shannon bream, live at the supreme court. we thought it might come down this morning, shannon, but i guess the justices have decided to keep us hanging. >> reporter: yeah, today is not the day, jon. we did get four opinions today, healthcare not among them. the justices know the world is watching on this. it's interesting when justice saying and lead on read one of the opinions she authored, and now i present the opinion on x, y, z case, probably not the one you're waiting on. that is being hammered out behind closed doors. a final draft in the many opinions we expect to get the case. we will get more opinions on thursday. we got a case today that is huge for american business owners and employers. it was a case from two pharmaceutical republicans who were suing because they wanted to get paid over extra hours they put in on the job. they classified as outside jails man which would make them exempt from over time, but they said they should be getting the extra pay. there was discussion whether people should get paid to play go

shannon bream live at the u.s. supreme court. bret baier, anchor of "special report" is with us as well. but let's begin with shannon. talk to us about this immigration ruling. what exactly, shannon, did the justices strike down, what survived? >> reporter: well, the lower courts had put four provisions of s.b. 1070 on hold, all four of them were in play, three of them were struck down. one of them that, essentially, would make it a state crime for illegal immigrants to not have their proper registration papers if they have them, the second would make it a crime for those who aren't authorize today work here in the u.s. to seek work anywhere within arizona's borders. the last one they struck down would give local and state police the authority to make an arrest if they thought somebody had committed an offense that would make them removable from the u.s. what that leaves is the key provision which is if police stop someone on suspicion of another crime and they have reasonable suspicion to believe somebody is here illegally, then

shannon bream live in washington at the high court as she has been all morning. shannon, and so it pits one of the most conservative justices on the high court directly against the president when it comes to the immigration policies of this administration. >> reporter: you're exactly right. and it looks like a head-on collision today. it's interesting that people on both sides of this law are claiming victory from this opinion. the opponents say three of the four provisions were struck down, a major win for us. but supporters of the bill say the one section they left standing is the one that matters most. let's talk about what's gone. three provisions to have law that were blocked, section three which makes it a state crime for those required to register with the federal government if they fail to carry a required registration card. a crime for those not authorized to work in the u.s. to solicit work in arizona and section six which would allow officers to make arrests in some cases without a warrant. you mentioned the part left in place, anyone stopped under stat

shannon ream, thanks very much -- bream, thanks very much. jenna: bret baier, we mentioned it's an election year. the political ramifications? >> they're significant. governor mitt romney is in arizona, and we're only getting indication from his campaign that he'll put out a paper statement about this ruling. so that kind of shows you the delicate issue of immigration and how it deals with the politics of the situation. obviously, this has been in the forefront of the back and forth between president obama and mitt romney over the past couple of days. they spoke to naleo, the national association of latino leaders, last week and this is a big issue. i want to point out as gregg mentioned, it was a bold statement from governor brewer in the paper statement she released saying this was a victory for the rule of law and that this controversial provision can now be implemented as accordance with the u.s. constitution. however, in that same statement a little bit later, i think the realism is expressed from governor brewer, and that says: today's

you will because shannon bream is here and no one knows it better than shannon. all right. you were at the supreme court today. tell me what the decision means? >> reporter: overall, they are striking down 3 of 4 provisions of sb1070 that inspector play. the majority agrees that the federal law preemps what the state was trying to do. they agreed on the one portion that alus the police, if they have stopped someone for a local or state infraction and have reason to believe that they are in the country illegally, if they have been arrested, you check the status before you let them go. >> all right. reasonable suspicion. what in the world is that? that's a gray area. if someone has an accent? there are a lot of american who is have absents. a lot of people here legally with accents f. people look of a different ethnic background. is that reasonable suspicion? will there be problems with that one? >> reporter: there will be. a number of groups already plan to sue, whatever happened with the case fanything was left standing, they have lawsuits in the wings. even governor brewer

shannon bream is watching the court for us. what did he get today?several opinions but let me break down a couple getting the most attention. the first is from california. if you are a state employee in california you have two choices. you can join the union and pay dues or not join the union you're still going to have to pay dues. in 2005, the se seiu sent letter of fee increase used to fund the political objective. a number of employees those paying dues chosen not to become union members objected to the process. in a 7-2 decision, they decided under the first amendment they could not be forced to subsidize split call speech they did not agree. significant blow to unions. another case, court held that the federal communications commission was in the wrong when it investigated and in some cases fined broadcast networks including fox television for things like profanity, by celebrities, you know, during award shows when they let things slip because the rules outlining decency were too vague. now we'll see if the fcc gives rules a rewrite. >> bret: st
