fox news alert as we near high noon on fox news. we take you out to illinois to an air force base. a suspicious package online a base. three people had to be taken to a hospital and a dozen others had to be decontaminated. the base is on stand by. what we november the package is limited. the package was in the mail building. what that situation is and the details of it we do not know at this time. the mail building along with four or five other buildings are closed and evacuated. there is an announcement going out over the loudspeaker on the base warning folks to stay away from the post office and the west side of the base. so a developing situation. you have a suspicious package, three people sent to the hospital, a dozen others that are apparently having to go through some sort of decontamination. as we hear more from the scott air force base we will bring you those developments. we'll keep you up to date on that breaking news everybody. we're so glad you are with us i'm jenna lee. gregg: i'm greg jarrett in for jon lee. a brand-new hour. jenna: we have new flood dangers that are really affecting the east coast as the east coast tries to recover from hurricane irene. you have vermont days after irene slammed the state where national -- i should say national guard ground crews are still trying to reach one town completely cut off by the floodwaters. people there have no food, no water no powers. much needed supplies are being airlifted into the state. gregg: the connecticut river cresting to the highest level in 20 years. 370 folks are still in the dark. jenna: in new jersey the passack river rising dangerous rehigh forcing a new round of evacuations and rescues in patterson, that's the state's third largest city. another of the hardest hit towns is little falls. joining us on the phone is lieutenant salvatore recalifurri, second in command at the police department. what is the lathess and where do you stand right now. >> right now we are still at extreme flood stage. our latest reading at the passack river gauge is 10.7 inches. we are still at least a foot higher than what we were in the springtime. we still have quite a ways to go as the water recedes. the water is receding, it's receding slowly but it is receding. we still have about 500 homes affected or more possibly affected by this flood. jenna: you say one of the most challenging things right now is just keeping people away. why is that such an issue for you right now? >> is just makes the relief efforts that much easier. as onlookers come, as traffic goes by, it just makes the relief effort that much more difficult for us. jenna: i'm sure people are anxious to get back to their homes when they start seeing a little bit of improvement. >> they can't wait to get back to their homes. jenna: we can all understand that. lieutenant have you ever seen anything like this in your time with the police department. >> not this bad. this is our 7th flood in seven years -- no, 6th flood in seven years, and this is the worst its been since 1903. jenna: what's the game plan? over the next couple of days what are you trying to achieve? >> over the next couple of days we want to maintain saourt in our area. we just want to assist the people however they need to be assisted, and we want to keep -- our biggest concern is keeping our residents safe. jenna: lieutenant, what do you think of the response so far? governor chris christie has been out in front really talking about the damage to the state. you have the department of homeland security secretary visiting the state, overall on a local level, how do you feel about the response? fox news digital fox news editor and the host on foxnews.com live. are you picking a winner, chris? >> reporter: the winner of course is people who love america if you're at the iowa state fair today, because they love america and it is awesome out here, jon. the winner of the actual debate last night just in terms of how you score the round, maybe it's bachmann, maybe it's pawlenty, maybe it's gingrich, but the winner of the debate overall in terms of how it changes the election and what it effect has going forward is pretty obviously mitt romney. he looked good, he stayed cool. he put jabs back when people came after him without seeming to get down in the mud. it was a technical and tactical win for mitt romney. a good rer form answer and just what we needed. jon: our presented today sesers were opening up the question to viewers. it is an unscientific poll obviously, but 50% of their people who responded say newt gingrich won. >> reporter: well, look he gave, in terms of what we've seen from speaker gingrich he delivered what people have been expecting from i'm all along, a tart tongue, a focus on policy, a brashness, a confrontationalness that he's none for that we haven't seen from him because his campaign has been so beleaguered by the problems on the trail and with his organization. people got to see a glimpse of the real newt last night. they loved it. i will stand up for chris wallace right now and say that was a totally legit question. what he was talking about was basically this. if you can't run your campaign, if you're having trouble running your campaign how do you run the executive branch of the federal government? would you bring those troops home to unemployment. very specific questions about that. another viewer is expressing concern about how much money you'd save and how would you do it without spending money to end the wars and where would you put the cash, so on and so forth. that that really is a theme, jon of people on the live chat. a lot of them are saying they didn't hear enough talk for their flavor about the war and ron paul had the only real angle on this in the debate last night. go to america's asking and we will include your voice in all of these. ron paul coming up in a little while. some of you are getting very detailed and very focused on your questions. jon: harris faulkner thank you. jenna: the economy was the major theme of the debate last night and certainly this week proved the point that it's still very much in the forefront of our minds. a wild ride on wall street triggering major whiplash for all of us, stocks moving up or down by hundreds of points each day. we have the founder of imperial wealth management. kimberly, let me share a story with you that i think many americans probably experienced this week. one of my friends said to me, i just checked my 401k, i lost thousands of dollars and i said, don't check your 401k, what do you doing check being it during such a volatile week? i thought about it, maybe i gave her bad advice. should we be checking our 401k, our allocations, is this a good time to do it. >> it's such a volatile market. professionals don't even know which way to go. everybody was taken off guard. you've got to be in the game in order to win the game. i tell my clients this week, basically allocation is the first and foremost important attribute of your portfolio, houp to stocks and how much to bonds. 90% of the variability or noise going up and down tells you the performance in the long term. how much do you want to stocks, how much to bonds. you might have 30% to bonds or 70% some stocks. if you're older you may have like only maybe 20% to the stock market. jenna: age is something important when you're thinking about financial planning. >> it is. jenna: the volatility is something that regardless of your age is tough to watch. how long do you expect -- how long do you expect this to last. do you think it will repeat next week? >> i think that volatility is the new normal. i hate to say it. you better get used to this. this is going to be the new normal. we don't have a lot of certainty in regard to what is going on on a geo political front or the united states front, and we have the super committee of 12 now, they are going to try and solve this budget issue, so we've got a lot of uncertainty, and of course the market doesn't like uncertainty. if you have a hundred thousand dollars in your portfolio and you're up 50% one year and down 50% the next year your rate of return goes from a hundred thousand to 75. if you're only up say 10% one year and 10% down the next year you're at $99,000. that volatility tells you what your rate of return is going to be for the long term. that is really important to be able to be able to have the allocation to go through these ups and downs in the market. jenna: it would be nice to have a million dollars in any t fund. there is one question we should be asking, whether it's ourselves if we're in control of our own retirement or a savings fund or a question we should mow tension alley be asking a financial planner. what is the one thing you see people missing when you talk to them about how they are planning their own finances? >> i think people are scared. and if you're scared have the allocation. if you can't say emotionally in the market have an investment adviser. ask them basically what is the allocation of my portfolio, and if it's too volatile pare that down a bit for the long term. the bottom line is you have to be in the market to win the game, and in the long run we're going to get through this, jenna, we are. we are all going to get through this. it's going to be tough. that's why we get the great rewards in the long run. keep your eye on the prize, it's the long term return. over the next two years it might be tough, but we will gain the reward. jenna: always nice to have you, thank you for coming on again. jon: optimism is good. and elite u.s. skier in trouble with the law after some very bad behavior on an airplane flight. the fallout today, plus a brand-new study offers promising leads in cancer treatment. we told you about it yesterday, and coming up we'll talk with the woman behind a project that seems to be paving the way for a major breakthrough in the cancer fight. it's all over now but the team decision. jenna: harris you handled that well by the way. there are no words but what a story . i don't even know what to say. thank you very much. >> reporter: sure. jon: anybody did that to my daughter they would be feeling some pain, that's for sure. there could be one of the biggest advances in cancer research in decades. we told you about this experimental treatment yesterday. it made cancer absolutely disappear in two of the three people treated. but it never would have happened if not for one woman. barbara netter cofounder for the alliance of cancer gene therapy is our guest. tell us how it is that you came to fund the alliance? >> all right. well, my daughter-in-law had breast cancer and she struggled with breast cancer. after that my husband and i founded the alliance for cancer gene therapy. he is now deceased. we met two doctors who practice at mt. sinai hospital and we each went with each of them