[laughter] our book was an attempt to provide intellectual content for the anti-washington fervor of the moment. it was a fervor that surges through american history. we chose the title of " the new promise of american life" because we believe that progressivism had been carried too far and what our country now needed was a reverse mirror image of the vision or less from washington and more of ourselves. our idea of america was one created by state's operating community-by community, depending on civic virtue, valuing individual liberty, in committees to large and too diverse to be managed by a central government in washington, d.c. my best political one minor at the time was "cut their pay and send them home." it r

hudson. his 42-page ruling is just out.e already got even some information out of the white house that suggests they are not too concerned about this ruling. they are saying at the white house that the case does not block this ruling does not block other provisions of the law. now the plaintiffs dispute that. the attorney general for the state of virginia, who filed this lawsuit, he and others say that is not the case, but the way the white house sees this, this is not the defeat that some others would have it be. again, get ready to argue healthcare all over again. this thing is likely to end up in the u.s. supreme court, and it's just one of many suits filed against the president's healthcare reform plans. once again judge henry hudson ruling that the individual mandate, the requirement that you have to buy health insurance is not in line with the requirements of the u.s. constitution. jenna: other big news around the country. take a look at some of the live pictures from carnation, washington where massive flooding is ca

and federal district court judge henry hudson agrees. he ruled that the mandate, quote, exceeds the constitutional boundaries of congressional power, unquote. mr. obama says, no big deal. rough issues always get a rough ride. >> that's the nature of these things. when social security was passed, there were all kinds of lawsuits. when the civil rights act was passed aned, there were all kinds of lawsuits. >> question is this case now on the bullet train to the supreme court, pat? >> certainly. frankly, i think it ought to be expedited, because it's going to the supreme court, it's a critical issue. cuccinelli has latched on to this one issue, john that individual mandate requiring people to buy something that they don't want to buy, and he said this is really outside the reel volume the constitution of the unitededtates. i think that's the strongest point. if this goes down on that point, i think the whole obamacare goes down, and i think cuccinelli stepped outside the group of other attorneys general to do this, john, and he is a former

hudson is an investor in campaign solutionses.hat virginia term's clients included several critics of obama health care law. cuccinelli among them. judge hudson, owned stock in campaign solutions for 13 years. it is valued at between 15,000 and $50,000. the company founder tells cnn hudson is a passive vfr with no knowledge or investment in the firm's daily business. is this a conflict? let's ask jeffrey toobin. are there clear rules? >> there are pretty clear rules, but this is not a conflict. you know, there's a tendency in washington to see everything as an ethics violation. hudson has no interest in this company. he was appointed to the bench because he's a conservative. they are ideological soul mates. that's not a secret, but it's also not a crime. there's nothing wrong with the fact that he owns stock in this company anymore. it was in his disclosure form. if the federal government thought it was a conflict, they could have moved to recuse him. they didn't because it's no big deal. >> you mentioned he's a bush appointee. he

judge hudson had no knowledge of the firm's day to day operations.porting to the firm's clients are some of the bill's biggest critics, senator john mccain, senator bachman. and alaska's half term governor. another client, ken cuccinelli of virginia paid $9,000 for services rendered this year. he also happens to be the attorney general of virginia, that's the man who would file the lawsuit that judge hudson happened to rule in favor of today. time now to call in the former chairman of the dnc, now a cnbc contributor former governor of vermont, howard dean. good evening, sir. >> thank you, keith. >> one judge says part of this law is unconstitutional, what are the implications? >> well, first of all, i have to note that the attorney general sent out a fund-raiser about two hours after the decision. >> of course. >> this is embarrassing for virginia. you know, you have a judge that's investing in an election thing, and the attorney general is clearly using this for fund-raising. it's kind of unfortunate for the state. so what does this mean? nothing. f

judge hudson, this is the first case brought by a state, virginia. the other cases were private sector folks that brought the action. he said that no, choosing to not participate in commerce, that's to not buy an insurance policy is not commerce. in fact, the fine that is enacted is a penalty, not a tax. so congress can't do it. i think judge hudson is right. i certainly hope he will be vindicated by the u.s. supreme court as this moves along. there is many other cases but this is the first one that got it right. >> chris: we'll get to the practical effects in a moment. judge hudson ruled against as we say a key provision of healthcare reform. and republicans are promising once they take control of the house, that they're going to do everything they can to block the implementation, spending for implementation of healthcare reform. given all of these different things, how much trouble is obamacare in right now? >> i think it's in a fair amount of trouble, but the big trouble right now honestly is for the governors in the states. chris, we have had pro

are you questioning judge henry hudson's credentials or his thinking on this?o you think this was a political ruling? >> no. we disagree with the result of the ruling, but we're not questioning anybody's politics or judgment in this. we disagree with it. >> if you disagree with it, what about governor mcdonald and other governors, we will be talking to him in a bit what about their request, suggestion, demand, if you will that this be fast tracked? that the solicitor general and the justice department send it directly to the supreme court so we can have clarity once and for all? >> andrea, we don't think that makes sense. the justice department will be getting back to the governor in short order. but we question the necessity of that, particularly because there are two other federal courts who ruled differently than judge hudson yesterday. even a judge in the governor's own state. so why is judge hudson's decision any more important than these two other federal judges? >> is it because you don't think the roberts court will uphold the health care and you don't

last week a decision by judge hudson was one of three that have gone to the merits and the other two ruled that the personal responsibility or individual responsibility requirement was in fact constitutional. this is one where the judge ruled it was not constitutional. these cases are just proceeding through the system. 14 of them have already been dismissed. >> brown: what is the constitutional argument that you think will overcome objections? the florida judge, for example, has not ruled but he did compare allowing the government to force people to buy insurance to forcing people to eat broccoli. >> well, he did. i think the lawyer representing the government pointed out that we're not talking about broccoli here. we're not talking about shoes. what we're talking about is ensuring that every american can purchase affordable insurance. if we want to be able to do that and to prohibit insurance companies from banning people who have pre-existing conditions, you know, who have been sick and making sure that everyone can get insurance, then we have to get everyone in the system. what w
