ordeal from his hospital bed. aaron burmeister had finished working the third shift at this speedway on hamilton avenue in mount healthy. as you can see in this surveillance video burmeister goes to turn his heater on in his car after noticing it was iced over. "i turned the car on to try and melt the ice and i went back into the store for just a second. i came out of the store and i saw a young man running toward my car going to get in" it's here from a different surveillance video angle that you can see burmeister heading for the door. "honestly i just acted instinctively. obviously i wish i hadn't. but the first thing that went through my head was how was i going to get to work if i don't have a car" more surveillance video outside the speedway captured the confrontation. "he got in and closed the door and i ran up to the door and tried to open it. he was already moving at

that's when he clipped me." burmeister suffered injuries, and a compression fracture in his left knee cap. and a wound only time may be able to fix, fear. "it scared me very much" burmeister says for the first month he won't be able to put pressure on his legs, and will be confined to a wheel chair for a month as well. and says he'll have to undergo at least one to two months of physical rehabilitation before he can return to work. burmeister has a message for supporters. "i appreciate all the support and the prayers that i've been getting and any help that they can to the go fund me page would be most appreciated." the money raised from the go fund me will help with medical expenses, along with supporting his two children. police are asking for the community's assistance in finding a silver 2004 chevrolet malibu with ohio plate

sticker and a broken rear taillight. reporting live frankie jupiter fox19 now a woman and her dogs are okay tonight... after going under a frigid, icy pond in today. butler county he has the latest. firefighters rescued the woman and her dogs inside this gated neighborhood off of liberty way. we spoke with a neighbor who called for help.

her friend survived. tonight... things are quiet again in this gated west chester community... and finally back to normal... mollie mihalik "over there in the water was a woman and her two dogs and she was up freezing water." this is what she saw when the cries for help brought what was going on. she immediately called 911 for help. climb up, the dogs to get out, too, and she woman was chasing a dog that got eventually she ran onto the ice and fell through. "i don't how she survived. i don't know there. i didn't see her until i heard her yelling." mihalik says quickly arrived for the daring rescue... that took several tries until finally and the dogs to dry land. "the third guy brought a ladder and laid it across the ice. they got her onto the rungs of somebody on the shore pulled the ladder and she slid across the ice." the dog owner went to the hospital... are just fine tonight.

alright. amazing." again... all is well that ends well. the woman and her dogs are okay... despite the fact that temperatures today were so cold... it appears all the rescue workers are okay as well. live in west chester... ben katko... fox19 now. a multi-million dollar settlement has been reached between the university of cincinnati and the family of a man who was shot and killed by a uc cop last summer... samuel dubose was shot and killed by uc police officer...ray tensing during a routine traffic stop on july 19th... tensing claimed it was self defense... and is now behind bard awaiting trial. the 5-point-3 million dollar settlement includes a 4-year educaton at uc for dubose's 12 children. 7raegan 'i'm really grateful for it. not only for myself but that my siblings could..you know. since i'm the one in college, i'm leading the way so hopefully they'll follow beind my footsteps and make something out of it." the settlement also calls for a

a growing call to boycot the oscars.. over a lack of diversity.. spike lee and jada pinkett smith both announced they will be boycotting the academy awards next month... because of the lack of diversity among the nominees. lee said this is the second year in a row that all 20 nominees for the actor categories are white. in a video posted to facebook - smith also said she would neither attend or watch at home due to the lack of color. begging for acknowlement, or even asking, diminishes dignity, diminishes power, and we are a dignified people. her husband, will smith, is one of the black actors who did not get nominated this year despite critical acclaim for his performance in "concussion" pinkett smith is not alone in her frustration... on social media - many have vented over the lack of oscar diversity. for the second

sewed the school and lost and now their appeal is set to be heard next month. the parents want their son's record cleared but according to these documents the school feels their in the right. although the st. gabriel consolidated school had refused to talk to us in previous attempts. new court records tell the story of why they felt suspending a student for staring at another student. the school's laywer filed this brief in appelate court which states: st. gabriel has a policy against intimidation. they say in the student handbook "suspensions or occur in cases of and it says one of "threatening or toward another parents argue their son who admits to the staring should

suspension. for one isolated incident there were no demerits on his record. and that's not justified according to the policy handbook the court documents also read the prinicpal in her decision took into account the school handbook, the 12-year-old's appology letter, their statement of events and an email from the victim's parents where the child said she was "very uncomfortable and fearful" from the staring. but there's one problem with the email. the tolbert's son's name is not on it. so you're going to tell me the 12 year old girl who was fearful, the mother's not going to get right who she is afraid of. so thats our biggest issue is that no one seems to be able to fill in the blanks the tolberts know the 12-year-old girl played the staring game with at least one but possibly two other students. they think those other students said their son started it, which is how he
