>> reporter: the winners of the men's marathon got their medals including american galen rupp who took home bronze. stealing the show, japan's prime minister paying homage to super mario. tokyo will host the next summer olympics in 2020. with the olympic flame extinguished, the rio games have come to a close. here is the medal count one final time. team usa crushing the competition. dominant in these games. 121 total medals. 46 golds way ahead of china, great britain and russia. this is the most medals for the u.s. in more than three decades. the most medals ever in a nonboycotted olympic games. you can see behind me.

them that everybody took off. >> probably still having a good time. thanks very much. there were other stories that came out of these games like the embarrassing incident that involved four american swimmers including ryan lochte that became a blemish on the games. he originally said that he and his teammates were robbed at gunpoint but surveillance video from a rio gas station paints a different picture. over the weekend we sat down with lochte exclusively to get his side of the story. in the bushes. the way it's been described to me is a metal framed poster of some kind or advertisementf some kind. and you just ripped it off the wall? >> yeah. and i have no idea -- i mean, i was very intoxicated. i have no idea why. it was immature. it was childish. >> it made a big noise. >> it made a big noise. and we continued to walk out and

doing things that a campaign does. they don't have the organization. some people doubt that he's trying to win. i don't know. >> reince priebus said by labor day this will be an even race. would you like to take that bet? >> i would like to take that bet but it's not labor day that counts. it's election day that counts and i think she'll be way ahead by then. >> on friday donald trump went to louisiana. you have family in baton rouge. >> a lot. >> it's a mess down there. he goes down there and looks at the damage firsthand and talks to people before president obama. it wasn't until after his visit that hillary clinton picked up governor there. did he appear more presidential in the wake of that tragedy than hillary clinton? >> i think the time line is that she and the governor spoke. the governor had said he would prefer that people come later because they have particularly the president come. i'm grateful that he came. he gave $100,000 t a church in the area. i'm sure the president is going to come on tuesday.

and all of that, they're not going to suffer from little confidence. that's one thing i'm not going to worry about. >> the book is called, "we're still right, they're still wrong." available on amazon and bookstores tomorrow. to new developments in the battle against zika we want to tell you about this morning. texas and louisiana could be the next states where the mosquito borne virus could spread. dr. anthony fauci from the national institutes of health says flooding in those states expanded the mosquito breeding grounds. he said zika will hang around in the u.s. for up to two years. infections traced to local mosquitos have been found in two parts of south florida including in miami beach. now to the severe weather impacting millions across the country. there were at least 16 reports of tornadoes over the weekend. most of them in ohio, indiana and michigan. emergency crews spent much of the day on sunday clearing trees and power lines that came down on roads there. tens of thousands of homes and businesses had power knocked out.

struggling to keep a raging wildfire there away from historic hearst castle. the so-called chimney fire has burned more than 27,000 acres and at one point was about two miles from the castle. farther south evacuation orders have been lifted after a massive fire destroyed more than 100 homes in san bernardino county. meanwhile, people in texas are cleaning up after a weekend of flash flooding. hard-hit louisiana, expecting more rain today. again, president obama will head there tomorrow. mr. roker, there's a lot going on. >> that's right and that rain that you were just talking about, it's still going to be coming down in parts of texas and louisiana, looking at more heavy rain and then it moves to the north. you can see heavy showers and thunderstorms firing up between corpus christi and san antonio. activity also firing up along the stationary front into louisiana and arkansas so lower

8:30 in the morning here we're going to get you back to the today show in moments. we're getting a update on the shooting of syville smith. >> let's go live to the wisconsin center. >> thank you for the opportunity to shed some light on where the investigation is in the case. i haven't had the opportunity to do yet that is express my sympathy to the family of mr. smith. no matter what the end result of this investigation, no matter what we determine are all of the facts of that day this was a terrible tragedy for his family to have lost a loved one. i also want to reflect on the residence of the sherman park neighborhood. the day after these events, and all through this difficult time,

their good character. the good people in that neighborhood far, far outnumber those who made the trouble. finally, i want to reflect on law enforcement. we will leave no stone unturned to get to the truth in this investigation. but like the people of sherman park, the vast, vast majority of law enforcement officers serve honorably with integrity and currently every day. for those hard-working public force is a traumatic act they hope to avoid when they go to work. i hope i join all of the voices that are urging calm in a peaceful response to the events. i'm also urging patience to give us the opportunity to complete and comprehensive investigation. a comprehensive search for the truth. today i'm here to talk about the

about the investigation and i will explain why in a moment. i will tell you now, we cannot and will not be discussing the information we have learned thus far except in very broad terms. the most common request has predictably been for the release of the videos of the body cameras. we will not be releasing those at this time. first, the body camera video is just one piece of information among many sources of information. they give only a incomplete glimpse of the overall picture. i can tell you now, viewing the body camera videos will not answer all of your questions. your questions will be better answered when the videos are viewed in the context of all of the information that is gathered in the investigation. more importantly, release of the videos would compromise the integrity of the investigation. as woe are searching for the -- as we are searching for the