at another time to a seminar. when we came back we were so excited about the thought of gene therapy as a cure and treatment for cancer that we decided to put our resources and our energies into this. and my husband who was a very patient and brilliant man with many, many ideas, felt in that over time something would develop. we are so pleased that we were the ones able to give to the doctor this grant, and the nci refused and others did not want to general taour into it. jon: the doctor took the project to the national institute of health. the idea is you alter the aids gene slightly, and it's hard to believe that a killer virus like that can actually be helpful, but that's what happened. they inserted it into people's white blood cells, reeven skwrebgt edit back into their body, it went in and hunted down the cancer cells and kill them. why wouldn't the national institutes of health fund this. and your much smaller organization did? >> there could be several reasons. one reason might be that they could not afford to give as many grants at that time, that must have been about five years ago. and another reason is that being a smaller organization we were able to fund it, and fortunately so. jon: this worked on leukemia patients. are you fairly confident that it will work on other cancer -dz as well? >> this is our hope. if we find one means of gene therapy it could be applied to many forms of cancer. there are many approaches to gene therapy, and certain approaches work better for certain kinds than others. jon: has your phone been ringing off the hook with congratulations? >> absolutely off the hook. acdt is so pleased. we are really hoping that we will get more donations and contributions so that we can keep up the funding of our pre imminent scientists. we have a board of 17 scientists around the country. they are preeminent people, and a board of directors of 15 people. we have 17 clinical trials in process. we do need people for the clinical trials. jon: i'm sure there will be lots of people who will want to get involved in the trials. >> it lends a great deal of hope. and we are so hopeful at this time and it looks as though we might really reach the point of our mission. jon: it is a great, great story, a couple paying for research that the government won't, and that research offers all kinds of promise in the cure for cans. barbara netter we're going to get your organization on our "happening now" website so people will know if they want to support you. >> please do, we are ww www.acdt.org. we are having a fund-raiser alternate the end of the year in honor of edward netter who was really our visionary. jon: it's a great way to honor his memory. jenna: remarkable. we know who will be on this debt cutting super committee. the big question is where are they going to find $1.5 trillion to cut from the federal budget? [ male announcer ] there's more barbeque time in every bag of kingsford charcoal. kingsford. slow down and grill. jenna: wall street right now trying to put together a two-day winning streak following some good retail sales, the best we've seen since earlier this year. anyone's best guess. our markets over in europe are closer to being closed and finishing off what has been a tough week. greg burke is monitoring what's happening in europe from rome, italy. greg? >> reporter: hi, jenna. that's right, things looking better. one of the things they did is actually in four countries here, italy, spain, france, belgium, to block short selling. but today markets looking good, up germany, france, london all about 2%, the markets. spain and italy up over 3%, so that is all very positive news after a very rough week but long-term prospects still looking pretty tough. you know, the growth figures or the lack of growth, really gdp figures are out for the second quarter, france was flat, greece perhaps no surprise but down nearly 7%, so it gives you an idea what a drag that is on europe. this is very much a political story just as it is business economics, and here in italy prime minister silvio berlusconi working with political leaders today, he's trying to explain to them what kind of cuts they're going to have to make. they're trying to trim down next year's budget by nearly $30 billion. so, clearly, politically that is not going to be an easy sell on the street, an easy sell out there in the regions. and finally, jenna, you know, we are in mid august here right now. silvio berlusconi's going to be having a cabinet meeting in just about an hour and a half. i can tell you 7 p.m. on a friday night in august, most europeans are not at work, they're probably at their beach house sipping something very cold. [laughter] jenna: i'm sure they prefer to be doing that than doing this meeting, but it's good that they're at work, i guess. greg, thank you very much. we'll let you get to sipping whatever you do during break. jon: six weeks of vacation they get in those european countries. jenna: thank you very much, greg. [laughter] jon: that debt crisis that's been gripping the nation? well, dealing with it is now in the hands of 12, count them 12, member of congress. the house and senate leadership appointing lawmakers to the supercommittee responsible for resolving our deficit. so who are these folks and why were they picked? mike emanuel live in washington with more on that. we know the names of all 12 now. what's the general feedback there in d.c., mike? >> reporter: well, jon, it seems like a formula for gridlock. six republicans, six democrats, six from the house, six from the senate. if they stay in their respective partisan corners, it seems to be a recipe for gridlock or a roadblock, stalemate, whatever you want to say at this point. so we asked a longtime adviser to senate majority leader harry reid for his take. take a listen. >> like i said, i think all are serious, substantive picks. there's some that i have disagreements with. i don't know, for instance, how senator toomey can sit there after having voted against the debt limit increase a couple of weeks ago, but having said that, you know, all, i think, are designed to, a, reflect their different constituencies and, b, reflect their caucus as well. >> reporter: now, jim manly believes that everything needs to be on the table in these discussions, that means looking at revenue, also looking at the entitlements which are long-term drivers of our debt. we will see how those talks proceed, jon. jon: but there are a lot of skeptics out there not crazy about this supercommittee, right? >> reporter: that's right. you know, in washington a blue ribbon panel, special committee, they seem to happen all the time, and a lot of times the reports go up on a shelf, and nothing happens. one of the most vocal critics of this supercommittee is a former speaker of the house, newt gingrich. take a listen. >> i think this supercommittee is about as dumb an idea as washington has come up with in my lifetime. [cheers and applause] i mean, if you will, for a second, i used to run the house of representatives, i have some general notion of these things. the idea that 523 senators and congressmen are going to sit around for four months while 12 brilliant political people are going to sit in a room and brill cantily come up with a trillion dollars or force us to choose between gutting our military and accepting a tax increase in irrational. >> reporter: so there you have his take, obviously, concern about what happens if, you know, the rest of the congress is not involved in this. you have 12 people making this decision perhaps behind closed doors, and what happens if they cannot agree to terms and then we have gridlock and serious problems because then we're looking at serious cuts across the board in government spending. jon: quickly, mike, you say perhaps behind closed doors. is it going to be open, their debate? >> >> reporter: we've heard calls for transparency, to do this in an open way, but you're also talking about very serious issues, and there'll be a lot of pressure from party elders, also from lobbyists all over washington on some of these issues like defense spending and also some of the health care spending. so there may be some tricky aspects if you do it on camera or do it in public where people can hear the argument. jon: a lot of posturing happens on camera. all right, thanks, mike. jenna: an amazing find on a civil war battlefield. maintenance workers were cutting up a fallen oak tree at gettysburg national military park when their chain saw hit something, and it wasn't just the wood. bullets embedded in the trunk, that's what they hit. and the discovery was made in an area called the culp hill, the scene of some of the most intense fighting almost 150 years ago. joining us to talk about this discovery, katie lohan, the spokesperson for getty burg park. how extraordinary is it to find these bullets? >> well, it's pretty much of a rarity today. now, 100 years ago when these were still privately owned lands, it happened much more frequently. but this hasn't happened in at least 20 years here at gettysburg. jenna: i read that the tree that fell was, is older than the united states of america? >> yes. we were pretty surprised. once we had this tree cut, especially the two slices that show the bullets, our natural resource specialist was trying to count the rings, and it was very hard because this tree grew very slowly. it was at the top of a dry, rocky ridge. and it was 100 years old in 1863. jenna: oh, wow. that's incredible. the stories the tree could tell, i'm sure, well, could cover a lot of ground. let's talk about these bullets. is there any way to track who fired them or what side they even belonged to? >> i think if someone did a lot of study, they might be able to figure out, but -- and here's why. first off, the tree fell over, so there's a root ball, but it's been exposed to the weather for about ten years. and it probably twisted and rolled a little bit because it's a steep slope. but if you can figure out whether the side of the tree that has the bullets in it faced downhill or uphill, you'd know whether it was probably confederates who were downhill firing up or the union soldiers who were uphill firing down. we just don't know. jenna: it'll remain a mystery right now, but that ridge, culp hill? is. >> yes. jenna: what kind of fighting was happening in the early july of that war? this. >> so it's a three-day battle of gettysburg on july 1st, 2nd and 3rd, and it's the second day of the battle especially where there's just incredibly intense fighting and on the 3rd of july as well. and the confederates were attacking uphill against the union defenses in this particular part of the hill. so just incredible fighting. in fact, there's some very well known historic photos that show the trees on culp hill, and they're just all