i know the department of public works is currently working with the california department of public transportation, with caltrans, to see whether a sidewalk can be constructed adjacent to the freeway side of niantic. it is under continued discussion with caltrans at this point. honestly from the department's perspective, we were given this information kind of after the fact, after the building permit was approved, after construction had begun and well underway before we found out this issue. really there is only one of two alternatives right now to the property owner barring the demolition of this building. one is the major encroachment permit which is in front of you. the alternative is to vacate or purchase that portion of the right of way so that it's part of their building, part of their property now, and then they would be made -- then the applicant and the city would be made whole by them paying a fair market value for this piece of land. i'm not sure whether that answers all your questions. >> so we have some comments. supervisor cohen and then supervisor wiener. >> thank you very much. mr.

we want to thank the members of the public for being here and taking part of in hearing and sharing their thoughts and concerns and their expertise as well. it is critical that we hear especially from folks who work in the neighborhood that probably have the highest incident of mental health crisis in san francisco where we would see the greatest deployment of the cit team and where if they were equipped with tasers would would see the highest incidence of use as well. i don't to call back up commander ali and or commander korea. i want to thank you for your presentation and for being here. and want to give you a moment to be able to respond to any particular thing that you heard from public comment. and anything that you would like to add. in the environment and which our officers have to work. i think that it is incredibly important and i want to leave a quick note that we have trained, one of the best trained departments in the country identifying with the mental health and in 2001, we began the initial training of 40 hours of 40-hour training for each officer in the mental health awar

i'm representing the department of public health today. this policy would inform prospective tenants of which units have been designated as smoking optional. supervisor mar, you've already basically explained what the ordinance would require and i would just like to add that over the years as the public has become much more educated and aware of the dangers of second hand smoke we've been getting a lot more calls with tenant complaints about smoking and in particular we've seen a lot of people who have called like i remember we got a call from a mother with a brand new infant, seniors with lots of chronic diseases, people with hiv, people with cancer and heart disease, who had just moved into their apartment and had no idea they were going to be exposed to second hand smoke that was drifting from other units into their apartment and they were totally at a loss of what they could do. this is basically a right to know ordinance. this would inform prospective renters where smoking is allowed so they can make an informed decision and choose to
