the bond authority has been by the same redevelopment agency and the redevelopment financing authority and with the automatic succession of these bonds, the ocii commission would be able to reconstitute the refinancing of this authority. the reason why the financing authority is a party to this contract because under the terms of various state guidelines it cannot do a negotiated sale but a financing authority can. if you want more explanation for the reason behind that, i can leave that to the attorneys. it has been the recommendation of the financial visors on this deal that a negotiated sale is necessary in order to get the best terms for these bonds because of a special status of the success or agencies and the fact that this is the first in fact new money bond deal under the terms of redevelopment dissolution. it requires a lot of education of potential investors as to why they should be competent with interest rates as coming into this as a new entity. we have been advised that a negotiated sale is the way to go and we need to do it through the financing authority structure. this

board of supervisor's resolution 11-12 to elect to retain the housing functions of the former redevelopment agency and to accept the housing assets, accept a transfer of all of the housing assets pursuant to disillusion law that was comprised of assembly bill ab 26. in march of 2012 the oversight board took action to acknowledge all of the housing assets had transferred to the city as housing successor. however, the end of june of 2012, the state amended disillusion law through assembly bill 1384. it did a lot of things, but one of the things it did was it changed how the assets should be treated, especially in transfers to housing successors and provided that transfers of housing assets exclude any balances that are retained in the low and moderate income housing fund and ex/khraoded the transfer of any obligations that were retained by the successor agency. it also required that housing successors provide a list to the state called the housing asset transfer list or the hat. that due date was august 1, so pretty much just one month later the city was required to turn in the hat and the ci

planning and redevelopment agencies are clearly involved.reet. we have john's restaurant down stairs. say you want todd remodel it you have to go to planning and say, are we permit todd have a take out restaurant in this location or a fast food restaurant in this location? the planning department and redevelopment and port and others have very, very specific regulations it's almost block by block. have you to bring into the planning department your address so they can look it up on the zoning map to see what you are permitted to have. before you get further involvement in a restaurant the first thing you have to do is see if it's allowed in this location. in many cases you will need to get a conditional use or other authorization which takes months and expensive and can be a deal killer right there. all these other agencies are involved the fire department are involved they are involved in assembly occupancies with an occupant load of 50 or more. the building department looks at construction reasonable doubted things the fire department look