pockmarked and damaged by all the bullets and all the cannonballs that hit them. jenna: you've given us a lot of reasons to come and visit this park. we have some of the images of what these battles looked like in artists' rendering. we did show a little bit of a reenactment of the civil wartime. obviously, there wasn't video at that moment. >> right. but there was the beginnings of photography and great photos taken at gettysburg shortly after the battle that help us know a little bit about what to preserve and protect here. jenna: katie, incredible. thank you so much for sharing this really special story with us that gives us a lot to think about and, again, another place to visit, katie. thank you very much. >> thank you very much. come see us. jon: the history of 150 years ago happening now. jenna: can you imagine how old that tree is? >> reporter: i know, jenna, and he's only 36 years old. it's pretty hard to believe, and it is a major bust. the mexican police actually, jenna, snagged the leader of the hands with eyes, that's the name of this mexican drug cartel. it happened in an overnight raid, and his group is actually blamed for a lot of the extreme drug violence and massive drug sales we've been seeing in mexico. as i said, 36-year-old, garcia is, and he was found at a presumed safehouse overnight. once he was taken into custody, he actually admitted to being personally responsible for 300 murders, and he was connected to at least, he said, 300 more many ending in beheadings, so it's the most severe violence we've seen. authorities are saying he's a deserter from the mexican military, former a navy corporal and police officer. here he is being brought out before the press in how they do their perp walks in mexico. and he was also a bodyguard for a major assassin, edgar valdez, before he split off and formed this hands with eyes gang. and, jenna, interestingly, the reason it was called hands with eyes, there's a popular mexican puppet part of an act by a mexican entertainer, and he actually paints his eyes on his hands when performing. think like lamb chop from years ago. this latest arrest were mildly dent the problem of skyrocketing mexican drug violence. this year alone there were more than 7,000 people or if you can believe this, jenna, an average of more than 40 a day that have died at the hands of the cartels, some of them killed are competitors, but innocent citizens are clearly getting caught up in the drug war as well. but authorities there are credited with another major bust. they made in this month, jose antonio acosta hernandez. that happened, again, this month. but still at large this guy, joaquin guzman, and with the death of usama bin laden, he is the most wanted man, most wanted man in the. hard to -- in the world. hard to believe he's the most dangerous. he actually escaped a mexican prison in 2001, and he saided capture since -- evaded capture since in a prison laundry cart after a court ordered he could be extradited to the u.s. no one knows where he is. you put his picture up, maybe we'll solve that one, jenna. jenna: each step an important one. jamie, thank you very much. >> reporter: sure. jon: will the king of the high wire pull off one of his biggest stubbles yet? [ jon i wouldn'tut it my table at home, i wouldn't bring it in. my name's jon forsythe, and i sea fd differently. jon: imagine trying to walk the distance of six football fields on a rope about as thick as a nickel. below you the rushing waters of niagara falls. sounds like a nightmare for most people, the kind of thing that would wake you up at night. but it's the dream of record-breaking tight rope walker nik wallenda. new york lawmakers have given him permission. they are hoping to bring more attention to the niagara falls area which could use an economic shot in the arm, but he still has to convince officials on the canadian side to give him the go ahead the make this walk. nik wallenda joins us live. you're talking about the diameter of a nickel, right? >> that is correct. jon: and your idea, your hope is to make it from the u.s. side to the canadian side. right now canadian authorities have not given you their approval? is. >> that's correct. you know, it's a huge process, getting permission from two countries to walk a wire between the two. um, so we decided to approach the u.s. side first as i'm a u.s. citizen, i was born and raised here and thanks to the help of one of the senators we were able to pass through the senate unanimously through the assembly which was sponsored by senator, i'm sorry, an assemblyman. and we were able the pass that. it still does have to be signed by governor cuomo, but we feel fairly confident he will. we just recently approached the canadian parks association, and we have been talking with them, with the commission and, again, it's a process on that side, too, and we're willing to follow each step that we need to in order to get permission to accomplish this dream of mine. jon: well, there has been a 50-year-old ban on so-called stunts over niagara falls. the new york legislature approved this one, why? because they're trying to give -- >> you know, i think it'll be huge for the economy, for one, on both sides. as well as the fact that what i do is really not a stunt. what i do is an art. it's something that i've done since i was 2 years old. my family has been entertaining around the world for over 200 years, i'm a seventh generation of the wallendas, and this is something that, again, i've done my entire life and trained my entire life for this one dream. jon: so give us some of the stats. this would be longer than six football fields, we mentioned. how high above the falls would you be? >> it's approximately 160 to 170 feet above the falls and, again, it is over 1800 feet in distance. jon: wow. you'd have, obviously, the mist, you know, the water on the wire, that's going to make it more difficult and potentially more trouble. >> well, you know, that's stuff that we train for. i actually recently walked across the allegheny river in pennsylvania, and it was about 220 feet high and halfway out it began to rain. i'll actually train down low with wind and rain, i've trained in the wind gusts of up to 90 miles an hour as well as in rain. so for this walk i'll actually be rigging the entire cable the exact way it'll be rigged over the falls on an airport runway, and we'll actually have wind machines there as well as fire trucks spraying mist on me so it'll duplicate exactly what i'll be feeling while i'm walking across the falls. jon: nik, assuming you get the permission from the governments, jenna wants to come with you, okay? >> she can sit on my shoulders. jenna: oh, oh no. >> a view like no other, i promise you that much. fox news alert. casey anthony -- >> greta: fox news alert. casey anthony is back in florida. she >> casey anthony is back in florida. jose baez reports she is in florida. she did plead guilt tow check fraud in 2010. this has nothing to do with the death of her daughter. y she will be going back to school. casey's planning to take classes online. the terms of her probation include she will not be allowed to drink alcohol in excess and she cannot break any laws and cannot leave florida without permission. last month, she was found not guilty of murder. we will keep you posted on any breaking news. >> governor perry wasting no time, according to a new poll he's the new gop front-runner. he may have joined the race late but he is leapfrogging romney by double digits. what happened? how did governor perry jump ahead? >> it is amazing. the guy got in 10 days ago. he was known according to soft polling by half the republican electorate last month. that shot up. all of a sudden he's de facto front-runner ahead by 12 points over romney. all year romney in one way or the other was the front-runner. all of a sudden perry comes in. the field has been fluid all year. we've seen numbers go up, trump hit a nerve a few months ago. bachmann flavor of the month for a little while. what is interesting about these numbers that came out today, it is the first perp of any of the names to almost hit 30%. if you go back, many elects back over the last decades in the republican field, you had a front-runner by new that was well over 30%. and that person in almost all cases went on to become the nominee this is a different environment. >> greta: is this a honeymoon? there's a new glow and no one has thrown any dirt at him? >> i think it is a little of that. i was in iowa, it was fascinating, last saturday, he walked through the crowd and an inordinate number of people were not only thrilled to see the guy but knew who he was, which i thought was surprising. he has a way of interacting with people that is very natural. i think he will be strong on the stump in that way, perhaps more than anyone else. there's a long way to go and people have a lot to learn about him and his record. some of it may not sit well with everyone. >> greta: the numbers from august and july, governor romney is down six. congresswoman bachmann down three, governor perry up 11. i'm curious if the conventional wisdom is governor perry is stealing voters from governor romney for representative bachmann? >> romney's hope when he looked at bachmann and pawlenty, battle it out in their space, particularly in iowa and in the debates in the end bachmann destroyed pawlenty and pawlenty is now out. i think the romney camp is hoping to see that battle take place between perry and bachmann. if you look at the numbers it is clear at least right now it is romney voters that are breaking away and going to perry's side. romney is showing all of a sudden a certain kind of flexibility or softness, i should say in his numbers that can't be pleasing. >> greta: because he's a front-runner he has been talking about president obama being his opponent. is governor romney going to have to take some swipes at governor perry or challenge him on certain policy? >> this came up today. his whole thing is steady eddie, i'm not going to change strategy. i'm going to talk about the economy, the president's record. for months he has been running a general election campaign in the debates he was that way the unflappable one. above his own party's battles that are going on. he's going to take it to the president. i don't think he can continue that for much longer. one thing about rick perry, he's won 10 elections in a row he has never loss, he runs tough, if necessary negative campaigns and he will go after romney if he needs to. i think it will have to come back the other way. >> greta: never dull. thank you. >>> update now on the phone hanking scandal. investigators say staffers at the now defunct british tabloid hacked into phones. employees are unscrutiny here in the united states after a report of possible phone hacking