i'm pleased to be here before you today to discuss the department of homeland security's efforts to regulate the security of high-risk chemical facilities under the chemical facility anti-terrorism standards act. as you all are aware, the department's current statutory authority to implement this came about under section 550 of the fiscal year 2007 appropriations act, and it has been amended and recently to extend that authorization until october 4 of 2012. i believe strongly in the cfas program, and i welcome the opportunity to continue to work with this committee, with the congress and all levels of government in the private sector to further improve this vital national security program. since the inception of cfas, we have initiated a basic rule, we've defined chemicals of interest, we've jointly conducted two surveys in the industry to define the facilities that have a substantial quantity of chemicals that caused them to be determined to be at high risk. after receiving the initial submissions from more than 40,000 facilities that might potentially be under the program, we've narrowed t

we know from the department of homeland security that there have already been threats to the utility sector. we also know that russia and china have probed our electricity grid to find vulnerabilities. our economy hinges on our reliable flow of power with losses that go into the billions of dollars with every major blackout. our national security also depends upon it. since 99% of the electricity used to power our military facilities, including critical strategic command assets comes from the commercially-operated grid. last september, i asked all five commissioners on the federal energy regulatory commission under our jurisdiction to name the number one threat to electricity reliability. all five commissioners agreed, cyber threats are the number one threat to the grid. in 2009, the full energy and commerce committee unanimously passed the grid act, which i authored along with chairman upton. that bill gave ferc, the authority to quickly issue grid security orders or rules that vul vulnerabilities or threats have not been adequately addressed in the industry. it was killed in the sen

first the roles and responsibility of the department of homeland security with regard on a cyber security mission. i know the secretary is well familiar with the lack of legislative authorities that dhs has with its mission. it's been doing an admirable job based upon executive order and public expectation, but we wanted to codify that current mission of dhs and make sure that they have the roles and responsibilities clear to protect critical infrastructure in this country. the second piece does touch upon various aspects we've already heard. that includes the protection of critical infrastructure. we do take a bit of a different approach to it. the thornberry task force found that while regulation is not our first choice, there is a rule for the government in protecting the most critical of critical. in trying to determine what was regulated, how it was regulated, and who did the regulating was the task that we had to determine in the committee. what we try to do is build upon the department's division of covering critical infrastructure used in the senate bill. so a facility or function
