reporter: in the story presented here by the defense there are some unanswered questions like did cindy anthonys mother, know about this alleged drowning? later this morning the prosecution continues to lay out its case, one they say will indeed prove she's guilty of first-degree murder. matt? >> kerry sanders, thank you very much. linda kenny bodden worked on stacey anthony's team for years. savannah guthrie is our lead correspondent. linda, you did work on the case for about 22 months. the defense is saying it wasn't murder at all. this was an accident that caylee drowned in the family's swimming pool. did this defense surprise you at all? >> it didn't surprise me at all. i have been in the case. you know, matt, as early as 2008, october, before the body was found, people were saying that the child may have drowned in the pool because of the whole incident with the ladder. no one investigated, took water samples from the child's bones to see if she could have drowned. >> the defense says george, casey's father, found the little girl, found caylee, but they didn't say what happened in the six

they have cindy anthony saying the car smelled like death. >> in a recorded phone call. >> since it iso novel in terms of law you wonder if prosecutors get it in and it becomes an issue on appeal later for defense. >> the idea that the defense may say, wait, this was accidental death and casey was panicked over how her parents and everyone would react so she kept it a secret. in some ways you are admitting guilt that she had some involvement in the death. how do you explain the duct tape in an accidental death? >> risky strategy for the defense. the normal course would be to pick apart the prosecutor's evidence and say it's the prosecutors with the burden of proof here. to have her say it was an accident, number one, you're rite. it admits some level of culpability. maybe it's a strategy to avoid the death penalty, but it almost cries out for casey anthony to take the stand. who else can tell the story of this alleged accident and putting her on the stand ises risky for the defense. >> you can almost hear the prosecutor saying 31 days went by. here are pictures of this motherer partyin

seemed like the defense attorney, they were throwing a lot of people under the bus, george anthony, blaming cindysey's mother. do you think -- speak to just the fact, what's the point of throwing all of these peoplen the bus? >> what jose baez is trying to do here -- >> jose baez is casey anthony's attorney. >> absolutely. he's the defense attorney. by throwing all of this stuff out, it's what we call the kitchen sink approach. when you shoot a shotgun it scatters and everything hits the wall you need one thing to stick. you need one juror to believe something you say. i think he overpromised. i think he overshot here. it's one thing to say it's an accident. >> but further. >> okay, so then we progress and we say, not only was it an accident, but george is the one who discovered the body and came up with the idea of covering it up. if that wasn't enough, then we say, and everything casey did is george's fault because he molested her. but wait, wait, wait, not just him, lee also molested her. but if you doesn't buy any of that, the problem becomes that roy kronk, the meter reader was so criminally

in a bad corner. >> we've seen a lot of emotion, not just from the mother, from cindy, but we've also seen from casey anthonyll. what is this then do to the jury -- the jurors? how are they going to react given all the emotion that we've seen. this is the first time year suing a lot of emotion from casey. >> i think jurors are going to expect testimony ton emotional and they're not going to decide this case on sympathy. they're going to base it on evidence. the emotion goes to credibility. how much can you fake that kind of emotion? if the grandmother is lying and just, you know, really trying to help the grandfather not look like he had something to do with her death and cover it up, how can she really fake the tears? that's what the jury has to evaluate. do they believe her? is she sincere? is she credible? if she is, once again, mother is pitted against daughter in the fight to find out what's the truth about what happened to granddaughter. >> absolutely. and you're talking about this trial. they're saying it could go seven to eight weeks or in the first week here, what do you expect will happen next week

anthony throughout would clutch a bible and leaf through it. his face turned red and looked down and clenched. his wife, cindyher was holding a teddy bear i believe belonged to caylee, somehow having a piece of caylee with her during the trial. but the judge had ordered them, george, no emotion, no outbursts, no nothing because the defense wanted them thrown out of court and since they are the victims in this case, the judge insisted they be allowed in. they were not allowed to show any emotion at all. >> nancy, the parents did have to stay there so they had to be prepared for this at some level and the prosecution certainly was. >> well, you know, yeah. you know that someday bad things are going to happen to you but when they really happen, it's like a cement block to the head. they were upset. george anthony cried. and out of all of the people in this case, i have found him to be the most upstanding and this theory that he molested her, why would she leave her little 2-year-old child alone with a man that molested her at 8? and if he knew caylee was dead all this time, why go through all of the motions of t
