s jennifer crompton is live at the scene with what we know about how the fire started. >> we are here where the fire started at about 2:30 this afternoon. as you mentioned, fire crews still on the scene. just moments ago they were pouring more water onto this, a little bit of smoke still showing but basically the upstairs is guided -- gutted from the top down into the house. the five-bedroom home sits on a hill at the top of a cul-de-sac. according to the chief, the nearest highways nearly a mile away so the water had to be brought in by tanker trucks from over a dozen communities. many still on scene at this hour. nearly 60 firefighters are here.

massachusetts law enforcement has been unable to serve him the court order, so the hearing is being rescheduled. he has not been charged with a crime. tom: boston marathon bomber dzhokar tsarnaev wants a new trial in a new location. tsarnaev did not attend the hearing at the federal courthouse in boston today. he remains locked up in a federal prison in colorado. wmur' s amy coveno was in the courtroom this morning and she joins us live in the studio with why the defense thinks their client should be acquitted. amy: the appeals process is frustrating to many people because we have a defendant whose attorneys first words to the jury were.' you have the right guy' . but in death penalty cases the appeals process is automatic and experts say will likely drag on for ten years. the defense team is relying on a 2013 supreme court decision. the so-called johnson clause mandates that ' crimes of violence' meet specific criteria of physical force.

: rocks estate in bethlehem is a popular holiday destination. but for dozens of volunteers it' s where they pack up the , holidays tree by tree. >> jingle bells, jingle bells, jingle all the way. >> as part of the trees for troops program these balsam and fraser firs will be delivered to military families in fort leonard, missouri. >> i really think that we forget how difficult it is being away at christmas. >> 450 trees from farms in vermont and new hampshire are sent down this assembly line made up of bethlehem 5th graders and combat veterans, are loaded onto the fedex truck and are being sent south today. >> it' s one of those things where we get a chance to give back. so it' s satisfying in that respect. it' s always good to work with the kids and the other folks that come out to volunteer for this. mike: in its 10th year the national program is bringing about 21,000 trees to service

tom: the ski conditions continue to improve at mountains across new hampshire. as of today loon mountain has eleven trails open. the mountain opened last wednesday and has been trying to open trails as quickly as possible. over the past few days the weather has been cold enough to make snow. they hope to have even more terrain ready to go and open by the weekend.

. things even better. a little bit of freezing rain in parts of northern and central new hampshire. we did see a little bit of sun early today at the coast. before clouds came in and s, only rising near 32 degrees during the late morning in early afternoon when a band of rain raced on through. part of it did race into portions of new hampshire. the icy threat does continue for a few more hours north and west of concord before he goes to primarily all rain. then it is a wet wednesday, up to an inch and spots between later tonight and tomorrow night but it will change over to snow on thursday and after that it quite' s down for several days. here'

advisory extended until 10:00. all of the upper valley and areas to the west of concord. temperatures are right near 32 degrees in a few spots so any untreated surface could be a little bit slick. the greatest concern should be the northeastern part of the lakes region and into the great north woods over the next few hours as temperatures there are right near 32. some mixing cannot be ruled out, temperatures right around 31 or 32 degrees and beginning to warm up a little bit in some of the higher terrain with readings -- in the mid-30' s. after this moves through, more wet weather down to the south and west has to move in. by then temperature should be well above using state wide. plymouth down to just northwest of concord right around that magic 32 degrees and it will

bands of rain move in from the south and west and into the day on wednesday. tomorrow afternoon into tomorrow night, before that moves off to the east and then the back edge rotates through up north on thursday when cold air moves in. that means a few inches of snow are not out of the question through the great north woods. at an inch of rain between now and tomorrow night. then the changeover to snow. we could see anywhere from 2-4 inches in many spots from pittsburgh all the way down into the heart of the white mountains with some of the highest elevations getting even a little bit more. occasional rain elsewhere, s and it could rise of it in some spots by morning. wet weather tomorrow, the steadiest in the afternoon and night.
