>> what does the a.c.l.u. do to make sure voters rights are protected overall? >> the a.c.l.u. are one of the nation's oldest civil rights and civil liberties organizations and nonpartisan organization devoted to protecting the constitutional rights of ohioans. year-round there's an uptick during election season and we are doing voter education and empowerment and of course what i am doing is a staff attorney a lot of the for voting rights litigation is a big part of our portfolio. >> what concerns are there about this election and being fair overall generally. >> i think the main concern is getting people out to vote and making sure everyone eligible to vote gets to do so and their vote is counted. >> we saw don champion's story and there are election observers.

have about voter intimidation potential there? >> sure. we put a press release out about this a few days ago you can find on our web site. as you mentioned, some candidates are encouraging votes to go out there and watch the polls. >> election poll observers are controlled by state law in ohio. actual election observers need to be appointed by the parties in the case of an group of people putting the issue up and they are carefully vetted and certified by the board of elections. only certain people are getting to officially do election observing. they are there to watch and not there to interfere and no one should be intimidating voters, recording or talking to voters as they cast their ballot. that's not the point of election observing. if that kind of thing is going on it is an issue.

we have learned recently, a record number of early voting in florida, what do you make of that? >> it is really interesting. the broward county and dade county and miami county heavily democratic areas and voter turnout exceeded expectations. in particular, the voter turnout and eased expectations with women and halt nos and young people. these are all constituencies that hillary clinton would generally say favor voting for her. huge blowout. president barack obama won by percentage points in 2012 and donald trump has had rallies there and the clinton campaign, looking at the swing states and feel more confident about florida than ohio and more confident than north carolina than florida. >> romona: why are they saying that in florida. there's an explosion of latino voting there and donald trump

because hispanics have been coming out. what does the clinton camp know that makes them feel like the clinton vote will go their way. >> in large part usually latino voters tend to vote democratic more than republican. romona, the bigger issue is this. nine times out of ten, if you are nonaffiliated or inconsisent voter, those people when they come out to vote they tend to vote more democratic. in a place like florida a ohio, swing states, there's only so many more voters you can squeeze out. people in ohio know their vote counts and high turnout in florida and if you are a first time new volter and ethnic minority you are more likely to vote democratic. that's the guess of the democrats now. that's why trump in the last couple of days going to michigan and minnesota thinks he can turn out more middle class white voters and thinks that's his
