before 9:00 this morning. good morning. kathleen kane is fighting to stay out of a prison cell. her attorneys are arguing she should get probation or house arrest instead of jail time. mo neek is live outside the montgomery county courthouse. do we expect to hear or what do we expect to hear rather from kathleen kane today? >> we're not sure if she's going to testify, but i can tell you the former attorney general arrived here about two hours ago. with her family. mrs. kane, would you like to make a comment? what do you hope happens today? wearing a dark suit and white blouse, the convict ed felon smiled, but said little. kane has come to court to face her punishment. three things the judge will consider. the sentencing glooin of 12 to 24 year kane's years of public service and the best care of her two teen sons who are sitting

with defense witnesses today. back h in august, the 50 yaerl kane was convicted of master minding a leak of grand jury material to a newspaper, then lie about it oath. they want a significant and stiff punishment like a prison term, but her tones want probation or house arrest. in court document, attorney said she had close to 30 letter of support including one from kane's mother. she says the prison sentence could be def kevin stating to kane's teenage son, kane's new aattorneys are appealing her conviction. now, kane never testified during her trial, we're quoing to let you know if she takes the stand today. live for now outside the courthouse. nbc 10 news. >> only only 10, we're hear iin from an amputee who was tossed from his wheelchair while two robbers stole everything they could find in his home.

we spoke to the disabled man after the home innovation yesterday and he asked he not identify him. flis say a man and a woman barged into his home. the truders pushed the victim out of his wheelchair and swiped his wallet, key, cell phone, tv and paper towels. >> he said he had a gun. and but i didn't see no gun. >> the robbers left through the back door of the house. the victim told us he had to crawl outside and wait for someone to pass by to get help. a philadelphia police officer is recovering after having ditch his bike to avoid being hit by a car. he was on his bike in east russell street when a car came at him. the bicycle was hit, but the officer wasn't. the driver got out of the car and ran. police caught up with him four blocks away. he was arrested and we've learned this morning, charged with assaulting an officer. the officer wasn't seriously

hurt. now your nbc 10 first alert weather. >> the winds are pickinging up this morning. but we're in store for a pleasant day. here's a live look outside of center city, philadelphia. first alert chief meteorologist is here with forecast. >> it is a beautiful morning out there. a little bit warmer than it was at this time yesterday. already 62 degrees in philadelphia. got sunshine across much of the area. still on the 50s in parts of the pennsylvania suburbs and up through the lehigh valley, but the temperatures are getting to near 60 degrees. chads ford at 60 right now, lincoln university getting close at 59 st. david, 60. bryn mar, 60 degrees. lot of places didn't get out of the 50s during the day yesterday. we still have this west to northwest wind. it's 15 to 20 miles an hour.

it may gust up as high as 30. during the afternoon. as temperatures are in the mid-60s. pretty close to average for this time of the year. the some of the ub ushs may barrelly git get up to the 60 degree mark and it's possible lehigh valley doesn't even get there. and then during the night tonight, it's still kind of windy. as the front comes through, so it will not be that chilly. but tomorrow night is a different story wooechl see how cold that's going to get and if we're quoing to see rain this week in just few minutes. an ongoing battle between ub ber, lyft and the city philadelphia could be coming to end. lawmakers are expecteded to vote today on making the ride sharing services league. last week, a law was passed legalizinging the rides. uber and lyft drivers rb giving people rides in pennsylvania for year, but illegally. the company has a temporary deal with the city, but that's

expired. a judge ruled it was okay for companies to give rides in city, but the philadelphia parking authority has been ticketing drivers. time now for a check on the roads with jessica boynton and what are you seeing? >> we're going to start on the blue route. we are watching an accident that's causing major derays on the southbound side. we have several lanes blocked there and making us have 67 minute drive time, which typically should be about 13 to 15 minutes or so. give or take. now, a little slow on the northbound side now. that's probably just from cars stopping or slowing down to k look at scene, but 67 minutes. almost an hour delay there from the southbound to 95 because the trip is typically about 15-minute ride there. average speeds into the teens. slow go and a little slow if you're heading into philadelphia. the construction on the ben franklin bridge where two lane as are closed.

