this with a hatchett. happened in up scale neighborhood in noe valley area of the city where the kind of crime never expected. story tonight from 7 news reporter thomas. >>reporter: he let them in no forced entry we know of. safe neighborhood coordinator for 300 block of 27 street in noe valley he says he's known the victim who lived in the house for more than 25 years. >> he's had encounter with other house guests who have threatened and hurt him. so this is not this is not isolated incident. >>reporter: san francisco police are calling the incident that happened 10:30 thursday night home invasion robbery. police say 3 men broke into the house and attacked 69-year-old resident while he slept with hatchett. then attacked his roommate. >> victim was brutally attacked in his own place. by the suspects. the victim had no time to react and just did the best to defend himself and as you can immanuel the second victim coming home walking into a home invasion in progress was also viciously attack. >>reporter: rea

paul kallen and glenda hatchett are back with me.ve filed harassment claims. judge, who has the better case. >> i think the photographer has a better case in this situation, because the reporter was there. so he has a witness. i mean, the things that he said to this guy, really are outrageous. this is a guy who was on the new york police department force for some 15 years. and this just is out of hand. and baldwin is, as you said in the lead of this, is no stranger to this. as i understand it from the most recent reports, the police are not going to pursue any criminal charges against either of them, since both of them filed charges. but i think he has a great civil case here against baldwin. >> now, the reporter does say she got the whole thing on tape. this is a celebrity story. tmz is involved here. tmz which has heard the tape, they say the tape backs up baldwin's claim that he never used a racial slur. >> interesting. >> and that he never said he would choke the reporter. paul, is this all that matters here, what the tape says?

. >> judge hatchett weigh in here with me, and explain why a gun therefore would be any different thanay a knife? so the person who manufactured my lovely kitchen knife, that could be used in a murder would also be liable. or the car that i drive, that i drank and killed someone, the manufacturer of that deadly weapon, doesn't this set a precedent? >> it's a very complicated situation. i want to go back just a second to the federal statute that was implemented in 2005 after heavy, heavy, heavy lobbying from the nra. i mean, it was a huge victory for them. but there are exceptions as joey mentioned that talk about defective manufacturing and negligence. so if a distributor knows that they are circumventing the background check, they can do that. but i do think this is a complicated situation. it is what happens, and how far back and how can you connect the dots for causation, even if you have the statute, it does not necessarily mean that you will prevail in these civil cases. because you have to establish some connection between the gun manufacturer and the incident that happened, wher