of 9/11 victims. eric holder met with victims' families telling them so far there is no prove but promising a preliminary criminal investigation. last month british prime minister cameron planned that his government would look into whether 9/11 victims with were targeted. news corporation the parent company of this network closed down the tabloid last machine. >>> senator lieberman goes on the record. what is up with an independent senator and governor palin? we ask senator lieberman about that. >> if you could take a vacation to space, would you? you may get a chance sooner [ grandma ] why do relationships matter? >> what is the dole? that's a great question. tell you what we are seeing. already in the house he is putting out a power point to do that. senator reed finished doing the same thing in the senate. it is interesting we just found something different there is a democratic alternative to the balanced budget amend am possible in this deal. the plot thickens as to whether that changes in this make scombrup in the list of things that is in this deal. >> democratic alternative. that's not a particularly encouraging sign. balanced budget is significant to the budget of the gop and the house. >> there are different versions of it. i believe it was created senator mark udol of colorado. it's a different version of the balanced budget amendment that would not require two-thirds to raise taxes down the road. let's keep going in the big picture. there is enough time if all of the senators agree to fast track this to get a vote they can do this and it can start in the senate. that is the ideal we are hearing pathway. when the tart vote started the market went down by over 700 points. the ideal path starts in the senate and goes to the house. they have a special rule in place they can do same day ra a try to handle this all day on monday to try to get the votes, ahead count before tuesday. >> in the house you have the far left the progressive caucus and tea party caulk cause both grumbling at least with all of the e-mails we see passing back and forth tonight. how certain is boehner he will get the numbers? >> more certain tonight. there are no votes obviously. there was a bit of a pickup in the defense cuts really stared some folks. half of the defense cuts in the so-called trigger. let me explain this quickly again. before thanksgiving a joint committee is set up. 6 lawmakers democrats 6 republicans. they come forward with the deeper cuts bigger cuts. if they are not able to do that and they are not able to pass in an up or down vote this punishment goes into effect these triggers. as it is set up now half are defense department cuts. that is a real problem for republicans. the other half is medicare cuts in these triggers but they are provider cuts for hospitals and doctors not on the beneficiary stuff. republicans said this is not a great deal on the cut thing. it tripped a few head count before speaker boehner today. >> the plot thickens. >> indeed. >> republican senator jeff sessions from state of alabama good evening, sir. what do you think? you like it or not? >> i haven't seen it yet. we have seen a little power point outline and time and time again we found those to be inaccurate. the numbers do indicate there will be some reduced spending not nearly enough but real reduced spending that i think can be enforced. maybe a half or less than half of what we really need to do to get our country on a sound footing. it is not a debt ceiling that is a big issue. the debt ceiling is a process and opportunity for us to discuss the overall debt trajectory that is dangerous for america to give us an opportunity to reverse the trends. that's some progress driven by the last election but not enough. >> is there any sort of -- as you put into the power presentation or in this plan so that in the next congress we are in this mess again in terms of the trajectory? is this really finding o bindin on anybody for a period of time? >> it is binding. a year or so ago we voted to declare the census an emergency. something that is required every ten years not an unexpected emergency. we declared it. the answer is yes congress can get around it. it will be more difficult. i think every american needs to watch and make sure that we are faithful to these modest committees to reverse our spending recklessness. >> do you have any idea the cuts will come in two places one is the military and the other is healthcare providers under medicare? >> i am concerned the military is improperly being targeted in this. what i am hearing is it could be much more severe on them than other agencies of the government certainly i wouldn't favor that. >> is that something that would be a game changer for you? >> it would be a game changer for a lot of people. we will have to see what the language is. they shouldn't have to tighten their belt but disproportionately. >> assuming it is not disproportionately. >> i have said we have 7 days to review this bill. we have known this day was coming for six months. i warned they were going to wait until the last minute plop down a bill no one has time to read and demand you pass it because the markets might be open tomorrow morning and be unstable. unworried about the markets. this legislation should have been on the floor for weeks american people should no what is in it. it's not a deal, deal, dole it's what is in the legislation that's important. >> since you don't want to do anything at the last minute it expires september 30th. wait until the 28th and 29th of september. why don't you stick around and handle that. >> that is a good suggestion actually. we have a real problem spendi s for next fiscal year that begins october 1st. we have surpassed only one appropriations bill and we have got 12 more to go and i don't see any of them moving very fast. so we will end up again with all piled up in one big bill at the last minute. we are asked to pass it. the senate robert byrd said there are two great senates roman senate and u.s. senate. u.s. senate could have been such a fabulous forum for national discussion about debt crisis. we really missed that opportunity. >> we should suggest it. i think it would be a little bit of a stink bomb. maybe we should suggest that you stick around to do that one. >> we need to be ready. we are going to be in the same position. you are right, september 30th. >> we are going to do the school drama again. >> unless something changes we are going to be in the same position. >> always nice to see you sir. the other side of the aisle democratic senator mary landrieu is she satisfied with the deal. you haven't seen all of the details but from what you know tonight yes or no? you like it or not? >> i haven't seen the details but i am leaning toward voting for it. i think it's very, very important to avoid default. it's not just how the government hostage it's how every american, family and business hostage. we need to get past back to the crisis. i want to thank harry reid for working up to the lathes minute. it wasn't pretty. it was tough. i wish we would have more time as the senator from alabama said. it is what it is. and i am looking forward to the details tomorrow. hope we can get this done in the next 24-hours. >> maybe you ought to do that one, too. >> in fact the appropriations process started. see if we can work out the agreement in the house in the home land appropriations bill. >> we talk about tax breaks and deductions. i looked at the power point and there won't be any tax increases. i know that's a big thing for the democrats and republicans have been fighting about it. are taxes going up with this or not? >> i haven't seen the details, tax increases are on the table. revenues are on the table. it's important they be. income coming into the government is at the lowest level since world war ii. people that pay high taxes don't want to believe that. but the fact of the matter is because there's so many loopholes in our tax code and because -- >> 5300. >> one percent income tax six percent income tax. that's in the fair. i am glad tax increases are on the table and tax revenues maybe we can lower rates for some middle class families and small businesses. that is on the table i understand. defense cuts are on the table. discretionary cuts are on the table. to solve this problem we have to raise revenues and cut spending. >> you think that's -- this is on the other side of the aisle. is that going to be -- if taxes are on the table that seemed to be a rare significant item certainly for the freshman members of congress and republicans. is that going to be a deal breaker? >> i think that will be very tough for members of the house. i think the president fought hard for a balanced approach which is some defense cuts, some discretionary cuts and some revenue increases. >> speaker boehner on his call tonight said we have 98 percent of what we wanted. minority leader nancy pelosi. is he right the republicans get 98 percent of what they wanted. >> what it seems like to me we devo avoided the default. we are going to get threw this for the next 24 months which is important. >> pass the election. >> it's not just pass the election. it's for two years. we don't want to engage in this kinds of holding the economy hostage every six months. we can fight about closing the government we can fight about appropriations we most certainly shouldn't fight about holding the economy hostage. >> if the economy were roaring it would be less of a problem. people would feel more optimistic we are on the right path. >> the economy is too weak. that's why i am objective of the fight over this right now. >> the economy is still weak two and a half years later. >> it has not worked as well as we hoped. it is better than doing nothing. that's why i object to people who say we shouldn't have done it. >> how do we know that? >> we put money in the pockets of every american. we extended the tax cuts. you can see now -- >> we put 787 billion into it. >> you can see now the state governments are cutting back teachers are being laid off professors are being laid off. it is starting to weaken the economy. government spending at the appropriate time when you have a depression is important to do. >> i am not totally convinced when i look at all of the inned kuwait dorrs unemployment housing starts i am not convinced the stimulus bill has gone. i know the argument is we would have lost more. i am unconvinced. >> i was always moved to do something as opposed to nothing. it was a balance between tax cuts and additional spending. we have to be careful about pulling too much out of the economy. i am glad the president avoided the default tonight. >> senator thank you very much. take a look at the details and there's much to be talked about. >> the republican senator ron johnson calls the secret behind the door's debt ceiling negotiations disgusting. is he satisfied with the proposed deal. the great state of wisconsin i might add. sorry to senator landrilandrieu. >> is it disgusting? >> yes. >> still? >> we are talking a deal that will be $2.4 trillion worth. think about what that is $2.4 million worth. you have a couple people negotiating this. it is ridiculous. talked about the federal government's budget here. >> we really do need time to review this. we don't want it like the healthcare law where nobody read the thing. we don't want to pass to see what's in it. >> in terms of what you know so far the same question i possessed to senator landrieu and senator sessions. does it look like something that put your hands around something you are likely to vote for? >> here's the first problem. the rating agency everybody is keying in on that. they are saying we need $4 trillion to afford it. this will only be 2.4 trillion. >> i hate the rating issues. they are the ones who got into that mess the way the toxic cdo's they gave triple a ratings for. >> let's put it a different way then. what is happening right now is we have doubled spending in just the last ten years. 