rob erred handa got to the scene minutes after this happened. robert, what's goes on there now? >> it is a very confused situation as you can imagine. we are here in the willow glen neighborhood of san jose. there are still a lot of police action going on behind me. kind of understandable since, as tori mentioned, this occurred about an hour ago. giving the view from news chopper 2, police here tell me that the incident took place near the gas pumps closest to curtner avenue. this happened around 11:00. a man went up to a man who was still in his vehicle. his mazda vehicle at the pumps. the person came up and shot the man inside the car at basically point blank range and fled. the person who was shot was rushed to the hospital and, at this point, police tell me that they are still waiting for the condition of the person who was shot. the investigation continues here as well as the search for the person, and, again, the person's condition could mean the difference between whether this turns into a homicide case or not. police say, at this point, of course, they are still talking
