o.c.c. director hings reports the view of recent activities, presentation of o.c.c.'s monthly comprehensive statistical reports for the period january 1, 2011 through april 30th, 2011 and january 1, 2010 through april 30, 2010. >> thank you, and welcome back drirktser hicks. >> good evening, president mazzucco and members of the commission, chief sir, it's good to be back. you have before you o.c.c.'s comprehensive statistical report for the period january 1 through april 30th of this year. and for comparison purposes, you also have the comprehensive statistical report for the same period last year. you also have pending case reports as of the same date. in april, 72 complaints were filed with the o.c.c. and through april 30, 2011, 260 complaints had been filed year to date. also as of april 30th, the o.c.c. closed 282 cases so we closed more cases than we opened and we had 403 pending cases. we sustained 21 cases or 7% of the cases we closed and as of april 30th, the o.c.c. conducted 26 mediations. in the same time last year, when we conducted seven mediations due to

where do you see the o.c.c.'s role in this and/or the police commission, particularly in the exercise of their 8.10 duties? >> as you said, a commissioner's assigned to the log of all police department activities with regard to the first amendment and since the director of o.c.c. works for the police commission, it seems that it would be a natural chain of command and flow there. commissioner chan: i think so. would you be amenable to amending the draft that would explicitly enable the -- and permit disclosure to the police commission and the o.c.c.? >> anything that makes the order more clear and ex plit and makes people more comfortable. as long as it's within the rules , i'm happy to do it. commissioner chan: do you have any idea what the budget outlays for the department have been with respect to funding or financing the department's participation in the jttf? as a fiscal matter? >> in my first 11 days it's alluded me. but i can find that information out, it's been a little busy. commissioner chan: out of fur

the o.c.c., i attached to my complaint some documents that i wanted them to read that would give them a background on the complaint that i was filing. the documents were predominantly freedom of information act requests i had made to the department of justice. the o.c.c. closed my complaint without interviewing me, and only interviewed me after i pressed them to do so. they ruled information only, which is a foggy finding and they still would not give me definition of what they meant by that. during the course of the investigation, i told them about the three detentions i suffered at the hands of the san francisco police department and they claim they can only find one. so they would not investigate where the others -- what happened to the other two, and i find that kind of as a signal of the quality of the investigation that was conducted. you know, finally tonight i want to say, if you knowingly and willingly engage in a malicious conspiracy against an individual and if that's a result of that

today i stopped by the o.c.c.'s office and i requested to see if they had clarification for me and they gave me this, which is basically just copies of all of the forms i had filled out and stuff like that. so i'm here again empty handed. i just want to say for the record i'm done. i wash my hands from them and i'm going to move forward, try to resolve this on my own. there's something i need to make very clear here. back when all of this started, when i was trying to find out who was harassing me and why they were doing it, there was an individual -- >> quiet. quiet. >> there was an individual for the sake of privacy i will call mr. x. i felt he had information that could help me resolve the matter and put the pieces of the puzzle together. not long of a started contacting him and pressing him for information, i received a call from the san francisco police department telling me that if i ever contacted him again, they would arrest me. they did not want to hear anything about what i had to say about what was going

i want to compliment director hicks from the o.c.c. on the mediation program. the mediation program work vezz well 6789 just as the director said, even though what the officer $was proper conduct, they get better perspective of citizens city. i want to help with the workload, which isy was here last week. last week i brought up a couple different issues that we don't think should be o.c.c. complaints, thereby freeing your investigators up to do other things, maybe more eedations. but what i would like to do with the blessing of the commission is maybe have someone from the chief's off, p.o.a., someone from the commission -- i know you're always busy but this wouldn't take very long, meet with members of the o.c.c. to see if there's common ground so just because a police officer fails to issue a form, that's not a complaint. if the police officer writes a report and the computer generates the wrong code number, that is not a citizen complaint. neither of those require interviewing or any time and police chief to deal with. we can fix that in a much better fashio

the o.c.c., a regulator in washington, actually sued attorneys general to prevent them from being ablepursue predatory that the actions against dubious lenders in their own states. it was really an important moment that we described in the book. is a call from maryland. dennis is a democrat there. caller: good morning. how were you? i am very much confused as where blame should really go. clinton had a very good idea in terms of being able to increase homeownership in the united states. this was a very good concept. but you should remember carefully that once he put forth that program or concept, the republicans in congress and senate, they put forth regulations. secondly, between 2001 and 2008, when the crisis really was created, george bush was reluctant with regulations. they deliberately allowed the corporations to run well, because they refuse to enforce the regulations, even those that were on the books. to blame the democrats and say the democrats were at fault, clinton was not at fault. he had a good concept. guest: i think the concept was ok, but the execution was terrible. i

the o.c.c. has done exactly the same thing. state bank commissionerrers across this country have done the same thing. and i know we have the -- the presiding officer is from minnesota fnlt i know he flies here to washington probably each week. the way the language is now written, it would be as if the presiding officer got on a flight from minneapolis to fly to washington, the seats were mostly full, but a standby passengers-on-got on the plane at the last minute, sat down in an empty seat, and the airline was forced to charge everybody that flew on their airline only the cost of what that one additional passenger -- half the trip was going to take place -- what that one additional passenger cost the airline to travel from minneapolis to washington. obviously that cost is almost negligible because, you know, all the reservations, the flight has been fueled, the flight attendants are there the pilots are there, all of those costs are already dl. we wilwell, that's the way the n amendment now reads. that's the way the law now is,

the o.c.c. has come in and said it won't work. market forces will take over. this will not work. they're going to get crushed. the state bank commissioners have come in and said the durbin amendment as written is going to be disastrous to consumers. it's going to be disastrous to the smaller institutions with which we all deal. so look, i'm not trying to carry water for either side. i'm trying to come up with a solution that's fair. i have worked with senator tester, senator crapo, senator hagan, senator bennet, senator brown, numbers of people to try to come up with language that hits that sweet spot. and the senator from illinois is right. we probably never developed a perfect law, but i think we have a responsibility when we know that something is about to happen that won't work, that is going to be devastateing. i think we have an obligation to try to come up with something that meets the test of trying to be fair to both sides, and i think that's what this amendment does. you know, the senator talked about all kinds of things being added in. the banks can't just add it in. th
