i am audrie's mother. first, i would like to thank all of those around the world who expressed their love for audrie and the sadness we have all shared that she was driven to leave us in the way that she did. she was a joy to everyone that she was around, she warmed the room with her smile and made us laugh at her incredible wit and sense of humor. audrie had a kind and gentle heart that from a very young age she formed relationships not only with her friends, but adults of all ages. she had a quality for bringing joy and laughter to all those that she was around. there is not a day or an hour that passes that i'm not warmed by a memory of her. in the days and months that followed the investigation, i learned that there was a serious flaw in the laws that surround the assault on my daughter. i discovered that if a victim does not have the ability to -- as a sexual assault, it is seen as a lesser crime than if she was conscious and able to fight off her attacker. i learned in california, a sexual assault st

audrie's stepmother read some of the messages audrie posted on her facebook page after photos of that attack were shared with other students at her school. >> i don't want to remember. it's a night i want to forget. i am in hell. everyone knows about that night. the whole school is talking about it. my life is over. >> reporter: the family used today's press conference to announce a civil suit against the three 16 year olds today and to urge prosecutors to try the teens as adults. the family attorney says the judge will have to consider the photos that santa clara county sheriff investigators found of the assault. >> there was one that said the name of a young man was here as if to taunt her when she was asleep someone was violating her. that is a particular factor we believe is indicative as to the intent that was formed to really do harm to her. >> these types of crimes are not juvenile. sexual assault is an adult crime. these boys distributed the pictures to humiliate and further bully my daughter. if this can happen to my daughter, it can happen to anyone. >> reporter: now it is w

audrie awoke the next day with no pants on and with markings over her body not knowing what happened. three boys were arrested and charged with the assault and distributing photos of the attack. the claim goes on to say that in the week before her death audrie w was accused of cutting herself and another one harassed her and called her name. the family claims teachers and administrators at saratoga high failed to respond. this is a violent prevention coordinator at san jose state and says schools have an important role in preventing bullying. >> the first step for any college campus and any school campus is to call it what it is. it's bullying. it's violence, and it's not okay >> reporter: and just about an hour ago the district issued a lengthy statement which says in part, quote, our internal investigation showed that audrie never reported or south counseling for bullying before or after the alleged sexual assault. if she had, our staff would have reported it and taken preventive steps to stop it. the district also refutes one of the family's accusations saying that the principal ha
