later. good morning. i' m emily riemer. randy: and i' m randy price with cindy fitzgibbon. another mild start. cindy: you close your eyes and you would swear it is not december outside. the pattern all month long and we' re going to show you what it looks like in boston. the fog is not reducing visibility. it is reducing visibility, down to about a third of a mile in south shore and parts of the cape. visibility could drop below one quarter of a mile. the fog is out there and it may slow you down. 49 in boston right now. a couple of spots in the 30' s, orange. we have a lot of clouds above

cannot completely rule out a glimpse briefly of sunshine this morning. showers are creeping up the coastline and they' re going to come at us late in the day. mostly cloudy with temperatures around 50 degrees about lunchtime. by 6:00, we have some showers around. 3:00 this afternoon there could be a couple of showers along the south coast and the cape. very light rain starts to settle in. the rain intensity is going to ramp up during the overnight hours. let' s get you out to the roads. you. some areas of dense fog. heavy delays on the express. about 15, 20 minutes to get from braintree up to the tunnel.

we' re dealing with a crash taking out one lane at 139. delays almost back to 124 and that brockton stretch. stilson slowdowns getting onto the expressway. coming down. in it again and pockets. 128 south there is a crash clearing on the ramp. if you are taking the trains, they are running on time, including the subway line and the computer rail. randy: thank you. right now chipotle is getting ready for a big move, trying to reopen a restaurant that made more than 100 people sick. emily: the eyeopener' s antoinette antonio is live in boston with the steps being taken this morning. antoinette: an inspection is happening today. if everything comes back clean, chipotle could reopen by the end

workers have been cleaning from top to bottom after a norovirus outbreak. most of them, boston college students, after eating at the location. the mother of one of those victims is now suing chipotle. health officials said an employee was sick at the restaurant and that may have caused the outbreak of norovirus. chipotle issued a statement last night saying, " we have been working to be sure the restaurant is safe to open." representative say the entire place has been disinfected. a second test of the nora virus has come back negative. we will keep you posted with what happens with today' s inspection. randy: thank you.

attorney general is issuing a warning to gun dealers across the state. "the globe" reports, since the mass shootings in san bernardino and colorado, maura healey' s office has investigated several dealers suspected of selling banned weapons. and she' s warning all licensed dealers to obey state laws. those laws were tightened last year, but have long been some of the toughest in the country. emily: right now police are investigating an armed robbery in brighton. it happened in the 200 block of lake street last night. police tell newscenter 5 that one person was robbed, and the suspect or suspects got away. no one was hurt. right now the man who loaned a gun to the boston marathon bombers is free and apologizing. stephen silva walked free yesterday for the first time in a year and a half. he admitted to lending his gun to dzhokhar tsarnaev, which was later used to murder m.i.t. police officer sean collier. the 22-year-old silva was a close friend to tsarnaev at the time.

silva apologized for his role in the crime. >> i would like to give my deepest condolences. it is just sad a close friend chose to do that with his life. emily: silva' s cooperation with prosecutors proved key in the marathon bombing trial. his testimony helped undermine the defense case that tsarnaev' s older brother tamerlan was the driving force behind the attack. for that, he received a lesser sentence. >> we shouldn' t let anyone bully his way into the presidency. randy: hillary clinton fighting back in her war of words with donald trump. despite outcry, the republican front-runner is not backing down. the eyeopener' s erika tarantal is here with details in overnight. erika: donald trump took to twitter to explain his use of a vulgar term, that means a sexually degrading act, to describe clinton' s primary loss in 2008. the gop front-runner insisting it was not vulgar and he simply meant she was beaten badly in the race. not responding specifically to

emphasized the importance of standing up to bullies. fellow democratic candidate bernie sanders was more direct, describing trump as clearly upset and poking fun at him for calling it disgusting that clinton took a bathroom break during the last debate. >> i don' t know what his relationship with women has been in his life. he has discovered that women go to the bathroom. >> i think there is a lot of women that are insulting to other women and to men out there. erika: the latest national poll still has trump leading the gop with 28% of the vote. but quinnipiac university says six in 10 women voters now say they would be embarrassed to have trump as president. emily: thank you. 5 investigates getting results this morning. a court clerk magistrate is off the job after 5 investigates tracked her work habits. ann colicchio was one of the highest earning court clerks in the state. sources tell our kathy curran she' s been suspended for 30 days

investigation. 5 investigates tracked the work habits of the concord district court clerk magistrate for 26 days and found the clerk at the courthouse on average only two hours and 23 minutes a day. while court was in session in concord, our investigation found the clerk miles and miles away in lowell. colicchio told us she was using earned time to deal with family health issues, but after our investigation, the state trial court launched a review. we reached out to both her and her lawyer, but did not receive any response. randy: prosecutors say a lakeville mother accused of kidnapping her two children planned to kill them. in court yesterday, prosecutors claimed that valerie mcgrath was so distraught over losing custody of her children that she planned to kill them, and then herself. she failed to return them to their father' s home on sunday, causing a search that finally ended monday night. mcgrath was ordered held on $50,000 bail. convicted killer aaron hernandez

one of the jurors who voted guilty was biased against him. hernandez' defense says a juror in the odin lloyd murder case may have known hernandez was implicated in two other murders. information about the double-murder case was excluded from the lloyd trial. hernandez' lawyers want to question the juror. no decision on the request yet from the judge. emily: right now an ayer man charged in a deadly hit-and-run in worcester is preparing to face a judge. daniel depew will be arraigned on several charges, including drunk driving. police say he hit gina and george burdick as they unloaded groceries from their car in september. depew is being held without bail. 5 on the opioid crisis. more than a dozen people are under arrest this morning, charged in a massive heroin bust in maine. we' re talking about nearly 18 pounds of the drug, worth $3.2 million. these suspects, including 34-year-old brian aquino from lynn, are facing aggravated trafficking charges.