10 years ago we spend $1.8 trillion this is year 1.6 trillion and more. what the president's budget would do after 10 years increase that from 3.7 to $5.7 trillion. he could spend $46 trillion. all we are doing is lowering that by what 9 huf900 million. i am an accountant. the only way you can really guarantee 900 billion of spending cuts is you better make sure you cut about 90 billion. i have seen estimate of 7 billion the first year maybe 22 billion. what is the control of the fact that we may get 9 billion in the first. there is no guarantee of 1.2 billion in the second. we have to control spending in washington. this is business as usual. this is a spending culture in washington. i came here to see if i could do something about changing this culture. >> is this in any way appealing? is oo anything good in it>> cbo estimated 3.4 million would lose numbers. 50 percent of employers will drop coverage. there is 180 million people that get their coverage through prou employers now. healthcare law alone could eat up any savings this bill creates. >> from what i understand i can't say how you are a yes on this. >> this is totally inned a inad. it may be a step in the right direction but it's not fixing the problem. it's not about the august 2nd deadline it's about the amount of spendling and debt that this country is occurring. it's really the debt in relationship to the size of our economy. if it is 120 trillion large 14 trillion would be a problem. the economy is 14.8 trillion. that's the problem. we have way too much debt for the size of our economy. >> the continued resolution funding our government do you want to do that now or wait until the 29th of september. >> the democrats should have passed the house and the senate. oo oo we are ore that one. >> no we are not over that. that's what is so disgusting about this. backing up against the deadlines and we are trying to spend trillions of dollars in a couple weeks. given these fwils we have no time to read them that is horrible government. it is going to produce an awful product. >> senator thank you, sir. we are going to go live where ed henry is standing by. >> spoke to a couple of white house officials laying out more details about how all of that came together. the president and vice president are working the knowns over the last couple dies talking to all of the key leaders reaching out to lawmakers to bring it to a conclusion. let me highlight one piece of the deal that is something to keep an eye on. we heard about the special committee of congress that will have to support a piece of legislation by thanksgiving and congress would have to act on that by christmas giving them two key deadlines giving them 1.5 trillion in more spending cuts. what happens if they don't do it? we heard there would be dramatically more spending cuts split evenly between domestic and defense so democrats and republicans would each feel pain. there's another piece of this that hasn't gotten a lot of attention. these dramatic kutsz if congress fails to act would not take effect. they would not take effect until the beginning of january 2013. the white house is talking the fact that they were able to get that so the cuts would take effect in january of 2013. that is when the bush tax kutsz cuts expire. they were saying if the republicans have not come up with the prime address is balanced approach. structural tax reform here as well cleaning up subsidies, et cetera. the president is now saying flatly he would veto the tax cuts for the rich. he extended those back in december in part because of the dire situation now and clout after the midterm elections. who will get cid the here is the president working the phones. one white house voted as well. last night this staffer was coming back here into the white house about 10:30 p.m. to get back to work. working around the clock here. motorcade was coming back from his residence to the white house. >> ed, thank you. >> the house's cat cup and balance the senate didn't vot bother to vote on it. do they agree with the wet debt ceiling. how about you? how does it impact you? >> you are one of the members of the republican gop the freshman. are you satisfied with this? >> everybody else sat here tonight with you it is hard to make the judgments until you see the details. looks good. looks like it has the same components that cap and balance has. we know they were firmly behind that plan. hopefully it's enough to get this done and make sure we avoid this crisis. >> a lot of the tea party caucus has been criticized as being the ones who were somehow causing trouble or interfering. has been worth it? >> abc slightly. you look at our history as a country and how often we raised the debt ceiling with no conditions how we have done it with the debt ceiling over and over again. we got seventh a referendum that said go there and change things. >> you have a sense that other freshman gop in the house are satisfied to the extent we know the details and you will be satisfied when you don't get anything else. recognizeing this crisis is coming. we have talked about it for a year and a half. we firmly believe this battle is why we were sent. >> they come down at the end of the day and envision that you get a whole package and to get part of it. we start that path down the right track. >> what do you think you didn't get that you wanted? what don't you think you get? >> i think everybody would like to see more substantial cuts especially in the first year or two they look to be small numbers. i haven't seen the details in this bill. in the other bill it was 22 million in this year than the next year. they won't be huge number that is blow our minds. we would like to see more than that. the balance the budget amendment to the states would be great. at home overwhelmingly people support that. that makes common sense. why would you not say it's a priority to balance your budget? that is something that a lot of us care deeply about. >> you learned about the gop president is that how you learned about it? >> that is a thing that is always a bugger. you sit there as a new member of congress you are amazed you are seeing a lot of the details in the news play out before you get the conference call. it had been in the media for half an hour. that is frustrating you would like to think you would hear some of the details first. that is one of the things we will fix up here. we need to keep working on it. >> senator johnson referred to the whole process as disgusting. it is hard to participate in the deal making. it is done behind closed doors. with more people in the room it's probably hard to get a deal. in the house it's different. t our speaker let bills come do the floor we have offered hundreds of amendments. there's no more earmarks to try to get votes. this is the policy of what do you think is right and let's see if we can roundup the vote. >> did he go up with the wealthy americans. >> the president kept talking that. tomorrow of them are endorsing that. >>> we will woch and see what happens the next daum days. >>> the stock market as the jitters.

fox news -- sources tell fox news in fact there is no word he has left libya. of course, his whereabouts are unknown. the british prime minister, david m cameron, just following a meeting of his own national security council issued a statement saying, quote, we have no confirmation of qaddafi's whereabouts but the british have also confirmed the detention and arrest of two of qaddafi's sons. of course any of this can change at any moment, we are cautioned by intelligence sources but as of now there's no evidence that qaddafi, who's not been seen in the last four hours, only heard by audio, has left the country. gregg: james, what are the top concerns of u.s. military officials going forward? >> reporter: number one, first and foremost, gregg, security in and around tripoli. this is the seat of government such as it was in qaddafi's libya and the very first order of business will be to try to impose some form of law and order in the country. once the celebration stops, they don't want to see this become baghdad a redoux where we see excessive looting and all toward that end, is to establish security over libya's weapons, stockpiles and arsenals, in particular, u.s. officials are concerned that missiles, antiaircraft missiles, of which libya had a sizeable number under qaddafi, could be looted and potentially get into the wrong hands and put to use against a civilian airliner. there is also concern about establishing cohesion amongst the transitional national council and libyan rebels. as you know there's tribal infighting and they don't want to see baghdad redoux. we've seen how that plays out. gregg: got to secure those weapons. a lot of them. james rosen, thanks. martha: james raises a number of important questions in all of this. what with ce expect from the libyan opposition groups that are likely trying to coalesce and try to figure out how to take power? k.t. mcfarland, national security analyst on the story, she has been all through the weekend of course for us and we thank you for that valuable input. here we are monday morning and you say the next 48 hours are extremely crucial in all of this. why is that? >> act one, topple the dictator, okay? we seem to have done that. act two, can the rebels get it together, watch and see what they do, can they establish security in the next 48 hours, 72 hours, because if they can't, looting starts. it's one thing to have a revolution. it's another thing to turn to the boring task of governing. are they going to spend their time score set ring -- score