different species have different chemicals in the leaves. maples will have different chemicals than an oak. they'll produce different colors, different vibrancies, and start changing at different times. >> reporter: and here is the good news. those colors are projected to start filling out at least a bit more beginning this weekend, and lasting through halloween. but the forestry department says your best bet is to head to higher elevations where cooler temperatures have already hit. krystal klei, nbc 10. >> all right, krystal. i love watching the transformation this time of year. but this weather we're having today, i love that even more. >> i know, 80 degrees, mid-october. we're close to breaking records. >> let's get back to sheena with how long this heat wave will

last. can we call it a heat wave? >> not technically, jim, but it might feel like one compared to what we've seen yesterday, so relatively speaking, yes, it might feel like a heat wave. but we won't get into the 90s. it will be in the 80s, comfortably warm outside. some think it will be hot compared to the last several days. but the night conditions will be lasting as we go through the next few days for sure. center city, mostly sunny skies. when we're talking about the leaves changing and 80-degree temperatures moving in, it will be confusing, but it will look like fall, feel a little more like summer outside. nice conditions locally. look at the 80s, 81 degrees through many of our pennsylvania suburbs. wilmington coming in at 81. south jersey neighborhoods, as well as the lehigh valley, all close to 80 degrees. we're all seeing nice dry conditions. your neighborhood weather for chester account, west brand ford township, 79 degrees.

malvern is at 80 degrees. montgomery county, mostly upper 70s. 79 degrees in ft. washington. some spots in bucks county around 80 degrees. satellite and radar giving cloud cover across the philadelphia area and parts of pennsylvania. these are thin clouds. we don't expect any rain from them. our next chance of rain really won't be until the end of the week. so with the warm air coming, we're not expecting rain with it. we do expect record high temperatures. take a look at what we expect over the next three days. the forecast high and the record high, very close if not hitting a record temperature. forecast 84 degrees tomorrow for the philadelphia area. the record is 81. wednesday, the forecast is 84, the record is 80. on thursday we could be close. thursday will be that transition day where we start to see things cooling down a little bit. we get more clouds in, the rain chance goes up. we could be looking at records i think over the next two days, possibly the next three days

when you factor in thursday. here is a look at tomorrow's high temperatures for everybody. elwin, 81 degrees with a lot of sunshine. langhorne, 82 degrees. allentown, 82. reading, 83. plenty of sun for new jersey. voorhees township, 83. delaware coming in 83 degrees in newark. so tomorrow's going to be a warmer day. a little bit warmer than today. look at future weather here. we don't expect much in the way of cloud cover, we don't expect anything in the way of rain. then wednesday will be another day when we're in the 80s. by the afternoon, plenty of sun still. then we start to see things change on thursday. thursday we'll get more in the way of clouds. chance of rain starts to go up. it will go up a little more on friday. that's when the temperatures will really start to drop off in time for the weekend. take a look at your ten-day forecast. dry, tuesday, wednesday. thursday, friday, rain chances go up. look at what happens to our temperatures, 78 on thursday, 68 on friday. and we keep on dropping into the

>> announcer: this is nbc 10 news. welcome back to nbc 10 news at 4:00. our nbc 10 responds team solves another case. >> this involves a philadelphia woman trying to get her broken fridge replaced. ines ferre has the story. how long has this been going on, innes? >> over a month. the viewer shays she tried to reach out to the store for 30 days and when she didn't get a reply, she contacted nbc 10 responds. >> reporter: evelyn capper use a small bridge in her basement to store food and her father's insulin medication. she says this is a makeshift solution since the refrigerator in the kitchen started breaking down. she says she reached out to h.h. gregg, where she bought the fridge and a service plan. >> i tried to reach customer

a republican office in new york new york was firebombed over the weekend. a group of democrats started a gofundme page to collect $10,000 to help the gop office reopen. they raised more than $13,000 in less than an hour. fortunately no one was hurt when somebody threw a bottle filled with flammable liquid into the office, gop representatives from around the state are calling the attack political terrorism. talk about a miracle baby. >> a charleston woman did not let those rising floodwaters from hurricane matthew stop her from giving birth in the hospital. she went into labor in the middle of the hurricane. she called for an ambulance but was told there would be a delay because look at all that water. so she decided to walk five blocks until someone gave her a ride to the hospital. >> it was a hell of a journey. a hell of a journey. and everyone was like, you wouldn't do it if i was you. i was thinking not about me but about him. >> the mother was born during

