into his s.u.v. window. police didn't find a weapon on him or in his vehicle. he was waiting for help when police responded to a call from a person driving by. his family has called for the officer to be charged. now the officer didn't activate her darb cam so there is no footage of what happened before other officers arrived. john cuoco 7 news. >> ryan: the family of a plaque man shot and killed by police in north carolina expected to see the videof fire. his death prompted two days of violence in the city of charlotte. >> kim: state of emergency there and the national guard called in. brandon gunnoe joins us with more. >> reporter: we just heard from the family's attorney. they've not seen the video yet but they want to as soon as possible. they're calling for peace and justice. police have video of the deadly shooting of

the video will be shown to the victim's practice but not to released to the public. the video does not show scott pointing a gun at police. officers say he ignored commands to drop his weapon. witnesses say they never saw a gun. last night protests in the city turned violent. one person was shot by another protester now in critical condition. the governor issued a state of emergency. the national guard arrived. the white house said the issues of distrust between police and communities. >> if there are legitimate concerns, that have been raised about inequities in our criminal justice system. >> reporter: loretta lynch called for the violent protests to stop. >> we need your voice. we need your passion. we need your commitment. but i urge those responsible for bringing violence to
