his probation ended just a couple months ago. >> reporter: and this report accuses him of a similar crime right here in this eep complex. >> -- apartment complex. >> it was really frustrating to me that he would get away. >> reporter: she came face-to-face with a flasher performing lewd acts outside her bedroom three times. >> i really wanted to go out there and beat him up. i wanted to get home down on the floor and wait until the police come. >> reporter: she made the first report in december and helped with a sketch of the man. the second was in january. both times, officers say they just missed their suspect. 28-year-old winston garwin. in 2009, he was accused of exposing himself to several teenagers. i looked up the case, and will clerk shows he pleaded no contest to performing a lewd act. adjudication was withheld,

offender and received five years probation. >> if he were going to escalate to do something more, i'm glad we got him. >> reporter: by the third incident, this mom was ready for an arrest. she stayed on the phone until officers arrived. garwin was running from the scene. >> i hope that doesn't happen again, and i hope he's not allowed to live anywhere near children. >> reporter: i spoke to his family over the phone this afternoon. they told me he is a good man and they do not believe he committed this crime. the latest on breaking news we've been following since four o'clock. it was a 5-year-old boy who was pulled from a canal near an orange county elementary school.

blocked off there. they're still investigating here. >> reporter: they're focusing their attention at the end of that fence line . crews pulled a 5-year-old boy out of that canal, and he was transported to the hospital. investigators have color ed confirmed that the victim attends a nearby elementary school. if that child attends that school from the school district, we'll find out. they're trying to figure out how that boy was able to make it past that area. we're also waiting to speak to the sheriff's office to gather a little more information on the

investigators are trying to find out more about a man who pulled a gun on palm bay police before being shot to death. it all started over a noise complaint at a home on mariposa driver after a 2-hour standoff. jeff, investigators haven't said much about the man involved here. >> reporter: not too much. they say he's 39 years old and does have some criminal history. i did speak with his goich. she told me that -- girlfriend. is former military and was a area. he called her and she tried to come down here to the crime scene where you see the investigation is still ongoing. she says the police told her not to come down here and she says at the time her boyfriend has been suffering from schizophrenia, paranoia, and ptsd.

crew doing work on a home came face-to-face with an irate neighbor. >> he was upset they were making noise. >> reporter: police got a call about the upset neighbor taking things too far, threatening to shoot three people who were working on the home. >> it was kind of a family job then we subcontracted out to some friends of ours, and they were working. >> reporter: her sister and nephew were two of the people threatened. when police arrived, they told us they tried to talk the suspect out of the home. when he did come out about two hours later, he had a gun and officers felt threatened. one officer, a 10-year veteran fired one shot and killed him. >> it's horrible. it was certainly preventible. but when somebody comes outside and pointeds a gun at our officers, they have to respond accordingly. >> reporter: they are investigating the shooting while people here are left wondering why someone would get that upset about noise. >> it's crazy. obviously either

or he was intoxicated. >> reporter: and one neighbor who witnessed this told me he saw the man come out with a gun pointing it and saw police shoot him in the head. we are told the dead man's families in puerto rico, they have not been notified so they are not releasing his name. a 20-year-old man has been arrested in a shooting at the florida mall from three weeks ago. he appeared before a judge today, charged with two counts ever third degree murder and was granted a $25,000 bond. so far investigators have not released a motive for the killing. the university of central florida just received the largest private donation so far for its new downtown campus.

an 8-year-old student from riverside elementary school is in critical condition after he fell into a canal near that school. we have a crew on the scene getting the latest. a 1-night performance of the vagina monologues is at the center of a controversy tonight. a businessman is lead ing a protest against the play and a burlesque show planned in the city. >> reporter: the vagina monologues is set to play here later this month. but there are those who don't want it here. and today they went to city hall to speak out about it. >> it everything from the female experience, from rape survivors, the average young woman, they're all stories from real women.

the monologues and a vintage style buresque review sat outside of city hall to spread the word about their message. they're convinced both should go on. eventually the protestors went inside for the council meeting where people on the other side of the issue are hoping to convince leaders to keep shows they feel are offensive out of the view of tax payers. >> where is the line that you don't cross? >> reporter: those who actually support the plays say they feel like the plays don't violate the lease agreement of the venues. and right now that city council meeting is going on. we'll let you know what the council had to say later on.
