new york senator kirsten gillibrand replied, that isn't good enough. she wants her bill which would separate prosecutions from the military. joining me for our daily fix chris cillizza msnbc host of "in play." ann guerin. welcome to you both. chris, first to you. the whole issue that divided claire mccaskill from kirsten gillibrand. year after year presidents have said we've got to fix -- charms, joint chiefs, we've got to fix this problem and nothing happens. it's hard to imagine why this statement would have more of an effect? >> sentiment is one thing, legislation is another, andrea. we know time and time again the best sentiments expressed by democrats, president run into a legislative brick wall. what's fascinating kirsten gillibrand seems unlikely to give this up as her statement you read made clear. she's already gotten, frankly, a lot further than many people who watch congress for a living thought. remember, this was a bill carl levin, chairman of the committee who oversees this bill was opposed to. he did not want her proposal to get a hearin

he's been against kirsten gillibrand's proposal for military sexual assaults, he thinks it goes too faraid she should have had her chance to have that debated on the floor. is he right about that? >> oh, he's absolutely right about that. but i don't know what you can do about it in this environment. you know, the congress has been in gridlock for almost two years now. and i think that their efforts now to get a budget is sort of a last-ditch response to the public's really disgust with how awful washington is functioning and i think it's also a realization on the part of republicans that they are taking the biggest hit here. >> well, e.j., is there a way to change what does seem to be over the last couple of years an inevitable process of constant friction, of waiting until the last minute, waiting until the guillotine is hanging over your neck? >> well, i think the biggest problem has been in the house where a group of very, very conservative members, depending on how you want to count them from 40 to 80 to 100 have been able to sort of stop a lot of things and that you haven't been ab

but a lot of senators wanted more amendments like senator kir kirsten gillibrand's proposal. do you expect that bill will stall in the senate? >> i don't think so. some people will swallow hard because some things that they didn't want on both sides of the aisle aren't going to be in it but that's the process of governing. mick jacker is a great philosopher but if you try sometimes you often get what you need. what we need is some certainty and we need to put this crisis situation behind us. so, yeah, the defense -- i had some amendments that i was hoping would be able to be put on that bill that probably aren't going to happen, but 98% of what people want, the strongest set of sexual assault prohibitions and work in the history of this country is already in the bill. so i think people are going to go ahead and say, yeah, this is the best we can do right now and we're going to get this done. the same thing goes on the budget deal. i mean this is an opportunity -- people have to compromise. you cannot always get everything that you think you need and that's why i think it's so

though a proposal was favored by senator kirsten gillibrand from new york providing for the prosecution of sex crimes outside the military chain of command, it is not included and did not receive the senate vote. some three dozen other reforms in legislation would make the punishment of these crimes more likely while providing more protection for its victims. let me just conclude on this editorial by reading the next to the last paragraph. it says, "other measures in the bill ought to attract broad bipartisan support. the effects on defense of the so-called sequester would be eased by transferring money to operations and training from less essential accounts, such as construction and staffing in office headquarters. the pentagon is still vulnerable to a $50 billion sequester cut in january unless a separate budget deal could be headed off. but passage of the authorization act would prevent the worst disruptions from being ongoing. so it goes on to say that this is over in the house right now and the house very likely is going to pass it over here to the senate, and they strongly support

and a lot of you have probably heard if you follow these types of things kirsten gillibrand introduceda proposal called the military justice improvement act which the whole idea is to take sexual assault cases out of the chain of command. some people agree, some people don't. i personally do because infantry commander is not a lawyer. and an infantry commander probably, like, is dealing with both the accused perpetrator and the person who accused them in their unit. you cannot be, you cannot be objective this those situations. in those situations. so, again, without going into too much detail, this is -- there definitely needs to be something that's done, and the only way you can change the military is literally through an act of congress and the ndaa. so these types of things have been this the works for a while, and people ask, too, like the whole combat exclusion policy was repealed this year. they're like, well, doesn't that just mean more women are going to get raped? i'm like, no, it does not. and diversity in the military is a good thing, and women are just as capable of doing t
