but at the same time remember this is an order that came from judge stan strickland. he was the judge who handled the case on the check fraud casey anthony pled guilty. and he said that he sentenced her to a year's probation. the confusion here is did she serve that year's probation as she was sitting in the orange county jail here in orlando awaiting the murder trial, or does that probation begin when she left the jail? so her attorneys argue, and there is some paperwork from the department of corrections, that suggests she served that probation as she sat in her jail cell. so the attorneys are arguing now, within the last 20 minutes, judge stan strickland, who has received the file from jose baez and the defense attorneys has been recused from even handling this part of the probation. and now that part of the case is going to go to judge perry. perry, of course, is the judge who handled the murder trial. she was acquitted on charges of murdering her 2-year-old caylee. we're standing here and expect anything a short time a representative from the department of correc

after objections from her attorneys, judge stan strickland is out. and judge belvin perry is back.he probation order stood. at 11:30 the department of corrections held a press conference to say they were ready. >> we are prepared to begin supervising casey anthony on probation. our goal is to treat her like every other probationer who we supervise. >> reporter: like every other probationer, casey's address would be made public, forcing her out of hiding. despite all the animosity in this town -- >> caylee, caylee. >> reporter: and a myriad of hate-filled websites, they have no plans for any added security. by 3:00, no change. >> and our expectation is that she will be here tomorrow between the hours of 7:00 a.m. and 10:00 a.m. >> reporter: then, at 4:45, just before the close of business judge perry gave casey a small victory. >> we received a call from the court saying that ms. anthony does not have to report to probation tomorrow. >> reporter: now, it is all up to the judge. jose baez will make his case to him in a hearing tomorrow morning. he'll argue that casey anthony already

the judge at the time, judge stan strickland, ordered her to serve 412 days in jail.t all while awaiting the trial. the judge also verbally said at the time after she's released, he then wants her to do one year supervised probation. but that whole year came and went while she was still awaiting the murder trial. so everybody, including the department of corrections, believe that counts for that one year of serving probation. but even now judge perry even seems perplexed. >> this is a legal morass that if anything could go wrong, it went wrong here? >> yes, your honor. >> and i'll be frank and honest, i don't know what i'm going to do. >> reporter: judge perry wants to do some more reading of some legal cases and rulings to see how this weighs out because the verbal intent by judge strickland seemed to indicate he wanted her to serve probation after she was released from jail, but on the actual sentencing documents that was not spelled out in black and white, so expect a ruling from judge perry perhaps next week, maybe wednesday or thursday. and if he does rule agains

now the judge in that case, judge stan strickland out of orlando just today announcing that he is stepping down from that case a, he's recused himself. he did not explain why he decided to do that, but, again, he is stepping down from this case. now we've just heard from officials at the florida department of corrections, and they say that they are under the impression that casey anthony has until tomorrow to report in orlando, to meet with a probation officer to begin serving that probation. so that's their understanding. they are expecting her to report to that probation officer tomorrow. there have been pictures that have been surfacing on the internet of casey anthony in ohio wandering around wearing a baseball cap and sunglasses and flip-flops. so that's apparently where she is, or where she's been. again, officials in florida are expecting her there tomorrow. it will be very interesting to see as we get word that the judge in that case has recused himself. so as we get more information and we learn where she is we'll let you know. back to you, jon. jon: keep an eye on it for us. jenn