police in ohio say the man had been switching price tags on coats at macy' s. when he got caught, he ran. so take a look again. he was running down the up escalator he runs into a police officer coming up. the officer tried to catch him by his legs, but couldn' t grab on. the suspect was not seriously hurt, but he' s now facing misdemeanor threat charges. right now police in londonderry, new hampshire, are looking for the person who' s been throwing full bottles of water at moving cars. one time, it was caught on video by a dash cam. take a look. you can hear the thump as three bottles hit the car and bounce off. five cars in two days have been hit by full water bottles. police ask anyone with information to give them a call. randy: a check of your economic headlines. asian stocks rallied overnight in light trading, following gains on wall street yesterday. the dow rose 165 points tuesday. right now, stock futures are up.

for a report on new home sales. as the number of orders amazon fills every year goes up, the company is looking for ways to cut delivery costs. right now, u.p.s. delivers most of their packages. but "the wall street journal" reports amazon is looking to take control of those logistics. it' s already using its own trucks, drivers, and couriers for the final leg of an order' s trip. and the company is now considering leasing cargo planes and building its own freight operations. emily: they' re a big part of the holiday season, those post-christmas shopping deals. but experts say some items can be a bigger steal than others. first, electronics. expect deep discounts from the big retailers on things like tv' s and laptops, especially since the new versions are usually unveiled in january. if you need a winter coat cold-weather clothing is often , slashed after the holidays so retailers can make way for spring inventory. and finally, the post-christmas rush might be a good time to

the roosevelt circle, medford, about 16 minutes down into the boston area. earlier problems on 24 have cleared away. delays from brockton up to the randolph area. the expressway heavy at adams street. taking the trains, red lines reporting some minor delays. emily: thank you. now to some of the stories we' re tracking right now on the eye. randy: erika is following information as it comes in. erika: the chipotle restaurant in cleveland circle will make a push to reopen today. city inspectors will be on site later this morning. more than 150 people got sick from the norovirus after eating at that location. right now boston police are searching for an armed robber. the crime happened in the 200 block of lake street in brighton last night. one person was robbed, and the suspect or suspects got away. luckily no one was hurt.

hit-and-run in worcester is expected to face a judge. police say he hit people as they unloaded groceries from their car. randy: right now a warning to homeowners, as police try and track down holiday thieves. they are after a very specific type of decoration. emily: the eyeopener' s todd kazakiewich is live in dorchester with the target. todd: thieves are after the newly popular laser lights. they hit the house behind me in dorchester. since they' re sold out in many stores, crooks are helping themselves. the lights shine through a projector, making holiday decorating easier, and less time consuming than hanging lights. quintino centeio caught a grinch on surveillance in dorchester, stealing his pricy laser display. another was captured in lynn, unplugging the lights, and

the new steps for the location. antoinette: the outcome of the inspection. it could reopen by the end of this week. inspectors will be here later this week for the inspection. workers have been disinfecting from top to bottom after a new norovirus outbreak. students suffered nausea and vomiting. the mother of one of the victims is now suing chipotle. representatives say the entire establishment has been disinfected. a second round of samples taken has tested negative for norovirus. we will keep you updated after today' s inspection. todd:

convicted of murdering his high school teacher understood exactly what was going on during his trial. those comments from the judge in the case who ruled phillip chism confident for that trial. chism will be sentenced on january 29th for the murder of colleen ritzer. because he was a juvenile at the time, chism can' t be sentenced to life without parole. randy: the woman charged with murder in a las vegas crash will make her first court appearance today. lakeisha holloway was charged with murder yesterday, hit-and-run, and child abuse. police say she intentionally drove up onto a sidewalk, plowing into a crowd, all with her young daughter in the car. one person was killed. emily: a woman is dead after she was forcibly removed from a hospital. police say the 57-year-old collapsed on monday. she was pronounced dead.

new york real estate heir and suspected murderer robert durst will head back to los angeles to face charges. prosecutors say he killed a friend to stop her from cooperating with an investigation into the 1982 disappearance of durst' s wife. durst was arrested months ago in new orleans on weapons charges. randy: twin birth rates hit a new high in the u.s. last year, nearly four million babies were born and 135,000 of them were twins. that' s about one in every 29 babies. in 1980, that ratio was only one in 53. experts believe the increase is due in part to the number of women waiting to have children. they say women in their 30' s are more likely to have twins than younger women. emily: an animal scare at the airport in myrtle beach. surveillance images capture a coyote running through the baggage terminal. airport staff say they have no idea how it got in. animal control was called, and they wrangled the coyote in

49 degrees with a light wind. we are talking about the warmth and the humidity. fog is widespread this morning. there may be spots for the visibility drops under one quarter of a mile. 46 in worcester. lower 40' s on the south shore. the fog is going to hang with us for the morning hours. by 5:00 p.m., some of this rain is going to start to work in. this is the leading edge of record warm temperatures. notice by 3:00 this afternoon, lower 50' s. 11:00 tonight, we are inching those temperatures up. the temperatures climb overnight as the rain comes in.
