rights of people up to the votes of the popular will. >> reporter: but that's exactly what the san jose cityay do, ask voters to decide whether to enact pension reform. the projected 23012-2013 shortfall could be $115 million in the red. the driving factor, the city says, pension costs. 10 years ago the bill for retirement costs was $73 million. this year, it's more than triple to $263 million. with another $50 million on top of that projected for next year. so the city is pushing for two key changes that are expected to save the city $67 million for the next fiscal year. first, push back the retirement age. for public safety from 50 to 60 and for the rest of city employees, from 55 to 65. second, change the formula that determines retirement pay. for example, right now, a police officer who works 25 years with a peak salary of $100,000 would get $75,000 in base retirement pay for the first year. under the new policy pay would be slashed to half of that. henry gutierrez of san jose says that's unfair. >> that's a big cut for people to take after they have worked a long time and expect it. >>

the south bay dozens of medical marijuana dispensaries are vowing to fight a decision pie the san jose city council to limit their number to just ten dispensaries. tonight mayor chuck reed is also digging in his heels. monte francis spoke to the mayor and joins us live from san jose city hall. what's next for the dozens of pot clubs in san jose? >> reporter: well, there are about 130 medical marijuana dispensaries here in san jose and the mayor is saying 120 of them will have to close or relocate. but pot club owners are vowing to take this fight to court and to the ballot box. amsterdam's garden is one of dozens of medical marijuana dispensaries in san jose that could be forced to close if it doesn't get one of the ten coveted permits allowed under a city ordinance passed last night by the city council. >> i think it's incorrect for them to go about trying to restrict something that doesn't -- that they don't really know that much about. >> the state has not given us much guidance, the federal government says it's illegal so we're trying to figure out the way to go and this is a good way t

faced with an ever increasing deficit san jose city leaders are already discussing just how they willlose the gap in next year's budget. we have team coverage and i begin with dan kerman who tells us after making cuts for the past 10 years there is little left for the city tram. >> for the coming year of 2012 and 2013 in expected that they will face a deficit of between seven yen and $115 million. the problem is that there's little left to cut, one option, services and lay off more employees including public safety personnel. the simpson--the second option is employees either pay more into the system or get more out of it. it could save a lot by doing this, but it requires a public vote. the third option would also require a public vote it would you quarter or half cent increase in the local sales tax. that could net the city about $36 million but a recent poll this summer san jose residents seem not to be interested in having their cells attacked increase. dan kerman kron4 news. >> how does the looming budget and tax and all the residents we continue team coverage with rob fladeboe f

reporter: well, dana, huge changes to the way the medical marijuana is sold and made here in the city of san jose. the council just overwhelmingly voted to reduce the number of cannabis clubs down from 140 to 10 in the entire city of san jose. they say that anyone who is in business right now is basically operating illegally. they will have to reapply. those applications will be screened and then they will be picked on a first come, first served basis. the other major change is that the medical marijuana will have to be grown on site where the medical marijuana is sold the right now. so if you look at all of this demand and supply that's in san jose you consolidate that into ten locations, a lot of the collectives are saying that now you're going to have these sites that are going to be the size of costco and wal-mart to actually grow the amount of marijuana that's needed to supply the city of san jose. so air going to have complaining neighbors and also they say that this is going to be a huge target for crooks that now the way it happens now is that a lot of this marijuana is grown in secret lo
