and vis-a-vis mr. cohen? supervisor elsbernd: thank you for accepting my request to appoint someone else, i was not able to attend. i was able to review the hearing and during this applicant's presentation there was one thing that was said that was concerning. the seat to which he has been appointed, qualification say the applicant must be low-income. in his testimony he said he is not low income. if we're going to follow the legislation as it was drafted and insure that everyone is represented, most importantly, those of low income qualification are represented, we should fully understand why this individual was appointed and if not him, if we have better applicants. not saying no to him today but that question needs to be further discussed since it was brought up by a public credit should be further elaborated in public. i asked the sea be referred back to committee. president chiu: supervisor has made a motion. is there a second? can we do that without objection? objection? roll-call vote.

mr. cohen's nomination be set back to the committee for further discussion. he said he stated he had been nominated for low-income see, but was no wonder low income. sauc-- but was no longer low income. on the motion to send his nomination back to the committee, the motion passed 6- 5. the committee will reach here this nomination in the future. the board also considered overturning a veto o. this would be of the sharply an ordinance. this week the board voted on whether they should override the veto. they need a super majority of eight, and over rights failed with only six votes. lastly, this week there was a sequa appeal for the certification of the modern art expansion and fire station relocation. this is the e.i.r. appeal of the project. they have remained arguments. they argued it did not match the plan submitted to the department. they argued the visual impacts were not analyze and there would be impacts to present views. staff responded to these claims, and on a unanimous vote they upheld the certification and denied the appeal. the board subsequently

thank you for your kind heart don't speak, make it better make it start ♪ [applause] supervisor cohen: mrloney? thank you. >> good afternoon, supervisors. my name is jim maloney and i just want to say that the port is very supportive of this project. we have had the opportunity to meet with the executive director, and dr. burke. we had the opportunity to express concerns with the location. we will be working closely -- we have offered to work closely with the wellness center to mitigate the concerns of the community, the rail and truck traffic. investigating this project working. supervisor wiener: i just visited iper 80 -- pier 80. i know that more activity will be coming up as the america's cup comes through. what will be different in that vicinity in terms of activity? >> some of the other america's cup teams may be there. supervisor wiener: can you explain how close the site is to appear 80 -- pier 80? >> it is about half of a mile from the site. the more intensive use that we expect to the site would be where the port is looking to potentially export the ball products -- bulk product

the chair recognizes the gentleman from tennessee, mr. cohen, for five minutes. mr. cohen: thank you, madam speaker. this weekend a movie opened in america that is unlike any other movie. significant movie because it is about a group of gentlemen who won the congressional gold medal, the tuskegee airmen, they were the first black airmen in the united states military history. it's part of black history, but beyond black history it's american history. because as i watched the movie yesterday in memphis, and a largely african-american crowd, i realized this was a story about america's progress and fulfilling its promise and about the problems we have had we had to overcome. the tuss keying gee air -- tuskegee airmen were men who wanted to fight for the country in world war ii and they weren't allowed to because of the segregation policies we had at the time. the military wasn't integrated and they didn't think african-americans were capable of serving as pilots and weren't allowed to do so. they had an experimental group set up at the tuskegee institute to train black ar
