magnitude of this evacuation and it all started with a man who says he was just headed down to the laundry room. a man calling 911 after smelling a strange gas. >> i smelled a smell and thought it was wrong so i found it in the basement, it was the furnace and called the property manager. >> reporter: firefighters evacuated the building and all the families inside at riverside condominiums in watertown. officials say three adults and three children had to be taken to the the building says it does have carbon monoxide dedetectors. >> reporter: back out here live i just spoke with the man who was out here fixing that furnace and he says it should be wrapped

>> tonight on 7, charged in a killing crash. a driver facing consequences from a restaurant tragedy. >> it took six months, but a grand jury has decided to hold a man responsible for the deadly drive. >> police say the driver barreled down chestnut street. we have night team coverage of the indictment and reaction from the victim's families. we start with tim caputo who is live in newton. >> reporter: that restaurant is the driver now facing charges and this is the day many people here in town thought would never come. almost exactly six months after an suv plowed through the front of a packed restaurant, the driver has been indicted. in early march when sweet tomatoes was filled with customers, this man came down the street and after sitting several cars his suv went right into the restaurant. he is now charged with two

homicide. a 32-year-old and a 57-year-old, two customers inside at the time were both killed. several others were hurt. people in newton wondered all summer if the driver would face charges. >> we were beginning to wonder because it's been so long. >> the middlesex county d.a. hasn't revealed what she believes happened inside that vehicle made him lose control. the third charge he's facing is operating to endanger. >> the facts ought to come out and if it's through the legal system, that's great. we knew when it occurred. we didn't know the circumstances and now presumably we'll learn that. >> as for the restaurant six months after the deadly crash it remains closed. just today as the indictment was announced, barriers were put in place on the sidewalk in front of sweet tomatoes and those who know the owners say it's been a long, difficult summer for everyone. >> we've tried to support the

there's been a lot of support. >> reporter: at this point no word on when the restaurant plans to reopen. as for that driver he will be arraigned in court, a date yet to be determined. >> tonight we're hearing from a brother of one of the victims who says his family is still struggling with the heartbreaking loss six months later. >> reporter: ryan, that victim was eleanor mele. she was here getting her loved ones description her as the spark of her family. >> it's been heart-breaking. we lost a piece of our heart that day. >> reporter: six months ago his beloved sister died when a car slammed into the restaurant where she was ordinarying a pizza. despite her untimely and tragic loss, they have never harbored

through this home. brandon gunnoe with the details. >> reporter: ryan, it was dangerous because the person living inside was in the process of moving out. so the firefighters said when they went in it was like an obstacle course of moving boxes. they finally got this fire under control but they had to battle hot spots for about eight hours. >> flames were shooting out of this home in hingeham. >> i was in my house, i heard a ma >> reporter: with the flames it was too dangerous to fight from inside. >> we had flame coming out three windows on the second floor so we had to go to an outside attack. >> they came running out and i was worried there was a gas leak or something and there was two big moving trucks and they left. and the fire trucks came. >> reporter: it started just after 2:00 at this three-family home. the woman on the top floor was

she wasn't urt h, thanks to the movers who made sure everyone got out safely. >> they got a report that they smelled smoke. they noticed dark smoke in the living room area. >> reporter: this firefighter suffered heat exhaustion and had to go to the hospital. >> this is her second day of moving out so she had a lot of stuff packed up and ready for that and we had to work around that and that made it difficult for the crews. >> reporter: now, the homeowner is staying with the neighbor up the street. she's okay, the cause of the fire is still under investigation but the chief said it appears to be an accident. we're live in hingham. >> traj zi hitting boston university an a freshman was hit and killed by a train. police say the driver of the next train stopped and called police. investigators do not suspect foul play. >> a woman in court today charged with drunk driving.

state police cruiser on route 193. she was released on bail and ordered not to drink alcohol and not to drive until her trial. police say she rear-ended a cruiser early tuesday morning sending a state trooper to the hospital with head and neck injuries and investigators say she blew nearly three times the legal limit when she was arrested. >> navy police are looking for this man caught on video stealing a car. police say the robbery happened around 3:00 in the morning on fray to call police. >> ryan lochte suspended after that night in rio for 10 months. the 12-time medalist lying about being robbed at gunpoint after a night of partying in brazil along with three of their teammates. the other swimmers are expected to be punished as well, but not as severely. >> just to get the season underway, especially jimmy

any good for us and slide away during the morning hours on friday. and speaking of friday, that's the hot ones where we start with clouds and developing sunshine, temps on friday close to 90. tomorrow upper 70s and low 80s and on friday we are all heading for the low 90s. the city around 91 friday afternoon. bedford 91 as well. likely to be our 21st day this year where the city reaches at least 90 degrees. it's been a while whereve also the humidity again. it does begin to fade away so by friday and more so toward the end of the weekend behind another weather system. it will be a second cool front that comes into new england and provides a chance of a couple of isolated showers. here's that weather system gaining strength but it falls apart as it moves through new england. there is a risk of an isolated shower on saturday morning and again i think on sunday morning, but neither day appears to have any significant rain, which of
