mr. hoyer: i'll take a minute. ladies and gentlemen of the house, i want to first of all thank mr. minnick. mr. minnick is an extraordinarily able member of this body and represents his district and our country well as a member of the congress of the united states. this amendment i think has brought up an important discussion on the perspectives that we all have. i am one of those that believes that previous administrations had two very deep failures. one was fiscal irresponsibility . we did not pay for what we bought. even at times when we said the economy was in good shape. we continued to borrow at record rates. taking a $5.6 trillion surplus and turning it into a $10 trillion deficit. the other major failure, i think, of the previous administration was regulartory impact. it had the power, as chairman frank has just pointed out, and in 1994 bill to intervene, to try to put a check on two things. number one, on subprime lending. it did not. mr. greenspan testified just a couple years ago that he thought that was a mistake. he thought people would not take risks beyond that which

mr. chairman, i want to thank the speaker, leader hoyer, chairman rangel for bringing this bill to the flooroday. the purpose of this bill is very straightforward. establish clarity and certainty in the tax road for the estate tax while exempting 99.7% of the estates in this country from this estate tax altogether. the estate tax has changed 10 times in the last 11 years. now, this has been a bonanza for the attorneys, the accountants, the planners, but it has been very unfortunate for the american people trying to make reasonable plans for their estates. the next two years become completely absurd when it comes to the estate tax thanks to a law passed by congress in 2001. estate tax repeal in 2010. replaced with a new capital gains tax that will impact many more farmers. in fact, for the 6,000 estates estimated to benefit from the tax change next year, 71,000 will find themselves with new tax obligations, this capital gains tax. additionally, come 2011 the repeal goes away. in this tax code they repeal the repeal. and we are back at $1 million level for estates, $2 million joint. 55% rate.
