>> developing news at 10 o'clock, will they strike? negotiations between septa and their largest union are going late into this night. the two sides trying to avoid a shutdown of buses, trolleys and subways. they have been hard at work throughout this day trying to craft a deal. good evening, i'm chris may. >> i'm jessica dean. "eyewitness news" reporter todd quinones is live in olde city where the negotiations continue right now. todd. >> reporter: and, jess today, just a couple moments ago congressman bob brady came out here to provide us an update and he says that right now signs are good that a deal is very likely. sources indicate septa and its largest union are "extremely close" in settling a contract dispute and averting a strike, a strike would leave nearly a million riders scrambling to find another way to get get to where they're going and idle 5,000 bus drivers subway operators and other workers.

rails would keep running. growth sides have been at the negotiation table friday in olde city. state senator anthony williams indicated there were little to no major sticking points left to hash out. >> i wouldn't say it's tense. i would say it's earnest. i would say that people are putting their best foot forward to reach to a successful conclusion. >> reporter: the union on monday promised 24 hours notice of any decision to strike indicating they would announce whether they would continue talking or strike on friday. major issues include contributions to the pension fund medical care and wages. but despite all these positive signs still at this hour no official word that an agreement has been reached. reporting live tonight in olde city, todd quinones for "eyewitness news" at 10:00 on the cw philly. >> all right, todd, thank you for the update. be sure to stay with "eyewitness news" for the latest on the septa contract talks. we'll bring you any new developments as they happen. the latest is always available at cbsphilly.com.

>> "eyewitness news" in fairmount tonight where it was a chilly halloween. and we've got our eye on some wet weather to start the weekend as well. meteorologist kathy orr is in the weather center with that first forecast. kathy. >> dry for now but not for long, chris. we are watching a cold storm system out through the midwest with rain and snow. this is moving toward the east. we'll get the cold component of this and some rain out of it as well. right now we're seeing some showers from a developing coastal system backing into the delaware valley so a few showers right now in the northern and western suburbs but nothing like we'll be seeing over the weekend. right now in philadelphia in trenton still holding onto 50, elsewhere in the 40's. going downton night into the 30's and 40's but this will not be the coldest we've seen this weekends by far. right now we're looking at a morning low of 45 in philadelphia, 40 in allentown and reading and 35 degrees in the poconos. coming up we're going to be talking about this weekend. very blustery, a stormy saturday not just rain but

also whipping winds. milder next week. so, it's not going to be all cold in the seven daily i'll be back with that a little baeder later on in the broadcast, chris. >> thank you very much. prosecutors will seek the death penalty for the suspected trooper killer eric frein. bruised and bloodied frein was arraigned at the pike county courthouse this morning. he was captured late yesterday. prosecutors charged him with first degree murder in the september 12th ambush in which corporal bryon dixon was shot and killed and trooper alex douglas was wounded. in court today frein was wearing the slain officers' handcuffs. frein has reportedly been answering questions but investigators won't say if he's made any kind of confession. >> the pennsylvania state police, the fbi and the atf will continue the investigation so we can build the best case in order to achieve justice on behalf corporal bryon dixon, trooper alex douglas and the pennsylvania state police family.

>> u.s. marshals continue to search for weapons in and around the abandoned air plan hangar where frein was found last night. he'll be held in the pike county correctional facility until his first preliminary hearing on november 12. people in monroe and pike counties who have lived through this manhunt say they're relieved it's over and tonight as our natasha brown found out, they're especially happy the kids can trick-or-treat. >> reporter: a collected sigh of relief from a community held hostage by fear for seven weeks. a crowd cheered and booed as eric frein was led into the courthouse friday to be charged with murder. >> it's just such a relief to finally be over and be done and know that, you know, they could go outside and play. >> reporter: some sense of normalcy came to neighborhoods hours after the manhunt ended. the police presence replaced on this halloween by the sight of children enjoying

