investigating his former mar-a-lago butler calling for the death of president obama. the trump campaign tells abc news the butler has not worked there for years and, quote, we totally and completely disavow the horrible statements made by him regarding the president. and in a vivid sign that republicans really are trying to unify, trump received a call yesterday from lindsey graham who had once said trump, quote, scares the hell out of me and is the most unprepared person he's ever meet to be commander in chief. after the 15-minute call last night trump tweeted, the two had a, quote, very interesting talk about national security. graham called it cordial and pleasant saying the campaign is over, he won. >> signs of progress for donald trump. okay, jon karl, thanks very much. mr. trump is standing by live. we'll talk to him in a minute. first that other big story. the change expected for the white house about transgender rights in the bathrooms of the

nation's public schools and abc's pierre thomas is following the story for us in washington this morning and, pierre, what is the administration to say? >> they're issuing a ler warning public schools across the country they should not discriminate against transgender children and be allowed to go to the rest room and locker room of the gender they identify with and sets the stage for a cultural debate with some civil rights leaders saying the rights of transgendered people must be respected and protected and with critics claiming that the obama administration is strong-arming local communities and issues like this should be left to the states. >> how does the administration enforce it? simply a recommendation or are there penalties? >> reporter: they do not have the force of law, simply recommendations but there is a looming threat that the administration can seek to strip federal funding from states that don't comply. robin, an intense debate is coming. >> that is fairly certain. >> let's engage.

donald trump, thanks for joining us. what do you think about directive from the administration on transgender rights? >> well, i believe it should be states rights and i think the state should make the decision. they're more capable of making the decision. i felt that from the beginning. >> so you're against this administration's directive? >> i just think it should be states' rights. i think many things should be states' rights but this is a perfect example. >> let us talk about that meeting you had with speaker ryan. positive signs and some reports many senators in your meeting with the republican senators suggested you tone down your message on immigration. are you going to do that? >> i don't think i toned it down. i want to have strong immigration. i want to have strong borders. some people agree with me and some don't but for the most part they agree. we have to have strong borders or we don't have a country so, no, i don't think i toned it down of i just got 16,500 border patrol people just endorsed me. first time they've ever done that in the history of the border patrol and, you know, i

don't think i've toned it down. i think we want to have strong borders but am certainly willing to listen to people with ideas. either we have a country or we don't. >> you won't modify your pentagons to get their support. they'll have to come to you? >> no, i don't think that. i think there's certain things we can talk about. i'm not totally inflexible on anything but i feel when it comes to the borders we have to have strong borders, absolutely >> let's talk about your tax return. under new pressure from the clinton campaign, secretary clinton talking about that the last couple of days. i just have a bottom line question for you. yes or no, do you believe voters have a right to see your tax returns before they make a final decision? >> i don't think they do. but i do say this, i will really gladly give them -- not going to learn anything but it's under routine audit. when the audit ends i'll present them. that should be before the election. i hope it's before the election. but when the audit ends i've had even journalists say that, no, nobody should give until audits are over and have had journalists say that so i think if there's no -- i sort of have

to laugh when clinton says it, mrs. clinton said i should give my tax returns. what about all the e-mails or missing goldman sachs speeches. very great hypocrite but as far as i'm concerned i want to give it as soon as possible, as soon as the audit gives, i've been under audit. every year -- i have wealthy friends that never get audited. >> as you know the audit is no excuse. the irs has made it very clear an audit is not a bar to public release. it is entirely your choice. president nixon released his tax returns even though he was under audit and when you were seeking a casino license in pennsylvania and new jersey, you released the returns to the state officials even though you were under audit. >> i am under audit now and as soon as the audit ends i'll release my returns. it's a simple thing. if you look at many others, many others feel the same way and almost every lawyer will tell you the same thing when you're under audit you finish the audit

