jody hernandez joins us from the regional park. there was a critical development in this case just in the past hour? >> reporter: we just learned from police within the last hour the district attorney's office has decided not to file charges today. they need more time for lab results before they decide whether or not to file charges. that means the three teenage boys that took part in the alleged attack will be set free, at least for now. this is where the alleged assault took place, east bay regional park. police say two teenage girls and three teenage boys went to the park in richmond last friday night to hang out. >> there was some alcohol involved that the men brought with them and some drinking took place. >> reporter: the girls ages 14 and 17 and passed out, waking up at the park the next morning to realize they'd been sexually assaulted. >> this is a dramatic attack on these two women. it occurred and they're there with acquaintances and not expecting or wanting anything like this to happen and it did. >> reporter: police ar

jody hernandez spoke with the hiker and joins us live from the park with the very latest. >> reporter: sheriff's investigators spent the entire day out here at shiloh park. they came out here collecting human remains after a hiker and his young children discovered a human skull out here yesterday afternoon. now, these are the photographs that hiker chris cain took of that gruesome discovery. a human skull and a tennis shoe. cain and his two young children were hiking along the creek bed yesterday afternoon when they made that troubling find. cain says he knew right away what it was and he called 911 immediately. he's hoping the discover will bring answers to that person's family. >> i hope that the families can be like, at least now we know where they are. the circumstances are terrible, but at least they'll have some kind of closure on where the family member is. >> they've collected a majority of the large bones, but not enough yet to determine who it is, gender, what might have happened to this person. >> reporter: investigators spent the entire day out here at the park carefully a