trick-or-treating an activity that was set to be canceled. >> these kids have lived with this police presence and the concern of having a person that's on the run and wandered by law enforcement in amongst them in their community and now they can get back to normal. >> crying 'cause there's just joy, i mean, to know that they can go out plain and not have to worry. forget pow the trick-or-treating part, just that we're safe. >> reporter: halloween festivities are under way here at the crossings premium outlets with stores handing out dean trick-or-treaters but some parents say they had already planned for a night in had the manhunt still been under way. >> trick-or-treat. >> we were going stay home. i had battened stay home. they didn't even have an outfit. this is something i got today and she already had hers from last year because we were not coming out. >> reporter: while thoughts of corporal bryon dixon's death during the ambush at the blooming grove barracks linger this small community exhails in the comfort of knowing their safety is no longer at

risk. natasha brown, "eyewitness news" on the cw philly. >> just days after the explosion of a nasa rocket in virginia another rocket crashed, this one deadly. a virgin galactic rocket blew up scattering debris over the mojave desert. it was part of a test run for a commercial spacecraft. danielle nottingham has the latest. >> today was a tough day. the record of virgin galactic spaceship two is scattered across part of the mojave desert. it happened shortly after the space plane detached and fired up its rocket engine as it has successfully done in previous test flights. one pile will the was found dead inside the spacecraft. the other parachuted out and was seriously injured. >> the test community is very small and we are human and it hurts. >> reporter: marlene rulely

often watches the test flights is it this community is built around this industry. this is tragic. >> reporter: spaceship two took off from here. the aircraft was using a new fuel formulation that executives say had been tested and proven on the ground. the company's billionaire founder sir richard branson was hoping to ride on the first commercial flight. he tweeted thoughts with all virgin galactic. thanks for all your messages of support. virgin galactic is working with authorities to determine cause of the crash. danielle nottingham for "eyewitness news" on the cw philly dozens of people are without a place to call home after a two alarm apartment fire in west philadelphia. that fire broke out late last night on the 6200 block of chestnut street in cobbs creek. samantha bullard didn't believe it at first. in fact when officers came knocking, she didn't answer. >> and i mean, he kicked that door in and the whole door

went boom. when i came outside, the whole third floor was in flames. >> two people including a firefighter were hurt. the red cross is now assisting more than 60 displaced residents. no word yet on what caused that fire. >> well, a troubling act of vandalism has throwed a hate crimes investigation in delaware. last night someone spray painted a racial slur and a depiction of male genitals on james la may's drive way in new castle. james and his young daughter came home to find that graffiti last night. it's now been painted over but the sting of the word and the image still hurts. >> of course it's that fear of you don't know what's next, you know, why us. we're very friendly. >> police are searching for the vandals tonight. they're asking anyone with information to come forward. >> the nurse from maine fighting an ebola quarantine scores a legal victory. a judge issued an order today

>> it is of course halloween and some kids got a real treat along broad street and cecil b. moore avenue tonight. temple university and local businesses took part in the eighth annual avenue of treats. handing out candy to trick-or-treaters. the event is organized by beach community services. >> it's not just halloween, it is also time to fall back. this is the weekend when we set the clocks back one hour while many people welcome getting an extra hour of sleep british researchers say it's a bad idea for children. they looked at 23,000 kids ages five to 16 from nine

different countries including the u.s. scientists found when it gets dark early children are less active. >> there was about a 5 percent increase in the children's physical activity. >> the extra daylight could mean more minutes of running around every day. it may not sound like a lot but researchers say children only get about a half hour of vigorous activity every day so even a little bit could help. >> well, forget about black friday. that is forever a way. the holiday shopping season is starting earlier than ever this year. amazon is rolling out holiday deals starting tomorrow with discounts on high demand gifts like toys and electronics. same goes for office max and office depot. wal-mart will also offer more than 20,000 rollbacks or discounts on everything from groceries to toys. well, wal-mart is also considering matching online prices from competitors like amazon. the world's largest retailer started testing that strategy last month in five of its markets but there are ways to