settling? for 40 years, qaddafi has murdered friends and families. is all the energy going to be taken up killing the bad guys were making sure the water runs, streets are safe, protect the institutions, get the electricity going? >> martha: certainly the early word is the treatment of the sons have been civilized and that says to me that they want the world -- that's the message they want to send to the world that they're not going to treat these individuals the way they've been treated and their families have been treated and also we've gotten support from sarkozy, saying he wants to meet with the head of the tnc in paris next week, so that also gives them legitimacy, you know, those indications would be somewhat positive, right? >> those are positive. but you have the moving factor in this, where is qaddafi, does he flight or flee, does he do a saddam hussein. everybody in libya has a gun, whether it's the libyan military that seems to have melted away when the rebels got into tripoli. we know the my laishas are armed, the rebels are armed, so does everybody lay down their arms? you don't know. if qaddafi flees, where does he go to, to the south, does he try to rally the southern desert tribe, which is where he's from, to fight an insurgency? does he flee -- >> martha: it sounds like the prime minister is now -- his own support network has deteriorated to such a degree, do you think he can put together enough people to keep fight something. >> he's got a lot of money to buy insurgents, pay people off, buy fighters from sudan, he has money literally probably under the mattress, we know there have been caches of weapons he's had in various palaces throughout the country. he's perfectly capable of mounting an opposition for a guerilla war. does where -- why does he not free, go to another country? fox news sunday. and hello again from fox new in washington. irene is hammering the shore of new jersey and bearing down on new york city. we can report it was downgraded to a tropical storm with sustained winds of 65 miles per hour. but it is moving so slow low and producing so much rain, it is still very dangerous. irene made landfall saturday morn there are nine reported deaths and tornados were spotted in maryland and delaware. knocked out power to three million people and new york city mayor michael bloom bloomm said he time for evacuation is over and ordered residents to stay inside . we'll hear from craig fugate in a moment but we have team coverage of where the irene is headed. julie is in battery park that faces a threat of the a serious storm surge. >>reporter: yes serious storm surge. loir manhattan and battery park in particular is ground zero for this storm. mainlyy because of the electric supply here and the tide. the tide is reaching high tide. 8:00 this morning and expected storm surge of 8 feet would mean that lower manhattan, much of it would get flooded. we have seen flooding knee deep and the hudson river overflowing in lower manhattan and meat packing district north of here. zone a is where i stand. mandatory evacuation issued here which meant 350,000 people in here and rockaways and queens and coney ilandd. flooding and street and bridge closures and the george washington bridge, lower deck closed earlier today. and all of the bridges will remain open as longg as the winds don't get up to sustained 60 miles per hour wind. we have had gusts up to 60 miles per hour and so it looks good there. we are hearing that the linn contunnel. outbound. not the lincoln but the holland tunnel which is southern most in battery park. you now have to move up north to the lincoln tunnel. they have closed that down. public transportation system is shut down. it is the first time new york city shut down all of the trains and buses due to inclement weather and last time new york city even experienced that affect due to a hurricane was 19quive hurricane gloria and first time for us to experience a direct hit back in 1921 and that flooded 13 feet high fromm where i am standing up to canal street. flooding is a major concern for hundreds of thousands of people without power in jersey and new york combined. back to you, chris. >> chris: julie, thank you so much for that. we'll bringg in mike tobin who is waiting for the storm to hit in howard beach, long island. what is the situation there? >>reporter: i can tell you, the full force of the storm, chris, we are getting the biggest kick we are going to get for the storm at least from this point and locationn. to give you an idea where my location is, it is near jfk airport. it is metered here at 40 miles per hour. they really feel like they are getting more to 50 or 60 miles per hour . that is why you can see all of the water driving in here. this is a result of storm surge and high tide hitting at the same time and this is a big parking lot. behind me, you will see the main drag that leads to the rockaways and rockaway beach. look at the amounts of the streett lines and power lines are tested right now. and also in this area, you can see the dump trucks in the boulevard. you can see them in the center of the boulevard. this is blocking off the cause way out to the barrier islands. all of those people who refused to come and decided to ride out the storm are getting the worst of it right now. and emergency being vs can't get there to evacuate them if they are in trouble at this moment. 92 do they think that the full storm surge has not hit. it is expected to hit in the next 45 minutes or hour. does the flooding expected to get worse? >>reporter: it seems that way. some people are braving the worst of that and drive through it and i can't tell you how many times people do that and found out it was a bad decision and ended up the lead story on the news. we are past the worst of high tide by a half an hour. but it seems like the water keeps coming in as the wind is driving it in and that is a storm surge in itself. and so with the intensity of the storm, we are getting more water on the main streets and now you can see the emergency vehicles behind us making their way through the water. they will get up and go across the causeway. that is the area in the rockaways where a lot of people rode out on the storm. >> chris: mike, thanks for that and stay safe. joinning us now from fema headquarter in washington is the director of the federal emergency management agency director fugate. as we said irene is bearlyy a hurricane with sustained winds of 75 miles per hour. can people afford to let theirr guard down? how dangerous is ireinn --irene at this point? >> guest: we have had reports of fatalities in certain states. caused by trafficc accidents or trees coming down and hitting houses and there is dangerous. hurricane-force winds of 70 miles per hour is bad. you don't want to drive in it. don't let your guard down. for most people in the immediate path of the store stay inside and stay safe until it passes the area. >> chris: talk about the area that irene is headed. what is yourr biggest worry as the hits new york and heads up new england? >> i think for new york and long island it is how much storm surge we get. they are running out of the high tide that. is a concern of how much water we get. wind itself, power out anals and that number goes up and heavy rainfalll and flash flooding that can occur. if you are in a safe place, staying inside is the best thing. we'll see how much flooding we get as irene moves up the coast. >> chris: we are talking 4-8 feet storm surge. what can that do to manhattan and the areas on long island? >> guest: the flood damage itself is bad. that's why the locall officials and mayor bloomm bloom ordered the evacuation to get people out of there. l hopefully we'll not get more damage but we'll know more when the storms gets out of the way. >> chris: 75 miles per hour wind sounds bad. but in a city with canyons and tall mountains and things like that, winds can be more severe particularly in the higher levells of the sky scrapers? >> guest: absolutelyy. we can see 20 or 30 percent increase as you move up a hundred feet or more n the high rise, get away from the high rise buildings and move down in the lowwer part of the building and don't go outside. we don't have reports yet. we may have a window pop out or debris pop off. so far, loss of life hasn't been as great as we were fearing. but we want to have people stay safe . >> chris: what reports about the damage so far about the damage where irene has hit as it made landfall in north carolina. >> guest: north carolina emergency reportted 57 swift water rescues where they got people out of the water that were trapped. they are lookking to get to the barrier ilans to get ferry service restored. half million more people are without power. we are seeing the report comes in and we'll get better idea of how much road and structural damage. the primary focus is on search and rescue. >> chris: talk about all of the things that your agency is doing withitate and officials. how many emergency shelters and supplies you have from beds and blankets and food and water. and any sense of how many people you are servicing? >> guest: the shelters are run by locall officials in combination with the american red cross and salvation army. we stay in contact, but the red cross is the best source for the shelters and go to red crosss.org, and they will give yo information if you need that information. we are workog getting teams in place and generators and supplies more for after the storm depending on impacts in the areas up down the east coast. it is a combined effort. volunteers and in the private sector working as a team and hoping to make sure we do everything we can to keep the public safe. a lot of areas that the storm moves through, you want to get out and see how bad it is. stay off of the roads. they don't need to compete with you for the road space and there is hazards with downed power lines. stay home unless it is urgent. >> chris: i know it is premature with the floodding and property damage. we understand three million people lost power. how long could these releafand - relief and cleann up efforts? >> guest: we'll know more tomorrow. how much damage was caused by system trips. and that will drive how quicklyy power will come back on. we are asking them to get ready for extended power out ages for days. >> chris: finally everything in washington director fugate revolves aroundd the budget. i know that is not your concern today. you are near the end of the fiscal year. is fema going to need emergency pending and need more money with the added coast - cost of the dealing with the hurricane? do you think that would help? yeah. priority mail flat rate shipping starts at just $4.95, only from the postal service. a simpler way to ship. >> chris: you are looking live at times square. it is an awfully