to confront witnesses with information they didn't know or didn't know we knew. we are still collecting information, and we will have followup questions for some of the witnesses who are interviewed already. we do not want to create the worst case scenario, that the da determines the charges might be appropriate and then cannot complete a successful investigation because we let the investigation get compromised. we will not so the process, the investigation is ongoing and it is done only when the prosecutor is satisfied that the investigators have given them all we can. that means until a charging decision is final, there could always be followup. so where is the investigation at? all critical witnesses have been interviewed at least once. we have completed neighborhood canvass.

process significantly. we had to put our crime lab, forensic investigators in body armor in order tore them to -- for them to be able to collect evidence safely at the crime scene. agents from the division of criminal investigation could not initially move as freely as they would have liked and were delayed in collecting information. wisconsin state patrol assisted us greatly with their technical reconstruction unit that came in to help map and unfortunately they had to delay their response because it wasn't safe due to the unrest. since things have settled down progress has been good. we are reviewing training records of the officers. we're still gathering one more piece of audio visual material. we had 13 special agents who responded initially and this remains a top priority for the division of criminal

we have put less critical responsibilities on hold as we conduct this critically important investigation. we are following up on leads provided by the family of mr. smith, and other community members. we are piecing together detailed histories for both the officer and mr. smith to determine whether there is any preexisting relationship that may have impacted the events that day. we fully expect that once we gather all of the other information we're working will want to conduct additional interviews with witnesses. both those we have and some we may not have yet interviewed. therefore, releasing the video or other important investigative details will compromise our ability to be sure we are getting the truth. in the end, the public needs to have confidence that the process was an effective search for the truth. therefore, i must reiterate the call for patience.

but not rushed. we are following up on every lead and only when we are satisfied we have followed every lead to the end, will the entire case be turned over to the district attorney. now we have been coordinating closely with the district attorney all along and we are doing this to help make sure that when the case does come to his office, the transition will be as smooth as possible for the prosecutor so they have not been kept in the dark by any means. entire investigation ready to turn over. another question is that has come up that relates to what contact have we had with the family of mr. smith? we have stayed in contact with mr. smith's family. they have some mistrust with the system. that is understandable with the circumstances. it is my understanding that his body will be released so they can conduct their memorial

preliminary autopsy results have been shared with the family through the medical examiner. the family has not seen the video. this is the same circumstance as anyone. if we release this to anyone, those individuals could share the details of that and compromise the integrity of the investigation. when the time comes to release the video, the family of mr. smith will be the first that we share it with. the officers involved have also not been shown that determination is made in each case on a case by case instance. they have, there have been requests from officers to see the video, but we have determined the search for the truth in this case is better served by not showing them the video. all three officers who were initially at the scene have been interviewed at least once and we already have some additional questions we would like to

the crime lab still conducting its work. they are still working on dna examination of the firearm. they are also conducting a compair son through the national integrated ballistic information network to determine whether that gun had ever been used in any other criminal activity we can trace it to. this is all part of gathering as much historical data as possible. i expect the milwaukee police department is also its own internal investigation relate to go disciplinary matters, but i have no information regarding that. it is necessary under the law there be a strong fire wall between an internal discipline investigation and a criminal investigation because in an internal discipline investigation, those interviews are compelled either talk to us and answer our questions or be fired. in a criminal investigation, all interviews must be voluntary if we're ever to use them therefore

in the internal investigation. in terms of when the video will be released, it will be released after the district attorney is done with his final determination. if to charge is issued the release would be very prompt along with all of the reports. if there is prosecution that decision will be made by the district attorney and that will be based on an examination of what is necessary to ensure a fair trial for all involved. i do want tip line that has been set up is still open. we still are encouraging any members of the public who have any information that might assist us in getting to the truth in this matter, to reach out, go to the doj website and individual may enter information anonymously if they wish. they may identify themselves, but they don't have to and we are seeking any information anyone might have that will assist us in getting the truth.

