there is an underutilized building. we are perfectly happy with a building going in next door. we think the planning code is therefore a reason. we think that the setbacks are therefore a reason. if you are going to grant an exception. this is not a ministerial act. this is not by right. this is a discretionary process. there has to be a reason why this is an animating force behind why a property owner needs the exception and then you can analyze whether or not that is proper. what the developer has offered is that they said that we need this for a -- system. you can design this without the encroachment and still maintain a certification and the objectives of the project development. well, the project developers come back and in their submission, the only reason why they gave, this is referenced as a building designed. the only reason they have given why they does not work is that the current plans approved to not contain a dedicated -- which is required. well, putting aside the fact that the building is not conform to the planning code, that is not a reason. i would submit tha

there have been a real underutilization of workforce development strategies city- wide, citybuild, academies. if you could say bit about that. >> hello, everyone. i am from poder. i am also part of smac, students making a change. that is also in district 11. at poder, we're working with immigrant families. many times, these communities are left out of the conversation, conversations that includes affordable housing and jobs. as many of you know, driving in the state of california, you need a driver's license. in order to bget a driver's license, you have to prove that you are a legal resident of california. we are left out. we depend on cars and vehicles to make a living. it would greatly benefit our community, the immigrant community, if the city of san francisco extended that great theory that when you are stopped by a police you can call someone with a driver's license to pick up your car and take it to your destination. it would benefit us if they extend and that time period from 20 minutes to 45 minutes. sometimes that is not enough time to get to where we are at. i know times are tough

so you've got historical underutilized businesses that are outside of the 60 miles, they would be excluded under this provision from competing for that 40% because they are in an arbitrary 61 miles, 60 1/2, whatever the criteria, it is unstated in this amendment. so you can't do that. i understand folks don't like to compete. this morning at baseball practice for the republicans, we had a bunch of new guys out of the 1987 and the coach said, folks, all nine positions are up for competition. i'm number two in the deck chart, i'm not real happy about that but it spurred me to compete better for that position. competition works, it works for the big guys, it works for the little guys and to arbitrarily set a 60-mile perimeter around a military base and say everything has to be provided, 40% of it has to be provided for folks inside that is wrong headed and i oppose the amendment and reserve the balance of my time. the chair: the gentleman reserves the balance of his time. the gentleman from california. mr. garamendi: i'm shocked. absolutely shocked that my republican friend didn't stand firm