unusual sight on sunday morning. it is absolutely deserted and people bracing for the arrival of irene despite what you see on the right-hand side of the screen is downgraded to a rop top storm and dangerous and sustained winds of 65 miles per hour and we heard from fema director craig fugate with a city with tall canyons and tall buildings. the 65 miles per hour wind can be much more fierce and a storm surge in the coastal areas. now for a look at how the storm is holding up where it is headed today, we turn to our meteorologist rick wright. >> rick: you get around 300 or 400 feet and it may with 25 miles per hour stormer. and the rain moved north of new york city . long island you are looking clear and don't be fooled. there will be more bands that circle through after we'll see more rain and the winds will continue. the winds are a story for the remainder of the day for tropical storm force winds. major flooding is the next concern. the rain is not over in parts of new england. if you key the maroon color that is flash flooding, most of the state of the new jersey and delaware and pennsylvania and areas of upstate new york and new england. we have more rain to come. heaviest of the rain, 17 or 18 inches in north carolina and virginia, that is done. we'll see it taper off in philadelphia and head to the north now and that's where the heaviest of the rain will be. mountains getting another 6 or eight inches of rain on top of what they have already received in the last couple of weeks. there is a major flooding concern on our hands by tomorrow of the chris. >> chris: rick, thank you for that. there is other news and joining us from houston, texas and continuing our 2012 one on one series is congressman ron paul. welcome back to fox news sunday. >> guest: thank you, chris, good to be with you. >> chris: you heard director fugate talking about all of the thing that is fema is doing to help with the path of irene. you talked about doing things back in 1900. >> guest: fema is not a good friend of most people in texas. all they do is come in and you can't get in your houses and they hinder the local people and they hinder volunteers from going in. there is no magic about fema. >> chris: you upon would do away with fema and all of the things it is doing to help people in the east coast? >> guest: you read the reports that came out of new orleans and all of the wonderful things they did. giving check to people who didn't live there and hundreds of millions of trailers because they didn't meet fema standards. it is a system of burrcrats with a policy that is deeply flawed. you don't get rid of it in one day. i have had the position for a long time and i have a coastal district. but i also suggested that there is differe

news continues on fox. >> this is a fox news alert. president obama says there is a deal. speaker boehner senate majority harry reid and mitch mcconnell says there is a deal. not so fast. that is just the leadership. it's not over. what about the raipg and file. the leaders must convince the rank and file already there is express content. will the tea party caucus and tore bead doe a deal. what's the deal? >> what is the dole? that's a great question. tell you what we are seeing. already in the house he is putting out a power point to do that. senator reed finished doing the same thing in the senate. it is interesting we just found something different there is a democratic alternative to the balanced budget amend am possible in this deal. the plot thickens as to whether that changes in this make scombrup in the list of things that is in this deal. >> democratic alternative. that's not a particularly encouraging sign. balanced budget is significant to the budget of the gop and the house. >> there are different versions of it. i believe it was created senator mark udol of colorado. it's a different version of the balanced budget amendment that would not require two-thirds to raise taxes down the road. let's keep going in the big picture. there is enough time if all of the senators agree to fast track this to get a vote they can do this and it can start in the senate. that is the ideal we are hearing pathway. when the tart vote started the market went down by over 700 points. the ideal path starts in the senate and goes to the house. they have a special rule in place they can do same day ra a try to handle this all day on monday to try to get the votes, ahead count before tuesday. >> in the house you have the far left the progressive caucus and tea party caulk cause both grumbling at least with all of the e-mails we see passing back and forth tonight. how certain is boehner he will get the numbers? >> more certain tonight. there are no votes obviously. there was a bit of a pickup in the defense cuts really stared some folks. half of the defense cuts in the so-called trigger. let me explain this quickly again. before thanksgiving a joint committee is set up. 6 lawmakers democrats 6 republicans. they come forward with the deeper cuts bigger cuts. if they are not able to do that and they are not able to pass in an up or down vote this punishment goes into effect these triggers. as it is set up now half are defense department cuts. that is a real problem for republicans. the other half is medicare cuts in these triggers but they are provider cuts for hospitals and doctors not on the beneficiary stuff. republicans said this is not a great deal on the cut thing. it tripped a few head count before speaker boehner today. >> the plot thickens. >> indeed. >> republican senator jeff sessions from state of alabama good evening, sir. what do you think? you like it or not? >> i haven't seen it yet. we have seen a little power point outline and time and time again we found those to be inaccurate. the numbers do indicate there will be some reduced spending not nearly enough but real reduced spending that i think can be enforced. maybe a half or less than half of what we really need to do to get our country on a sound footing. it is not a debt ceiling that is a big issue. the debt ceiling is a process and opportunity for us to discuss the overall debt trajectory that is dangerous for america to give us an opportunity to reverse the trends. that's some progress driven by the last election but not enough. >> is there any sort of -- as you put into the power presentation or in this plan so that in the next congress we are in this mess again in terms of the trajectory? is this really finding o bindin on anybody for a period of time? >> it is binding. a year or so ago we voted to declare the census an emergency. something that is required every ten years not an unexpected emergency. we declared it. the answer is yes congress can get around it. it will be more difficult. i think every american needs to watch and make sure that we are faithful to these modest committees to reverse our spending recklessness. >> do you have any idea the cuts will come in two places one is the military and the other is healthcare providers under medicare? >> i am concerned the military is improperly being targeted in this. what i am hearing is it could be much more severe on them than other agencies of the government certainly i wouldn't favor that. >> is that something that would be a game changer for you? >> it would be a game changer for a lot of people. we will have to see what the language is. they shouldn't have to tighten their belt but disproportionately. >> assuming it is not disproportionately. >> i have said we have 7 days to review this bill. we have known this day was coming for six months. i warned they were going to wait until the last minute plop down a bill no one has time to read and demand you pass it because the markets might be open tomorrow morning and be unstable. unworried about the markets. this legislation should have been on the floor for weeks american people should no what is in it. it's not a deal, deal, dole it's what is in the legislation that's important. >> since you don't want to do anything at the last minute it expires september 30th. wait until the 28th and 29th of september. why don't you stick around and handle that. >> that is a good suggestion actually. we have a real problem spendi s for next fiscal year that begins october 1st. we have surpassed only one appropriations bill and we have got 12 more to go and i don't see any of them moving very fast. so we will end up again with all piled up in one big bill at the last minute. we are asked to pass it. the senate robert byrd said there are two great senates roman senate and u.s. senate. u.s. senate could have been such a fabulous forum for national discussion about debt crisis. we really missed that opportunity. >> we should suggest it. i think it would be a little bit of a stink bomb. maybe we should suggest that you stick around to do that one. >> we need to be ready. we are going to be in the same position. you are right, september 30th. >> we are going to do the school drama again. >> unless something changes we are going to be in the same position. >> always nice to see you sir. the other side of the aisle democratic senator mary landrieu is she satisfied with the deal. you haven't seen all of the details but from what you know tonight yes or no? you like it or not? >> i haven't seen the details but i am leaning toward voting for it. i think it's very, very important to avoid default. it's not just how the government hostage it's how every american, family and business hostage. we need to get past back to the crisis. i want to thank harry reid for working up to the lathes minute. it wasn't pretty. it was tough. i wish we would have more time as the senator from alabama said. it is what it is. and i am looking forward to the details tomorrow. hope we can get this done in the next 24-hours. >> maybe you ought to do that one, too. >> in fact the appropriations process started. see if we can work out the agreement in the house in the home land appropriations bill. >> we talk about tax breaks and deductions. i looked at the power point and there won't be any tax increases. i know that's a big thing for the democrats and republicans have been fighting about it. are taxes going up with this or not? >> i haven't seen the details, tax increases are on the table. revenues are on the table. it's important they be. income coming into the government is at the lowest level since world war ii. people that pay high taxes don't want to believe that. but the fact of the matter is because there's so many loopholes in our tax code and because -- >> 5300. >> one percent income tax six percent income tax. that's in the fair. i am glad tax increases are on the table and tax revenues maybe we can lower rates for some middle class families and small businesses. that is on the table i understand. defense cuts are on the table. discretionary cuts