>> the district attorney is going to have to make the determinations as to whether the officerses acted inreasonable or the officer acted in reasonable exercise of self-defense. the way the gun is positioned, a position of mr. smith, when the officer made his decision to discharge his weapon, all of those things are part of that important determination. mayor has stated i believe could compromise the integrity of that investigation. >> [indiscernible] >> if it were me, in charge of the division of criminal investigation, i wouldn't have released it because of the role i have. for the mayor he has a different role. he had a responsibility to do

safety and calm in the city and i think what he did was a reasonable decision to release a small piece of information oftentimes what triggers unrest after an officer involved use of force is information that the subject was or was not armed. in this situation, the mayor was able to provide that information. that limited statement i don't think harms our investi >> i would urge everyone to wait until all of the investigation is complete and with release all of the reports. you can see everything in context. again, i think, we're looking at individuals when you compare me to and my responsibility at the department of justice with the mayor and the police chief they had a different responsibility.

we are searching for the truth. they are trying to maintain calm. and peacefulness in their city. so i don't fault them for releasing the information they have released at this point, but i can tell you there is a great deal more that will come out when we're done. >> tt's been, that has been alleged largely by a family member of are following up on that lead at this point. >> [indiscernible] >> at this point we're not releasing any information that we have learned about that detail in the investigation. >> [indiscernible] >> the family has been cooperative. we have no difficulties with

to be in this situation. you know somewhere along the way there was a question asked by a member of the media and possibly several of them, is the family happy with the investigation? and the word happy has nothing to do with their life right now. there is nothing satisfactory about the situation they are in and no one would want to trade places with them. so, they any way they are just, they are very unhappy with the circumstances they face. >> [indiscernible] >> we are very close to gathering up and reviewing all of the information we will want to review. just in terms of looking back, we got the body camera videos

we were able to review them then, but it became useful to be able to slow them down a great deal. everything happens very quickly in it. that took some technological work. it took at least a day to be able to have that work done. we have additional audio visual materials like a dispatch recording that we are also doing similar work on and when we get all of that go back and talk to some of the witnesses again. >> [indiscernible] >> it inecessy to remain vague about those details at

that the district attorney will have to make in assessing the reasonableness of the officer's actions that day. so we're going to continue to be vague. it is information that will come out when all of the reports are released. >> [indiscernible] >> there were three officers who were at the scene very quickly yes. >> [indiscernible] >> correct. or at least, i don't think they had one at all. he did not. >> [indiscernible] >> yes that makes it more difficult. there was i believe it is a 30 second delay before the audio starts after the incident recording begins so, there is a period, there is a period at which there is no audio. that is difficult.

>> [indiscernible] >> when a law enforcement agency sets up their policy to for use of body cameras they make determinations as to how they are going to set that up. they made that decision. i don't have a comment on what, on how they made their decision. i just, have to work with what we have available. that's what we have. yes. >> [indiscernible] >> right. right. part of that, now part of that is already when he is in the vehicle. because it's when the officer initiating the traffic stop that the recording starts. so, part of that much of that 3t even exited his vehicle yet.

>> i'm concerned about answering that because i don't know for sure how they set it up. i just know what we have. i know that the video starts as the officer is still in the vehicle and then about 30 seconds later the audio also kicks in. in terms of how it was set up or why, i would be reluctant to speculate. >> [indiscernible] >> i think it's necessary to put it in context. the video, when a person is running with a video camera past them, it is not staying focused on what the officer, the individual or the officer is pursuing at all times. it moves very quickly. it's not easy to see everything until you slow it down a great

are happening very quickly it is necessary to know what the officer's reactions with the officers perceiving and more than just the narrow alley that you see from a video, but the officers seeing 180 degrees, he's got his peripheral vision. he has other concerns there is second individual there. all of those or factors that a body camera doesn't pick up are necessary parts of undan >> [indiscernible] >> yes when they set up their system this is what they put in place. >> [indiscernible] >> they may or may not i don't know the answer to that. >> [indiscernible]

when you say you have obviously talked to them, i have not personally. investigator yes, agents have interviewed all three of the officers. i don't, i don't know how to answer the question how this officer is doing. i don't know that information. >> [indiscernible] >> yes all three officers have been cooperative. >> [indiscernible] >> yeah, well, they perceive that there would be a short-term gain to releasing it now. i have to think in terms of the long range. and the long range is,o have an investigation and if a prosecution becomes part of the picture, a successful prosecution for the da and in

is done in a way that maintains the integrity of the information gathered. i cannot have witness statements being colored or tainted by information they are seeing from other sources. >> [indiscernible] >> we're working closely with the da.ul is the lead in any investigation. the da will decide what additional information we need to gather. we're taking a lot off the lead of the district attorney. in terms of the police chief and the mayor. obviously the police chief has this because this is the department's video. our hope is he won't release it and it is my expectations that he will do everything to cooperate with what we need to

comprehensive thorough investigation that gets to the truth as well as we can. i think the chief also recognizes that the question of a short-term gain verses the long-term end result is more torn to look at the long-term end result. >> [indiscernible] >> we are very optimistic that this will move much faster yes. >> [indiscernible] >> we've received some information that wasn't new it kind of duplicated some things we were already looking at. so thus far it hasn't been terribly fruitful, but we are following up on some leads that

point it is too soon to say whether those will ultimately result in anything useful. i want individuals who have information to feel that it is important to let us know that information. we will follow it up. we will take it seriously, until we're sure that there is nothing to it. we will follow it up. so if people have information we would like to know that.
