was that in the berman case? was that in hawaii thousand housing authority? where did that happen? >> as far as back as the 19th century some people made that argument in some state courts albeit minority at that time, held that under their state constitutions but the federal supreme court did not adopt that as an interpretation of the public use clause of the fifth amendment until the berman versus parker case in 1954. there will were cases in the early 20th century and late 19th century which also were fairly differentialal to eminent domain but if you look at those cases as i did in great detail in one of my articles, none of those cases actually address the public use clause of the fifth amendment. rather those cases were heard during a period when the supreme court had not yet taken the view that the bill of rights was incorporated against the states. so therefore the only way to challenge a state taking in a federal court was under the due process clause of the fifth, i'm sorry of the 14th amendment and under that clause the supreme court applied a fairly deferential approach

joining us now dennis berman the "wall street journal"'s deputy bureau chief. let me ask you a few simple questions to see if there is a link. are we in a credit crisis right now? >> we are not in a credit crisis here in america. the banks are pretty well capitalized. american companies have about a trillion dollars of cash. they were scared from 2008 so they reacted. the real question is europe. all the debts over the years are getting pushed up into the country levels. jenna: that sounds like deja vu. a banking crisis is my next question. these are some of the issues we saw in 2008. is a banking crisis happening in europe? >> in some ways it might be even worse than a banking crisis and that's how the markets are responding. the question is can governments support their debts? what you've seen, some of your viewers have heard about portugal and ireland, country like that, the real heart of europe is under question, do these countries have enough wherewithal to payoff their debts. jenna: the countries and the companies are very closely linked in europe. if we

country's credit rating s&p, and joining me is the country's foremost professor of economics leonard bermanand now you say that we heard the president allude to this might be a blessing in the disguise and put some urgency behind lawmakers in an effort to do something about the economy and come to a compromise and why do you believe it is a blessing in disguise? >> well, it is a wake-up call. we are not at the point at which we are going to have a debt crisis, and we clearly could repay the debt, and even if it got larger, but if we continue the current policies, 5 or 10 or 15 years down the road, we could be in a situation where a downgrade could cause upward spiral in interest rates that would sink the economy. the blessing in disguise is that this is showing us and giving a harbinger of what is to come and suggesting to the president that it is time to take charge. and take the hard decisions that will be necessary to get the debt under control and also to do the things to get the economy out of the recession in the short term. it is not easy, but it is creating urgency for it. >> it is

some felt that was a threatening comment, not a respectful comment of the fed and of ben berman key in particular. >> well, i might have said it a little bit differently. listen, governor perry's just brand new in the race. i know he wants to make an impact quickly. and i think focussing on the fiscal policies of this administration that have us $14 trillion in debt heading towards over $20 and having no coherent strategy for a budget that's going to get us out of this $1.5 trillion deficit a year i think is governor perry's broader point. everybody's got to focus on the issues they think are important for america and getting us out of debt is the biggest issue of this campaign. >> the other thing he suggested was that in some ways the president might not love america when asked are you saying with his comments about wanting to be the kind of commander in chief that the military would respect, are you suggesting that the president doesn't love america? he said you'll have to ask him. some people took offense at that. in fact, mitt romney was asked about that, he said he wouldn't say th

in 1986, senators grassley and berman added an incentive and asked a whistle-blower is to bring morelaims for, and if they did and there was a successful return of government funds, they would get a small percentage. after that, every year, we have averaged about $1 billion in returns. last year it was $3 billion. carolyn mention that studies have shown over and over again that was always -- that whistleblowers are incredibly effective. some 5000 corporations world wide showed that whistle- blowers cashmore internal fraud and law enforcement, officers and compliance officers combined. surely you will hear from kristin, -- shortly, you will hear from kristin, was fought waste of taxpayer dollars, but there are other examples. the national taxpayers union strongly supports a whistle- blower protection, along with other ngo's from across the ideological spectrum. it is also why we are very dismayed that right now, the proposed budget for fiscal year 2012 has a nonsensical proposed cut of about $2 million for the office of special counsel. we think that is the wrong way to begin to heal