>> announcer: this is nbc 10 news. about a third of teens are getting behind the wheel when drowsy, the finding of a new study from mutual insurance. 32% of teenagers surveyed say they struggle to stay awake while driving and one in ten has dozed off behind the wheel. as you would expect, drowsiness impacts response time.

a new study says women can wait until their mid-20s or even 30 before undergoing cervical cancer screening. they suggest women over the age 21 be screened for the disease every three years. harvard researchers used a computer model to estimate the risks of testing. they found women may only need to be screened every five to ten years and can start later in adulthood if they've been vaccinated for hpv. more students are graduating from high school than ever before. >> today the white house announced the u.s. graduation rate has reached a new high of 83.2%. that was for the 2014/2015 school year. president obama spoke about the achievement at a high school in washington, d.c. today. it's not all good news. there were significant differences between ethnic groups. asian-americans and whites had the highest graduation rates

temperatures this week will be warming a little bit, a taste of summer, if you will, through the next few days. but it won't last through the weekend. it will be cooler as we go into the weekend. temperature right now 81 in philadelphia and many of our pennsylvania suburbs. delaware coming in mostly in the low 80s. philadelphia area, 81 degrees. the normal high is 66. we're well above normal across the area. 81 fox chase. now, we will be setting potential record highs over the next couple of days. i think some areas will hit records. again, the normal is 66. take a look at what's going to happen, forecast high 84 for tomorrow and wednesday. thursday we'll drop into the upper 70s with more cloud cover, some rain. look at the record high, 81 is the record for philadelphia. tomorrow, forecast high going for 84 again. 80 is the record on wednesday. we'll still be above that. and thursday could be a close call, but we are looking at forecast records.

and that will be ending as we go into the end of the week. the shower chance returns by thursday and friday. that will really start to drop those temperatures, especially as we go into your weekend. but until then, you can enjoy the warm air. that weekend weather is going to start to change quite a bit. there is the warm air as we go into tuesday and wednesday. it's still over the area. then you see the cool air moving in from the north. it will get quite a bit cooler for your saturday and sunday. look at that dropping down from canada. temperatures will be noticeably cooler into the weekend. if you like the warm air, enjoy it over the next few days. now we look at the temperature trend. you can really see it very well here, mid-80s tomorrow and wednesday. thursday, upper 70s. friday, upper 60s, big drop there. then we're looking for a 60 high over the weekend. going from the summer feel to very much like fall this weekend in and out of we're looking at radar and satellite. we have a few clouds around, but no rain. we really won't have rain the

next several days. a big area of high pressure will keep us dry, also going to help warm us up, pulling in the warm air from the south. eventually it will move away and we'll see the rain chance move in thursday, also friday. here are some of the high temperatures for friday, reading 83 degrees. we'll be dry with that. if you're in pennsylvania suburbs, phoenixville, 83 for a high tomorrow. philadelphia area, mid-80s. plenty of sunshine, you don't have to worry about the rain. haddonfie haddonfield, 83 degrees. along the shore, 81 for galloway township. wilmington, 83. dover coming in at 82 tomorrow. so a nice warm day. future weather keeping us nice and dry here, tuesday afternoon, plenty of sun. as we go into wednesday, we'll still see a fairly dry day here, looking at the mid-80s by the afternoon wednesday with partly cloudy skies. thursday, we start to see a change. i mentioned those rain chances moving in, temperatures start to
