let's go right to nbc kerry sanders, who is in atlantic weech, mcincome, with a good morning to you. r we spoke to you, kerry. we had part of a pier that had been shorn off. >> month more of the pier is gone, but if you are looking at me right now, you are saying what's going on? well, it's really calm here because we're in the n what is the eye. it's really ill defined. what's interesting is i'm going to take you up in the camera here, and as can you see some n certain areas it looks almost like blue sky there, and then as you look way out there you can see those really dark clouds. well, they're heading towards us. that's the eye wall that is heading this direction. of course, as you know, the eye wall is where the most powerful winds with the hurricane are. they'll be getting here. we imagine within about the next hour or so at the speed this hurricane is moving. the really good news, though, on the front end of this hurricane, we have the back end still to come through, but the really good news is the lack of damage. there's a little street flooding. there have been some fences kn

please stay inside. >> again, that was nbc's kerry sanders in atlantic beach, north carolina. as we mentioned, the storm is expected to hit new york city during high tide tomorrow morning. nick is tracking irene and joins us with what that could mean in terms of flooding. hello. >> absolutely. hitting right at high tide. they'll have a storm surge of four, six, perhaps as high as eight feet so you get the high tide, the big waves. could be some big flooding issues for new york city. here's the developing of the storm weakening a bit as it hit the outer banks of north carolina. just got the update at 11:00 p.m. still sustained winds at 80 miles an hour. what's amazing about this storm is just the sheer size of it. it is about 500 miles across. that would cover about two-thirds of the state of california if it were on the west coast. here's a zoomed in picture. the center of the system not quite as wrapped one rainfall. a little drier air. it is creeping along at 15 miles per hour to the north northeast. right now it is off the maryland and delaware county coast -- the state coa

nbc's kerry sanders is in orlando with the latest on this. kerry, we are hearing that casey's case has been transferred now to another judge, which was a motion filed just the other day, correct? >> yeah. we have all sorts of developments. first of all, i'm standing in front of the department of corrections in orlando where if casey anthony follows the current schedule that she's been ordered to do she will have to show up before 5:00. but at the same time remember this is an order that came from judge stan strickland. he was the judge who handled the case on the check fraud casey anthony pled guilty. and he said that he sentenced her to a year's probation. the confusion here is did she serve that year's probation as she was sitting in the orange county jail here in orlando awaiting the murder trial, or does that probation begin when she left the jail? so her attorneys argue, and there is some paperwork from the department of corrections, that suggests she served that probation as she sat in her jail cell. so the attorneys are arguing now, wit

kerry sanders is live from orlando with that. ed as if casey was a free woman after the acquittal and the lawyers are now expected the file a motion against that order, any minute i understand, and when do you expect that the motion can come through? >> i think that they are going to file perhaps within the next 20 minutes. they indicated that they would have filed by now, so i think that we are told by defense attorney cheney mason that there needs to be adjustments to the language to the motion they are filing. but the problem is that they will file this the clerk's office here at the courthouse, but the judge who has ordered her to return, judge stan strictland is on vacation. and the court has already indicated that he does not plan to come in to court today, open up the courtroom, and break from vacation. so, it is unclear since he won't be back from vacation next week whether he will entertain this motion, which means that his standing order for casey anthony to return to begin the probation would hold. casey anthony is supp

first, let's bring in nbc's kerry sanders live in atlantic beach, north carolina. a scary place to be when you hear eastern north carolina is directly in the path of this hurricane. >> when you say the eye wall, which is where the strongest winds are, could come right through here. might jog a little bit north, might jog a little bit south. as incredible as these powerful computers are and what the national hurricane center is able to do, nonetheless, there is some imprecision they're forecasting. i'm standing right here atwater's edge because this water is more than 80 tegs. this is the fuel for the hurricane. this warm water is fwraet fgrea tourists but not for irene as it makes irene even more powerful. i think it's a good opportunity because you've got to understand, folks in north carolina, they've been through this drill before. they understand this. a little further north, maybe they can take tips from the people here about what to do as irene is coming at them. you hear, for instance, the governor of north carolina, bev perdue, she's already declared a stat

. >>> nbc's kerry sanders is live in atlantic beach, north carolina. kerry, what's the latest from down there? >> reporter: well, good morning, and good news is you see very few people here at the beach. that is good news, because it means tourists are beginning to take the warnings. some counties along the north carolina coast have already issued evacuation orders for tourists. now, here's how they hope it works -- that tourists recognize they need to leave today. and so they push inland and go where they need to go, which then opens the roads for the residents to be able to begin their evacuations tomorrow. because the idea is with hurricane irene coming in and as we just heard bill say, it looks like the eye wall will come right through here over eastern carolina shore. they're going to need to get a lot of people inland. and to get folks inland requires a lot of preparation on individuals, you know, there's just so much the government can do for you here, and that's usually after the fact. right now, they're urging people to recognize that you have

nbc's kerry sanders is in orlando. why is this coming after?e judge is here in this courthouse. as you remember, 16 months before the trial when casey anthony was acquit odd all charges of murdering her daughter, when she was acquitted of those charges there was still an order by the judge in a previous case for check fraud, which you mentioned. and that order required one year's probation. now, the error was that they determined that the probation was being served while she was in her jail cell waiting to stand trial for allegedly murdering her daughter. so she's released, goes off and everybody thinks she's free. and that's it. yesterday, the judge who had ordered that one-year probation sent out a clarification explaining what he meant. and he said he meant that she had to spend one year probation here in orange county in florida. right here in orlando. and said she had 72 hours to report to the department of corrections. so that would be tomorrow afternoon. now her attorneys are planning to come to court to say they would like to disqualify