the rest of the bridges are okay. here's 95 around cot mann avenue. we had some congestion, with police activity. looks like that's cleared. right around creek road. and lastly in cherry hill, new jersey. watch for construction. springdale road, this is going to last for the next three weeks. started this morning at 7:00 p.m. that's closed from easton road to wilderness drive, so there will be traffic around the scene. pamela. >> we now know what caused a scare on board a plane at philly international airport sunday morning. american airlines says a couple of hours before the flight to boston, a couple walked op to the plane and took their seats. when the crew discovered them during boarding, they evacuated and searched the aircraft. the couple did have tickets for the flight. the airline put them and other passengers on another plane. officials are investigating how the couple got early access to the plane.

testimony is back underway in the defamation lawsuit brought by a former assistant football coach against penn state. mike mcquery claims he was wrongfully fired after the scandal. on friday, he testified he was angry, he couldn't go to team facilities after sandusky was charged with child abuse. mcquery says he was treated as a villain for speaking up. he's suing penn state for $4 million in lost wages and other claims. the second defendant in the bridge gate trial the back on the stand in north jersey this morning. bridgette kelly testify ied on friday that she told governor christie about the bridge lane closures before they happened. and that she had his approval for what she called a legitimate traffic study. christie denies he knew anything about the plan to shut down the lanes. kelly was deputy chief of staff to the governor when all of this unfolded in 2013.

she and the former executive director of the r port authority are accused in the scheme closing arguments are expected to begin on wednesday. happening today, a new jersey congresswoman will announce new legislation to keep children safe from lead poisoning in schools. testing over the summer found trenton public schools have elevated levels of lead in more than three quarters of its buildings. the congresswoman will announce new legislation today. meantime, new federal housing and urban development money will also be coming to trenton to help to be used to help local homeowners renovate lead based paint. this is a national poison awareness week. today in south jersey, the mayor of atlanticty will lay out his plan to keep the city financially afloat for the next five years. a special city council meeting being held at city hall at 5:00

decision 2016. the presidential candidates have just 15 days left to convince voters. today's schedule finds democrat hillary clinton in new hampshire and republican donald trump in florida. a new abc thus poll of likely voters nationwide shows clinton with a 12 point lead. president obama is firing up his support for hillary clinton and democratic candidate for the u.s. senate, but he's also drilling down the democratic hopefuls in legislative races. the president plans to endorse dozens of down ballot candidates in 20 states. the support will come by way of robo call, social media spoes, mailers and radio ads. democrats in tough races are hoping to hitch themts themselves to president obama who's enjoying a high approval ratinging. "the new york times" just published a full list of donald trump's insulting tweets since

he started his campaign. the complete list includes 281 people, places and inning things that trump has insulted on twitter. the newspaper says it put more than 4,000 tweets into categories they found one in every eight was a personal insult of some kind. to decision 2016 and tonight, the candidates for u.s. senate in pennsylvania will debate here in philadelphia. republican incumbent, pat toomey and katie mcginnty will face off at temple university. the latest quinnipiac poll shows a lead of 20 percentage points. they debated in pittsburgh last week. i spoke with an expert to get her take on the race. >> both are sort of hardened into their positions at this point. really try and persuade a few people. >> tonight's second debate between mcginnty and toomey will be their last.

now, your nbc 10 first alert weather. >> well, nothing like last week, but it is not at chilly today as it was yesterday. we're already seeing places in the 60s. in delaware, south jersey,ier jersey shore. 62 at the airport. 63 in society hill. 62 in westbound area and parkwood and a lot of these places will at least get into the mid-60s today. we have some clouds in the northwest flow, moisture across the great lake, not expecting any precipitation during the day and we don't have any strong weather systems headed this way. no fronts with any moisture and so, it's going to not only stay dry today, but over the next couple of days. we were 80 degrees on friday, then dropped.

56. today, about 63 and then tomorrow, we're going to drop dwen. the average high is about 64. and on average, the best fall colors are coming out in the next week or so. even in southeasten pennsylvania. we are at the peak. lehigh valley and up towards the adirondacks in new york and very close to the peak in other parts of the lehigh valley and some of the northern western suburbs. it is just spectacular looking out there. we have winds gusting up to 23 miles an hour in millville. 22 in philadelphia. again, not nearly as strong as what we saw over the weekend. those showers and northwestern pennsylvania are not going to make it as we go through the day today and some snow flurries on the future cast up in some of the mountains in new england. yeah, a sign of things to come eventually. eventually, winter will be here.