before you release. i have no problem and it should be and i hope it's before the election. >> if you were willing -- >> by the way, people will learn nothing. i put in financials 100 pages worth of financials that show that i built a company that's worth more than $10 billion. it shows cash. it shows cash flows. it shows everything. you learn very little from tax returns but nevertheless, when the audit is complete, i will release. i have no problem with it. >> a couple of follow-ups to that. if you are willing to release your tax returns to get a casino license why shouldn't voters see them before they make you commander in chiefy. >> well, because at the time it didn't make any difference to me. now it does. if you take a look at the picture that we sent you with a tax returns probably ten feet high when you stack them on top and lengthy and complex and built a massive business and want to make sure that everything is perfect. it's a routine audit and get through it first and that's what i'll do. there have been many presidents that have not shown their tax returns. >> brian efianayebrian efianaye

won in the previous winter games but this morning explosive new claims about how they achieved that dominance. grigory rodchenkov, the former head of the russian anti-doping lab, tells "the new york times" that dozens of russian athletes including 15 of the 33 russian medal winners at those winter olympic games were part of a state-run doping program. a program planned for years to ensure dominance at the games. the lab director explaining he developed a three-drug cocktail of banned substances which he would mix with liquor. then with the help of russian intelligence services doping experts would replace urine samples in the supposed tamper proof international testing bottles and the international olympic committee calling the report very worrying. >> they are cheating like crazy. it's the gold medal for cheating. one of the worst stories we have seen in terms of cheating in olympic sports. >> reporter: a spokesman for vladimir putin calls the claims the slapdzer of a turncoat. two of the gold medalists a

new chance of freedom for owen labrie. the judge has now been ordered to revisit labrie's sentence and abc's gio benitez is in new hampshire with the details. good morning, gio. >> reporter: george, good morning to you. owen labrie right now is inside the jail behind me but if the state supreme court has its way he won't be there for long. owen labrie convicted of misdemeanor sexual assault against a 15-year-old girl while both were students at the prestigious saints paul's prep school in new hampshire. >> i was raped. >> reporter: in march after curfew violations a judge ruled labrie had to begin serving the one-year sentence he was appealing. throwing him behind bars, that's exactly what the state supreme court wants the judge to revisit. labrie has spent nearly two months in a new hampshire jail. the once harvard bound student recently moved to the general jail population after spending several weeks in solitary confinement >> that's an adjustment for him, but he's doing the best he can.

>> reporter: and now newly revealed court documents show that during the trial, owen labrie's defense team argued he was unfairly singled out alleging his roommate who took the stand against labrie -- >> i can't recall specifically -- >> reporter: also engaged in the senior salute where graduating students use the last few days of school to spend time with younger students. he was with a different underclass girl but he was never prosecuted. the judge not allowing those claims to be heard by the jury. that roommate's attorney telling abc news overnight these unfounded and untruthful allegations appear to be part of the defendant's ongoing and desperate trial strategy. and as for owen labrie, the tough talking trial judge doesn't have to release him. these are only recommendations by the state supreme court. it's entirely up to him, george. >> okay, gio, thanks. dan abrams, gio makes the point these are only recommendations but it is the supreme court. >> it is so interesting.

the court is sort of giving a wink and nod to the lower court and saying we're not telling you what to do but here's what we think you should do. and the court is basically saying two thing, number one, is that we think that you can create conditions of bail that will work. remember, bail is not intended to be punishment. it's intended to make sure he shows up. the supreme court is saying we think you can figure that out. number two and most interestingly, the court is sort of hinting we might even give him a new trial on these charges. they called it a nonfrivolous issue, this issue of not being able to cross-examine the roommate about this question. that's about as much of a hint as a high court can give to a lower court that we may overturn this. this is a nonfrivolous issue. in conjunction with the bail issue we're telling you, please reconsider although we're not telling you what to do. >> how would that play out say if the cross-examination were allowed. >> so they would get a new trial. and then they'd be able to cross-examine his roommate about

