comey is under fire for making the disclosure 11 days before the election. >> how are the voters, how is the public supposed to respond to this? and there's simply no way for the public to make an informed judgment. >> in a letter addressed to the f.b.i. director sunday, democratic senator harry reid accused comey of partisan actions and alleged that he may have broken the law by violating the hatch act. it bans most federal and some other government employees from participating in political activities that cou hurt a partisan group or candidate in a partisan election. investigators seized the laptop belonging to long time clinton aide abadeen and estranged husband anthony weiner during a separate probe into weiner's alleged communication with an underaged girl. cbs news learned the f.b.i. deliberated over whether to disclose the information. officials debated whether they would be accused of trying to

hiding the information if criminal evidence was found. a person familiar with the process says officials ultimately concluded that the letter was the most credible approach after comey pledged to inform congress if anything new came up related to the investigation into clinton's use of the private e-mail server. >> we would certainly look at any new and substantial information. >> what the decision this week showed is even 11 days before an election, no one is above the law. >> law enforcement sources say the aide is seemed surprised that the e-mails were on the laptop. >> brian: because of the volume of e-mails, the review is expected to stretch past election day. >> tia: presidential nominee hillary clinton is returning right here to northeast ohio. she will speak this afternoon at kent state university urging young voters to get to the polls early. clinton will reportedly lay out her plans to create an economy that works for everyone.

instruct you are there. potential jurors being questioned in the cincinnati area for the murder trial of a white former police officer charged with killing an unarmed black man during a traffic stop. ray tinsing's attorney says the police officer feared for his life. the 26-year-old plead not guilty to charges of murder and voluntary manslaughter in the shooting of 43-year-old sam debose last year. >> tia: a man accused of hitting and killing a p israel logo jr. is accused of drag racing when he hit and killed a man in a wheelchair on west 25th street earlier this month. he fled the scene and tried to hide but turned himself in last week. a judge set bond at $1 # 00,000. -- at $100,000. a stark county man is facing charges for threatening trick or treaters. prosecutors say he showed parents of trick or treaters a gun and hit someone with his car yesterday. the 22-year-old is charged with menacing and assault.

go win-dians all the way. you can join the morning hot topic conversation on our facebook page. >> samantha: all right. time now 12:17 on this monday. it is halloween. but, nothing scary happening in the world of weather. at least for today. right? things have been very quiet. we are completely dry. you can see in our satellite imagery that we have a lot of cloud cover moving through the area but for the most part these are certainly fair-weather clouds. they aren't going to produce any rain for the rest of the afternoon and even into tonight. we should stay dry. here's your afternoon planner. if you have to get some candy, maybe you ate it all and you got to get more for the trick or treaters, guilty. speaking from experience here. then you are looking at quiet weather to get out there and do so. forget the umbrella. we are partly sunny for the rest of the afternoon. i'm going to go 55 at 1:00 hitting 58 at 3:00.

work today 5:00, 6:00. and things are going to start to drop. we will be in the low 50s for trick or treating. this is what the forecast looks like tonight if you are trying to figure out whether or not you should throw a coat on over your costume or over your child's costume. i don't think you need the big down parka or anything like that, you know. sometimes we got to throw those big puffy jackets on over top of the costumes. not this year. i'm going to go 54 at 6:00. really not bad. 8:00, though, a little cool. we will hit a me 51 at that point. then eventually bottoming out around 49 early tomorrow morning. tomorrow's forecast, this is our big weather story in the days ahead. a major warmup. and we talked about this a lot this morning how it would feel like fall today but the first day of november totally different. 50s in the morning. 70 midday and then an afternoon high in the mid 70s tomorrow. i do think we will get a little more sun tomorrow, as well.

anything happening in cleveland tomorrow night, right? yeah, there's a pretty big game. game six of the world series. and, this is what it looks like from a weather perspective. tomorrow night at 8:00, that is first pitch. i think we'll have a light south wind. 70. partly cloudy skies and then we will only drop to about 67 by the final out. so, by november standards, this is a very warm night. no rain for this one. i do not expect any weather-related issues. it's windy. we aren't going to be battling, you know, high wind and rain or anything like that. and if you are liking the warm weather, well, i'm thinking it's going to stick around all the way through wednesday. i did go 74 on wednesday. but as brian pointed out this morning, i only put one "c" on the seven day because i'm hoping that i will not have to give you a game seven forecast. hopefully we can knock it out tomorrow. take a look at that full seven-day thursday we do have a
