i'm lynn berry. today we begin with a judicial tug of war. the military's don't ask, don't tell policy is essentially back in effect this morning after a federal appeals court in california suspended a judge's ruling that ordered the pentagon to allow openly gay troops to serve in the military. the three-judge panel sided with the obama administration and informed lawyers for gay rights activists that they have until monday to respond to last night's rulings. the judges will then decide whether to extend the temporary stay while it considers the government's appeal of a lower court ruling that found the controversial policy unconstitutional. still, it's not clear what affect this will have on the pentagon which has informed recruiters to allow openly gay service members. >>> with the mid-term election clock ticking and with two weeks left to go, president obama and the democrats are fighting to hold on to congress. tracie potts is in washington for us this morning with all the details. tracie, good m

nbc's lynn barry is live with all the details and with a good saturday morning to you, lynn, my friend. we'll talk about the respective on these numbers. >> the labor department's new figures mean there are now 14.8 million americans out of work. as you said, the rate holding at 9.6%. that's actually better than some people had anticipated. but consider this, the jobless rate has now topped 9.5% for 14 straight months. that's the longest stretch since the 1930s. now, keep in mind that's just unemployment. now, dig deeper and we find there are nearly 27 million americans that are underemployed. here's what that means, they have been forced to settle for part-time work but prefer a full-time job, or they have stopped looking for work altogether. take that consideration and the rate jumped to 17.1%. >> yeah, we don't want to go there. who is it, lynn, having luck out there in the job market and who is being left behind? >> we have the 95,000 total jobs lost, so we'll break that down. we have the private sector that actually gained 64,000 jobs, but that was the weakest showing since june.
