daniel o'donnell is a key sponsor of the bill in the new york assembly, where the bill passed earliersie o'donnell's brother. brian brown is against the bill. you saw him in mary snow's piece just before the break, he's part of the national organization for marriage. mr. brown, we have already said you're against it. you have republicans who are supporting this new bill, are you worried? are you nervous about it? >> well, obviously it's crunch time right now, in 2009, we heard from the lead response sorry tom duane that the votes were there and the bill ended up being defeated 38-4. so the notion that this is a done deal is wrong. what we're doing right now, there are thousands of calls going in to senators. the legislature should not be deciding something as important as marriage. the voters of new york should have the same ability as every other state, this has been put to a vote, they have all said no, we know what marriage is, we know it's unique and special, and we do not want it redefined. >> you say the voter also decide. but this is -- this is a recent poll here. 58% of new yo

let's give daniel o'donnell a chance to talk here. daniel, what do you think?going to be gay pride in new york next weekend on sunday is the big parade. do you think that people will be celebrating then? >> absolutely, i'm confident with the governor's leadership, we're going to get this done. no one ever asked me in 2009 if it would pass. this time it's going to be passed and i'm proud of the process expanding the rights of new yorkers. >> there was a letter published by three of the greatest legal scholars of our time. robbie george at princeton and a number of other folks who support same-sex marriage. none of them deny that there are major unintended consequences of same-sex marriage. in illinois, we heard these same arguments. it's not going to affect anyone other than the couples getting maerds. in illinois right now, there are three lawsuits because the catholic church, its adoption agencies are being told they had have to shut down if they will not adopt children to same-sex couples. >> you don't look at this as a civil rights issue, right? >> it's not

for more on new york and beyond we're joined by daniel o'donnell, a democratic member of the new york state assembly. and maggie gallagher, co-founder and chair of the national organization for marriage, a group that lobbies around the country to keep marriage between a man and a woman. mr. o'donnell starting with you, two years ago this bill was rejected by a democrat-led majority senate. this time it passed through a republican-majority senate. what changed? >> many things have changed in the last two years. when i first got this bill passed in 2007, the polling on this subject was in the low 40s. the polling these days in new york is close to 60% of new yorkers support my right to equality. so we had a governor who was fully supportive and was willing to commit his political good will. we had money behind it. and we had coordination of all the groups that are in favor, worked very closely together. so all those things allowed the decision to be made by the leadership of the senate to put the bill on the floor. i have known for at least a month that the bill was put on the floor tha

last hour, i spoke to the lawmaker who led the marriage equality act to passage, daniel o'donnell. in the new york assembly. the brother of comedian rosie o'donnell. >> a lot of ways this was a perfect storm. when the assembly passed the bill, the polling numbers were at 38 or 40%. the polling numbers in new york are close to 60%. our previous governor was as committed as andrew cuomo was to the idea although he didn't have the political power and popularity that andrew cuomo did, so our governor was able to use that political power and support to help marshall this through. the third thing, all the disparate groups joined together and worked as a coordinated campaign. >> new york governor, andrew cuomo believes his state's actions could change the momentum for the gay rights movement on a national level. >> what this state said today brings this discussion of marriage equality to a new plane. that's the power and the beauty of new york. the other states look to new york for the progressive direction. what we said today is you look to new york once again. because new york made a pow