tomorrow afternoon, we're still kind of dry. we're dry into wednesday as well. but as we dpo into thursday, we see moisture approach frg the west and that's when we should see some showers this week. and the rain chances show that in philadelphia practically no chance until thursday. same thing are dover and atlantic city. and in redding. there's the one day where the rain chance spikes up and that's about it. as you go through the day tomorrow, it's, we're not seeing anything close to 60 degrees. plus, we have 15 to 20 mile an hour wind, so it's going to be cold colder tomorrow, then another chilly day on wednesday. tomorrow night, it's a wednesday morning should be the coldest we'll see temperatures down near freezing in parts of the suburbs and could be a hard freeze in some of those areas, look at

62 degrees. dry. trz that's for sure. we were breezy tonight as a cold front coming through, so it's going to feel like it's in the upper 30s in many parts of the area. and then tomorrow night, the temperature itself is going to be going way down. more on that and the next rain coming with the rest of the ten h day in a few minutes. federal investigators are looking for the cause of a deadly tour bus crash in southern california. 13 people were killed when the bus plowed into the back of a tractor trailer yesterday. morgan radford reports from palm springs. >> weekend trip to the casino turned deadly. passengers shaken. witnesses say around 4:00 a.m., their tour bus left a kwacasino headed for los angeles. an hour later, it slammed into the back of a tractor trailer in palm springs.

five people are dead in a plane crash. a small plane was headed to monitor migrant traffic off the coast of lablabia. the airport was closed for about four hours while the debris was cleared. near fresno, california, a police pursuit turned into a shootout when a suspect started firing at a rookie officer's car. it happened while a citizen was with the officer as part of a ride along program. the officer tried to pull the suv over, but the driver wouldn't stop. then a passenger started shoot ing at the officer's car. the bullets hit the officer's wind fie windshield, ending the chase. the private citizen suffered minor injuries from the shattered glass. tom hayden is dead. his wife said he died yesterday in southern california.

after a long illness. hayden made headlines in the 1960s with his trips to north vietnam and his marriage to actress jane fonda. he went on to nearly two decades as a state lawmaker. he was 76 years old. new proof that football, young football players are at risk for brain injury, even if they never had a concussion. researchers at wake forest university recorded the head impacts of 25 football players between 8 and 13 years old. after one season of play, the players who had the most hits to the head showed changes in brian white matter, which helps connect different areas of the brain. these players had no signs or symptom of a concussion. and there are new recommendations for the safetiest way to put your baby to bed. 3500 babies die in their sleep each year in the u.s. nbc 10 national reporter erica

edwards has the new precautions from the american academy of pediatrics. >> you are lookinging at one of the most dangerous places for a baby to sleep. >> if i had to choose one place where i would never want a baby to sleep, it would be on a coach or sofa. >> that's because babies can become trapped between the cushions or underneath a sleeping adult, who rolls over on them. the american academy of pediatrics is emphasizes the dangers of soft bedding for young babies in its new sleep safety guidelines. the experts say room sharing can reduce the risk of sides by half and now recommends babies sleep in a crib up to age 1 in the parent's room. the only thing that should be in the baby bed is the baby. for the first time, the safe sleep guidelines include a recommendation for skin to skin contact just after birth. >> we know skin to skin helps

northwest winds continue to bring moisture from the great lake s, but it doesn't quite reach southeast earn pennsylvania and so, we're not expecting anything in the way of rain over the next couple of day days. but look at that snow showers up over the mountains in new england as the colder air starts to come in again. so, this is a pretty good shot of cold air that's coming in and this system is going to be bringing the rain. as we go into thursday. tomorrow, temperatures only in the 50s. tomorrow night, we're down into 30s. it's possible some parts could get into the 20 by wednesday morning. look how chilly, phoenix down to 37 degrees after a high of 55. mt. airy, 38 degrees after a high of 54 tomorrow. they say it's cool today, wait until tomorrow tomorrow night, these temperature, hardly any

families? >> it's a fund raising non-profit that raises funds to help local special needs children. participate in all kinds of social activities and outings that they may not otherwise have the able thety to participate in. >> tell us about these activities they participate in. >> we have a sunday sports group and they come every sunday at 3:00 to the greater plymouth community center and we kind of change it up. we do hockey, scooter basketball, beach ball volleyball, tennis. we do -- >> so, a lot of good stuff. >> a lot of sports. they enjoy the sports. >> tell us about the weekend run and how people can participate in that. >>. saturday's event is the family fun run. like you said, we are co-hosting with exceptional families of exceptional children and it is a
