clerk calvillo: supervisor chu, kim, wiener? supervisor wiener: today, i am calling for a hearing on what various city departments, including the mayor's office on housing and other departments, are doing to encourage the production of moderate and middle-income housing in san francisco. inclusionary housing. how that review will addressed the connection -- that will address the city's ability to would attract and maintain private and non-profit sector jobs. we do a very good job producing market rate housing in san francisco. we do a respectable job producing low and very low- income housing in the city. we are close to meeting our targets. we do a very poor job producing moderate and middle-income housing in san francisco, moving as potentially in the direction of being a city of rich and poor without a large middle class to support the tax base and to provide the stability that any city or society needs. we need to be very aggressive in providing that housing, and i am very interested to hear with the various city departments

supervisor wiener? >> thank you. i will be supporting the motion. we have in recent years been able to enact a number of important pieces of pro worker legislation with very broad support. we passed minimum wage, paid sick leave. at the ballot with broad support, healthy san francisco after a lot of work on both sides went to passing healthy san francisco. i hope that on which i am working will pass close to unanimously. when we put our minds to it, we can come up with solutions to labor issues and do it in a consensus way that protects workers while not damaging businesses. we keep hearing over and over again that it is a small or tiny percentage of players who are abusing the h.r.a.'s. if that is true, and i believe that it is, we need to address this problem with a scalpel and not with a sledgehammer. we are all hearing -- i know i am -- from many small businesses that are absolutely terrified about what will happen to their businesses if this legislation passes in its current form. we are hearing from labor a different narrative. we should not b

i would like to think supervisors wiener, mar and campos. there has been an incredible groundswell of support throughout all sectors of san francisco from mom-and-pop restaurants, small restaurants, cafes, who are looking for as much assistance in getting a leg up, especially as san francisco likes of the other cities has tried to traverse the economic downturn that has engulfed this country and the state. musicians and performance artists are looking for some opportunity that had not been created before that might give them a leg up as well. we think with this legislation, we might be able to create some synergistic response that helps the sizable orbit of cafes and restaurants to be able to obtain a permit where the curb -- current system had been very cost prohibitive because it's a one size fits all permit which could cap over $2,000 in a year. usually for the larger facilities, the larger venues that would allow for entertainment. in this case, we're trying to create another tear for smaller than you permits and that falls into line wit

for supervisor wiener about the contrasting this plan with a sledgehammer. the courts made it clear, but to the extent that you try to define the concepts of benefits and try to micromanage this kind of an account, that you are going to have legal problems. and to the extent that people are talking about compromise, the compromise that has been discussed, and we heard that in "the chronicle," focus is on the kind of benefits that would be required for employers to give their employees. it would put limitations on the limitations employers can place on the accounts. if we go down that road -- and i think that is what my colleagues are thinking about when they talk about compromise -- we are falling into a legal trap that will ensure that not only we lose this amendment, but we jeopardize the entire health care security ordinance. that is the fear that we have here. compromise may be appropriate, but at the end of the day, you do reach some situations where you have to make a choice. if you are going to have universal health care, are you going to let a small
