our senior correspondent eric shawn in new york city tonight. are growing. how safe are absentee ballots where you mail in your vote. over 90 million people voted by absentee ballot in 2010. those are the numbers that voted. more than 14 million voted by absentee ballot. over 15% of use those according to federal election officials. in new jersey they expect to handle 40,000 absentee ballots for this election. john hogan the county clerk say there is a rigorous procedure that involves both democrat and republic election officials overseeing them. >> we have a very thorough verification process so that anyone who should be able to vote and chooses to vote by mail their right will be preserved. they will be able to vote by mail. >> the ballots are kept secure in a locked and 24-hour guarded room with protection for restricted access. some say absentee ballots are the easiest way to commit voter fraud there have been absentee ballot prosecutions this year in at least 10 states. >> the board of elections people are overwhelmed during the time of an e

eric shawn is here with more for us. >> reporter: jenna, opponents of voter id turned out this morning, and they got their wish. you do not need a photo id now to vote in the presidential election in pennsylvania in november, but the law will stand. commonwealth court judge robert simpson, who supported the law, did let the voter id law stay. he says poll workers can still, though, ask for a voter id, but voters don't have to show one when they show up in november. simpson blocked part of the law that requires people without an id to vote by provisional ballot and then provide documentation about their identity within six days. he feared that requirement could disenfranchise voters if they could not come up with the proof of their id. simpson ruled, quote: i question whether sufficient time now remains. i expected more photo ids to have been issued by this time for this reason. i accept petitioner's argument that in the remaining five weeks the gap between the photo ids issued and the estimated need will not be closed. opponents charged the law was aimed at preventing minorities and th

eric shawn has this from new york. >> you know you have to be an american citizen to vote for presidentin colorado officials say that they have found more noncitizens who robert voter roles. you know it's been a controversial issue nationwide after election officials have discovered thousands across the country. colorado secretary of state republic scott guess ler says as many as 5,000 noncitizens may have voted in his state alone in 2010. well, now guess ler says they found 441 more of those, 232 are unaffiliated with the political party. 163 are democrats. 37 republicans. and the others are enrolled in minor parties. say it's politically motivated and disenfranchising voters in november. that's nonsense by law they are only protecting the election system. there is always that chance it could impact the presidential race. 10 years ago we had a congressional race that was decided by 121 votes. and that same year, we had a statewide race that was decided by 90 votes statewide. so, this stuff matters. and it matters a lot. >> and it's not just colorado. fox news has reviewed noncitizen re

senior correspondent eric shawn live in the new york newsroom with shocking details of this. eric, tell us how the scheme worked? >> hi, martha. the plan was vodka for votes, offering little half-point plastic bottles for vodka like this one we bought in arkansas to steal an election. that is what prosecutors say did happen in eastern arkansas. a scheme included absentee ballot fraud and buying votes in exchange for money and food besides the booze. nine people have been charged. democratic state representative hudson holland pled guilty. he resigned from office. he allegedly told a codefendant a local city councilman, we need to use a black limo and buy a couple cases of cheap vodka and whiskey to get people to vote. >> i guess i always knew all along it was wrong but first i didn't think it was that big of a deal. i always heard that is what everybody did. >> reporter: he faces five years of prison. resigned after the deadline to be on the ballot. authorities say if he wins he will not take office, martha. martha: eric, how did authorities discover it was going on? >> report