his own actions because really the claim is he did something just like what labrie is accused of. and they want to be able to undermine that roommate's credibility by asking him about this. the supreme court is basically saying, hmm, kind of surprised that the trial court didn't let that in, big deal. >> any consequences for the judge if he just ignores the supreme court's recommendations. >> nope, it wouldn't be ignored because the court specifically said, it's at your discretion so this is really now entirely in the trial court's hands to decide does he get released. remember, one of the key questions is, will he sit in jail throughout the course of his appeal? and the court is basically saying, look, we're talking about a 12-month sentence if you don't let him out now he may serve his entire time pending appeal which is another concern of the supreme court. >> dan abrams, thanks very much. >> coming up here on "gma," george, the freeway challenge. skateboarders going for a dangerous joyride on a highway. a new trend that could turn deadly. a major parenting alert.

back now with a dangerous new stunt gaining traction on california highways and on social media using #skateboard challenge hitting the road where one wrong move could turn deadly. matt gutman is in l.a. with the story. good morning, matt. >> reporter: hey, good morning, lara. anyone who spent time here in southern california has learned how painful the traffic can be, so to make the time pass, those skateboarders weave and slalom between cars sometimes hanging on to them and as we've learned it's a stunt with potentially disastrous consequences. trapped in l.a. gridlock board skateboarders have decided to hit the road. kick-starting a social media storm with this dangerous new trend. daredevils jump out of their cars and onto their boards,

friends filming those brazen stunts as they weave through or even slalom across l.a.'s grindingly slow freeways. then they post the videos with the #freewaychallenge. >> foolish and reckless and dangerous thing. i mean, that was my first reaction. why would anybody want to be on the freeway? >> reporter: what the police call reckless stunts aren't for amateurs. one shows professional skateboa skateboarder smith jumping on to the freeway and doing a flip between cars. >> doesn't look like he's about to cause himself or others harm. >> i can guarantee you that a car or motorcycle traveling at at least 20 to 25 miles per hour can significantly cause damage to you as a person or kill you. >> reporter: smith could not be reached for comment but on instagram, he urged other skateboarders not to hit the freeways writing this, #freeway challenge stuff is stupid and i seriously advise that no one tries it. still, many have and many have failed and even bicyclists

flipping and spinning their way down a clogged highway. but scenes like this are not the first examples of freeway horseplay. stunts like car surfing blew up on youtube last summer and while this may seem more dangerous than this, officers with the california highway patrol say a kick flip off the freeway has much bigger consequences than just crashing onto the concrete. >> they're out there on their skateboards and someone tries to avoid a collision with them and someone gets killed, that's manslaughter. >> now, police across southern california are on the lookout for anyone trying this stunt. but it's not a misdemeanor, it's not a felony, it's an infraction, meaning if caught, they can get a ticket though it is a hefty one, i'm told. it could top a few hundred buck organization the price of a very expensive skateboard. >> or they could get killed. i mean, thank you, matt. unbelievable. >> time to make that a full crime. >> absolutely. coming up, the moment

cardiac arrest during what was supposed to be a routine throat procedure. her daughter melissa filed a lawsuit claiming her personal doctor never should have performed that biopsy at a clinic. the suit also allegations doctored involved didn't notice her vital signs plumbing during the procedure and accuses one posing for a photo with her when she was unconscious. >> it caused her to have worse care. >> reporter: the 81-year-old died in september of 2014 following the routine elective throat procedure at this new york city medical clinic, not a hospital. in a statement her daughter melissa says i'm able to put the legal aspects of my mother's death behind me. >> melissa rivers is walking away with a settlement that is substantial but regarding the death of her mother, it's something that never should have happened. it didn't have to happen. >> reporter: for "good morning america," diane macedo, abc news, new york. >> our thanks to diane for that. and actress hayden panettiere is speaking out as she enters rehab for postpartum
