the brickyard has taken more measures to address noise than any other businesses in union street. we've tried to work within the existing physical structure because changing it would result in construction costs and cause further financial strain on a struggling business. noise ordinance compliance is not dependent on physical structure in place. it also requires responsible management. if it were physical structures alone, no venue would be allowed to have windows or doors that open to the street. giving the existing structure with the conditions in place, there will be no violations of the noise ordinance. we are responsible business owners and neighbors. we do not recommend additional changes. in closing, thank you, we do not recommend changes for the physical structure. we request the board denied the appeal and upheld the conditions imposed by the planning commission. vice president garcia: i have a question for your acoustical expert, mr. solomon. there seems to be some dispute about what the base ambient noise level should be. would you tell me what they are and whether -- b

i'm leslie landhart, i'm the executive director of the union street association. i'm really not speaking with that hat on today. my members did not send me down here to discuss this. they're pretty disgusted about everything that happens anyhow with raising taxes. with the 1% -- i'm speaking from my own business. i have a small business. i've been in business for 33 years in san francisco on the same street, on union street, and i have seen nothing but -- especially since in 10 years, especially with rates of taxes going up, sales tax in particular. i've seen my business go down, down, down. i was thrilled to see 1% come off the state. that made it 8 1/2 percent rather than 9 1/2 percent. it's subliminal when people go buying. you might own a retail type business where you have goods to sell. people say they have much lovelier shops there and it's 2% cheaper. it's cumulative. i think san francisco has a very bad image with a visitor. i'm sorry to say it. that we are expensive. you can't park. all in all, you've heard it before, i know you have. i won't belabor the

the water along market street. the next bart station is powell street, near union scare. was all timed to coincide with rush hour. it's 5:45 now, this started at 5:00 tonight. we had dozens of protesters inside the civic center bart station and we have these pictures to show you what it looked like. you see here passengers inside the bart train. you see a protesters holding a sign, free speech. and looks like that train is not able to move. after this is when bart made the decision to close that station down to trains. we saw a number of trains coming in and speeding through the station and not stopping and quite a bit of this guy, surround by police, talking on his cell phone. lot of the people as part of the protest are calling for free speech in reference to bart's decision to shut down cell service inside some stations at previous protest last week. it is a developing situation and the newest information is the civic center bart station is not open. we saw trains speeding through. we learned bart decided to close the down escalator so people could not access the civic