make the most out of your holiday dollars. >> it is ghoulishly cool around the delaware valley and our eyewitness weather watchers are telling us that our eyewitness weather temperatures during the latter part of the evening. let's first start off right here where it's 50 degrees. ron says not much wind but good weather for trick-or-treating. through south jersey we go toward the shore in ocean view in tuckerton, timothy says 53 degrees. the storm is coming. it is, it's 65 like the calm before the storm mark says in chatsworth 49 degrees, before the storm mark says in 70 percent and we're looking at 48 degrees. doug reported seven minutes ago in vincentown the wind is very lighten says ghostly clouds are making for a spooky halloween night. if you would like to be an eyewitness weather watcher, we would love to have you join our team. just go to

cbsphilly.com/watchers to sign up and find more information on the program. cooling down but the clouds are helping us somewhat tonight. in center city philadelphia still looking at a mostly cloudy sky. the rain isn't here just yet. our live neighborhood network takes us to the site of beasley's game of the week bishop eustace prep in pennsauken. the team took the field and you can see the lights went on as night fell. we had half time, second half and just a little bit ago the field was cleared but the lights still on as the halloween festivities continue across the area. on storm scan3 still seeing some mainly dry conditions but see these showers backing into the region? that will continue during the late night hours and tomorrow those showers from the west will be moving in as well. you can see the cooler air trying to build in. 40's to the north and west. philadelphia, trenton in the 50's and some cooler air as well to the south and east. overnight lows will be chilly

but not this cold. this cold is going to wait until sunday morning and monday morning. that's when we really bottom out. but in places like cincinnati and even in wisconsin and in michigan, we saw snow. it's because of this, an area of low pressure in the upper levels of the atmosphere that is going to bring the cold. it's going to help energize a coastal low that's developing but it's only going to mean rain and wind for us. that's the good news. you can see some showers moving in tomorrow morning, so any sporting activities are in jeopardy. you could have some cancellations. in the evening more rain but then these two get together. this storm intensifies and for sunday we just see wind. it will be sunny but in wind will be whipping. down the shore we could have some wind advisories. so here's what you can expect. chilly with occasional rain for saturday. winds gusting to 25. late saturday night and into sunday the winds just get ferocious at times. winds gusting to 35 maybe even 40 miles an hour gusts. wind chills in the 30's sunday

>> sixers tonight in milwaukee and the game showcased two future nba stars, the sixers nerlens noel and this year's second overall pick jabari parker of the of the bucks. first quarter, nerlens with the ball in the paint. he grabbed six boards in the first half. parker showed off his game. here he is on the break finishes with the two handed.

wow. uh-oh. right now the sixers have the lead 62 to 60 in the third quarter. nate al schenn listed as questionable for sunday's game against the texans. he missed most of practice this week with that hamstring injury. the birds defense will be tested by aryan foster. second in the league in rushing. last sunday he ran for 151 yards and scored three touchdowns. >> he can run through tackles but he's also a really good receiver coming out of the back field and i think he does a great job compliment wag they do with him in the run game but also the passing game. big physical guy. you got to get a lot of guys around him. i don't think one guy is going to take him down. >> we'll get you ready for the showdown in houston on sunday. kickoff at 11:30ly i'll be joined by lesley van arsdale and the voice of the eagles merrill reese over on our sister station cbs3. the flyers with the night off. they are back on the ice tomorrow against the florida panthers. late last night they signed veteran free agent defenseman carlo and he joined the team

today. he's in the middle of a 12-year career, played great with saint louis last year. carlo adds depth to the injury depleted defense. >> maybe sometime next week hopefully tuesday but, you know, just a matter of getting a couple good skates in and get acclimated here with the guys, accustomed to the coaches, the style of play they want to play. >> after practice the flyers equipment manager was in the holiday spirit he taped a plastic snake inside the cooler and when the players reached in for a sports drink the fright night prank produced the desired effect.