are on the table. to solve this problem we have to raise revenues and cut spending. >> you think that's -- this is on the other side of the aisle. is that going to be -- if taxes are on the table that seemed to be a rare significant item certainly for the freshman members of congress and republicans. is that going to be a deal breaker? >> i think that will be very tough for members of the house. i think the president fought hard for a balanced approach which is some defense cuts, some discretionary cuts and some revenue increases. >> speaker boehner on his call tonight said we have 98 percent of what we wanted. minority leader nancy pelosi. is he right the republicans get 98 percent of what they wanted. >> what it seems like to me we devo avoided the default. we are going to get threw this for the next 24 months which is important. >> pass the election. >> it's not just pass the election. it's for two years. we don't want to engage in this kinds of holding the economy hostage every six months. we can fight about closing the government we can fight about appropriations we most certainly shouldn't fight about holding the economy hostage. >> if the economy were roaring it would be less of a problem. people would feel more optimistic we are on the right path. >> the economy is too weak. that's why i am objective of the fight over this right now. >> the economy is still weak two and a half years later. >> it has not worked as well as we hoped. it is better than doing nothing. that's why i object to people who say we shouldn't have done it. >> how do we know that? >> we put money in the pockets of every american. we extended the tax cuts. you can see now -- >> we put 787 billion into it. >> you can see now the state governments are cutting back teachers are being laid off professors are being laid off. it is starting to weaken the economy. government spending at the appropriate time when you have a depression is important to do. >> i am not totally convinced when i look at all of the inned kuwait dorrs unemployment housing starts i am not convinced the stimulus bill has gone. i know the argument is we would have lost more. i am unconvinced. >> i was always moved to do something as opposed to nothing. it was a balance between tax cuts and additional spending. we have to be careful about pulling too much out of the economy. i am glad the president avoided the default tonight. >> senator thank you very much. take a look at the details and there's much to be talked about. >> the republican senator ron johnson calls the secret behind the door's debt ceiling negotiations disgusting. is he satisfied with the proposed deal. the great state of wisconsin i might add. sorry to senator landrilandrieu. >> is it disgusting? >> yes. >> still? >> we are talking a deal that will be $2.4 trillion worth. think about what that is $2.4 million worth. you have a couple people negotiating this. it is ridiculous. talked about the federal government's budget here. >> we really do need time to review this. we don't want it like the healthcare law where nobody read the thing. we don't want to pass to see what's in it. >> in terms of what you know so far the same question i possessed to senator landrieu and senator sessions. does it look like something that put your hands around something you are likely to vote for? >> here's the first problem. the rating agency everybody is keying in on that. they are saying we need $4 trillion to afford it. this will only be 2.4 trillion. >> i hate the rating issues. they are the ones who got into that mess the way the toxic cdo's they gave triple a ratings for. >> let's put it a different way then. what is happening right now is we have doubled spending in just the last ten years. 10 years ago we spend $1.8 trillion this is year 1.6 trillion and more. what the president's budget would do after 10 years increase that from 3.7 to $5.7 trillion. he could spend $46 trillion. all we are doing is lowering that by what 9 huf900 million. i am an accountant. the only way you can really guarantee 900 billion of spending cuts is you better make sure you cut about 90 billion. i have seen estimate of 7 billion the first year maybe 22 billion. what is the control of the fact that we may get 9 billion in the first. there is no guarantee of 1.2 billion in the second. we have to control spending in washington. this is business as usual. this is a spending culture in washington. i came here to see if i could do something about changing this culture. >> is this in any way appealing? is oo anything good in it>> cbo estimated 3.4 million would lose numbers. 50 percent of employers will drop coverage. there is 180 million people that get their coverage through prou employers now. healthcare law alone could eat up any savings this bill creates. >> from what i understand i can't say how you are a yes on this. >> this is totally inned a inad. it may be a step in the right direction but it's not fixing the problem. it's not about the august 2nd deadline it's about the amount of spendling and debt that this country is occurring. it's really the debt in relationship to the size of our economy. if it is 120 trillion large 14 trillion would be a problem. the economy is 14.8 trillion. that's the problem. we have way too much debt for the size of our economy. >> the continued resolution funding our government do you want to do that now or wait until the 29th of september. >> the democrats should have passed the house and the senate. oo oo we are ore that one. >> no we are not over that. that's what is so disgusting about this. backing up against the deadlines and we are trying to spend trillions of dollars in a couple weeks. given these fwils we have no time to read them that is horrible government. it is going to produce an awful product. >> senator thank you, sir. we are going to go live where ed henry is standing by. >> spoke to a couple of white house officials laying out more details about how all of that came together. the president and vice president are working the knowns over the last couple dies talking to all of the key leaders reaching out to lawmakers to bring it to a conclusion. let me highlight one piece of the deal that is something to keep an eye on. we heard about the special committee of congress that will have to support a piece of legislation by thanksgiving and congress would have to act on that by christmas giving them two key deadlines giving them 1.5 trillion in more spending cuts. what happens if they don't do it? we heard there would be dramatically more spending cuts split evenly between domestic and defense so democrats and republicans would each feel pain. there's another piece of this that hasn't gotten a lot of attention. these dramatic kutsz if congress fails to act would not take effect. they would not take effect until the beginning of january 2013. the white house is talking the fact that they were able to get that so the cuts would take effect in january of 2013. that is when the bush tax kutsz cuts expire. they were saying if the republicans have not come up with the prime address is balanced approach. structural tax reform here as well cleaning up subsidies, et cetera. the president is now saying flatly he would veto the tax cuts for the rich. he extended those back in december in part because of the dire situation now and clout after the midterm elections. who will get cid the here is the president working the phones. one white house voted as well. last night this staffer was coming back here into the white house about 10:30 p.m. to get back to work. working around the clock here. motorcade was coming back from his residence to the white house. >> ed, thank you. >> the house's cat cup and balance the senate didn't vot bother to vote on it. do they agree with the wet debt ceiling. how about you? how does it impact you? >> you are one of the members of the republican gop the freshman. are you satisfied with this? >> everybody else sat here tonight with you it is hard to make the judgments until you see the details. looks good. looks like it has the same components that cap and balance has. we know they were firmly behind that plan. hopefully it's enough to get this done and make sure we avoid this crisis. >> a lot of the tea party caucus has been criticized as being the ones who were somehow causing trouble or interfering. has been worth it? >> abc slightly. you look at our history as a country and how often we raised the debt ceiling with no conditions how we have done it with the debt ceiling over and over again. we got seventh a referendum that said go there and change things. >> you have a sense that other freshman gop in the house are satisfied to the extent we know the details and you will be satisfied when you don't get anything else. recognizeing this crisis is coming. we have talked about it for a year and a half. we firmly believe this battle is why we were sent. >> they come down at the end of the day and envision that you get a whole package and to get part of it. we start that path down the right track. >> what do you think you didn't get that you wanted? what don't you think you get? >> i think everybody would like to see more substantial cuts especially in the first year or two they look to be small numbers. i haven't seen the details in this bill. in the other bill it was 22 million in this year than the next year. they won't be huge number that is blow our minds. we would like to see more than that. the balance the budget amendment to the states would be great. at home overwhelmingly people support that. that makes common sense. why would you not say it's a priority to balance your budget? that is something that a lot of us care deeply about. >> you learned about the gop president is that how you learned about it? >> that is a thing that is always a bugger. you sit there as a new member of congress you are amazed you are seeing a lot of the details in the news play out before you get the conference call. it had been in the media for half an hour. that is frustrating you would like to think you would hear some of the details first. that is one of the things we will fix up here. we need to keep working on it. >> senator johnson referred to the whole process as disgusting. it is hard to participate in the deal making. it is done behind closed doors. with more people in the room it's probably hard to get a deal. in the house it's different. t our speaker let bills come do the floor we have offered hundreds of amendments. there's no more earmarks to try to get votes. this is the policy of what do you think is right and let's see if we can roundup the vote. >> did he go up with the wealthy americans. >> the president kept talking that. tomorrow of them are endorsing that. >>> we will woch and see what happens the next daum days. >>> the stock market as the jitters.
