[ crying ] >> they're brothers. they're close. >> reporter: but now one of the brothers, brian wong of berkeley, is missing. that's why the three remaining wong brothers have decided not to come home with the rest of the survivors today. brian's wife elsie is beside herself. >> they told me that they're going to stay there and wait for brian. >> reporter: elsie says her husband was asleep as were the rest of the passengers of the erik early sunday morning when a violent storm suddenly sank the boat. 19 men including gary craig and glen wong swam for more than 15 hours. while the water was treacherous, it has since calmed and there are many islands around. fishermen tell the family that others have been rescued in the area in the past after being stranded for days. t

but joe vazquez reports witnesses tell a very different story. joe, now i understand we have some pretty graphic cell phone video of this entire incident. >> reporter: julia, we are only going to show a very short snipet of that video. too gorery to show on television. the man who sheet the video said he captured the last two shots fired by police officers then the video, the part you won't see goes on to show this man who was shot laying on the sidewalk bleeding profusely while he waited for help. listen closely and you can hear two pops. dixon said he turned his camera on just after the first firing. >> by the time you saw the officers get in front of us he gave the last two shots while he was already down. >> nine shots total? >> yes, seven to nine shots. >> reporter: it happened in front of dozens of witnesses. a man shot by at least two officers. several people tell cbs5 the man was running from police and they shot him from behind. >> it all started behind a transfer. the young man did not have his amount to pay his fare. it started off with

joe vazquez from the medical examiner's office with the new findings tonight. >> reporter: the medical examiner laid out the forensic evidence. they say of the 10 gunshots that were fired saturday, one hit kenneth harding in the leg. that came from police. the other went through his neck, hit his head, that they say came from harding himself. >> we believe that the fatal wound on mr. harding's body was self-inflicted. >> reporter: a surprising new finding that the suspect shot by police on saturday afternoon apparently killed himself, that's according to forensic evidence released from the medical examiner's office. >> there is one gunshot wound which enters and exits his left leg, there is a second gunshot wound that enters the right side of his neck and was retained in his head. the bullet which was removed from his head is not consistent with the service ammunition used by the san francisco police department. >> reporter: given the new evidence, police believe harding somehow shot himself in the head with his .380 handgun. maybe it was a suicide. maybe it was an accidental shooting

joe vazquez reports that the witnesses tell a different story. >> reporter: julia, we are trying to sort that out. witnesses heard 7 of 8 shots as officers opened fire on a man trying to jump a train fare. >> reporter: it was in front of dozens of people. the man was running from police, and they shot him from behind. >> they shot him there behind in his neck and leg and they just left him. >> reporter: two officers signed to the silence reduction were completing a fair instruction. for some reason the man took off running. that the point we fire the department fired backwards at the officers. the officers returned fire in self-defense. >> reporter: the man later died at the hospital. the witnesses are so furious, they loudly shouted down on the news conference. >> they are telling lies. >> the investigation is ongoing. my homicide, internal affairs investigation. >> i don't think he got on his knees. >> hey, hey, hey. >> reporter: did he fire at police. >> several neighbors say it wasn't the case, so was a weapon ever recovered? >> reporter: have you found his weapon? >> i don't have an

joe vazquez shows us it's about to get harder to get things done in san francisco court. joe. >> reporter: elizabeth, the mood here at 400 mcallister is somber right now as courthouse employees are told there will be 200 layoffs, they are just not sure who. about half the courtrooms are shut down. >> we're behind. >> reporter: if you think your line at the clerk's office is long now, just wait. courthouse officials say they have stayed it off for the at last three years -- staved it off for the last year years but budget cuts forced the inevitable. >> we are on the verge of to severely downsize the court. >> reporter: the court officer says come monday, layoff notices will be mailed out to some 200 state workers at san francisco courthouses. 25 of the 63 courtrooms will be shut down. >> this is actually somebody's work area. >> reporter: the stacks and stacks and stacks of paperwork will get higher. >> you may have to wait four or five hours to file your law. don't expect to go back to your office. you'll be spending the day here. >> reporter: civil courts will be hit more

joe vazquez reports, this is not the first time a ucsf shuttle has been involved in a deadly crash. joe. >> reporter: in fact, it's the second time over the last year, ken. four passengers as well as the driver of that shuttle bus were brought here to san francisco general hospital. they are going to be okay. the one man who died ironically was a doctor on his way to work. he is a doctor of psychiatry who was working in the emergency room. nobody is saying exactly what caused the wreck. but one san francisco police official tells me clearly someone ran a red light. a ucsf shuttle was going eastbound on oak. a big rig carrying cars was northbound on octavia. they crashed around 6:20. the truck driver was identified by his company. he reported that he had a green light and the bus came out of no. >> reporter: this goes on all the time. to be a pedestrian in this area or driving is dangerous. >> reporter: 52-year-old dr. kevin mack was killed after he was thrown out the window of the shuttle and landed underneath the big rig. dr. mack was a psychiatrist at sf general hospital. >> the pa

joe vazquez is in san diego that is helping the navy. >> this is supposed to be fun, the annual fishing expedition down to mexico. instead it turned into an international rescue effort. the coast guard helicopter arrived back here at the base at san diego. earlier today, the max can government talked about calling off the rescue and shift ting to a recovery mission. now they are back to calling it a rescue effort after a long time with american officials as they believe there's a chance the missing may still be alive. their skin is scorched, their bodies exhausted. these photos show the survivors. they had just spent more than 15 hours in the water clinging to life vests and even coolers. most, but not all, made it back to land. the mexican navy requested help from u.s. coast guard helicopters based in san diego to search for the missing. >> they conducted their search until the first crew reached their limits. the second crew was flown out to meet them and then they got in the same helicopter and the second crew took that helicopter down and conducted their search and presently they ar
